Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides a systematic approach to transport law as applied in Japan. The book describes the main sources of transport law, jurisdiction and courts, state immunity, and the legal role of transport intermediaries, with detailed reference to maritime law, transport by road, transport by air, transport by rail, and inland navigation. A special chapter is devoted to multimodal transport. Among the elements of transport law considered are the legal status of the vessel; its acquisition, ownership, and registration; vessel liens and mortgages; the position of master and crew; maritime salvage and assistance; marine pollution; collision; and carriage of passengers. Other topics discussed include liability and limitation of liability, charter parties, and transport under bill of lading. Case law, intergovernmental cooperation agreements, and interactions with environmental, tax, and competition law are also covered. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling transport contracts or cases affecting Japan. It will also be welcomed by researchers and academics for its contribution to a field that continues to gain significance in the study of comparative law.

Book excerpt: A Short History of Transport in Japan from Ancient Times to the Present is a unique study: the first by a Western scholar to place the long-term development of Japanese infrastructure alongside an analysis of its evolving political economy. Drawing from New Institutional Economics, Black offers a historically informed critique of contemporary planning using the example of Japan’s historical institutions, their particular biases, and the power they have exerted over national and local transport, to identify how reformed institutional arrangements might develop more sustainable and equitable transport services. With chapters addressing each major form of transport, Black examines the predominant role of institutions and individuals – from seventeenth-century shoguns to post-war planners – in transforming Japan’s maritime infrastructure, its roads and waterways, and its adoption of rail and air transport. Using a multidisciplinary, comparative, and chronological approach, the book consults a range of technical, cultural, and political sources to tease out these interactions between society and technology. This spirited new contribution to transport studies will attract readers interested in institutional power, the history of transport, and the development of future infrastructure, as well as those with a general interest in Japan.

Yet just over 100 years ago the movement of goods and people in Japan was largely carried out on foot and by ox cart. Covering 120 years, from 1867 to 1980, Japanese historians of transportation describe the creation of the modern transportation system we see today. Divided into eight historical stages, their survey traces the development of road, river, coastal and rail transport.

Book excerpt: Inclusive Transport: Fighting Involuntary Transport Disadvantages offers readers profound and multifaceted insights into transportation and social equity, guiding transportation and urban studies researchers, planners, and policy makers in evaluating potential solutions to this complex issue. It considers discrimination and its societal consequences, providing a needed perspective on who is left out of transportation planning, and why. The book is systematically divided into 2 parts, Part A is problem oriented and explores the main problems to the transportation disadvantaged; accessibility and affordability. It looks at the consequences of non-accessibility, the problems non-car owners face, and the interplay between housing and transportation; Part B is policy oriented and analyses how current policies tend to forget transport disadvantages. It looks at pragmatic solutions for transport disadvantaged and ends with a design for inclusive transport, being a more radical approach combining sustainability challenges, people's behaviours and emotions, creating more just and equitable mobility. - Synthesizes academic research and narratives on transport disadvantage and the transport disadvantaged, linking the research with current mobility policies and practices - Connects the fight on transport disadvantages with sustainable and smart mobility strategies and looks into car sharing, ride sharing and individualising public transport while de- individualizing car use - Has an extensive usage of data, figures, and examples from around the world, and inspiring mobility plans and policies

Book excerpt: This book reveals the mechanisms underlying the convergence of car fuel economy regulations in Europe, Japan and the US by drawing upon a constructivist theory of International Relations and law that focuses on business competition and environmental regulations. It offers new understanding of the topic of cars and an issue of climate change, discussing the emerging phenomenon of convergence of fuel economy regulations; addressing the role of business actors in pushing for climate change action; proposing the new model of agency with and beyond states; and providing insightful case studies from Europe, Japan and the US. The opening chapter reviews the automobile industry and global climate change, providing a background for the discussion to follow. Chapter 2, Business Actors and Global Environmental Governance, grounds the discussion in the field of environmental governance. The third chapter is a case study examining the construction and timing of the European Union's climate policies for automobile CO2 emissions, discussing the underlying factors and the actors influencing the policies. The following chapter argues that Japan adopted its stringent fuel economy regulations primarily because of industry competitiveness, motivated by stringent environmental regulations in export markets and encouraged by a tradition of ‘co-regulation’ and ‘corporatism’ to enhance the regulations. Chapter 5 asks why the US, the first country to introduce fuel economy regulations, spent two decades in regulatory stagnation, and discusses how recent US fuel economy regulations came to converge with Japanese and European standards. Chapter 6 compares, contrasts and analyzes fuel economy regulations among the three case studies and identifies policy implications for the future climate governance for 2015 and beyond. The final chapter explores applicability of the ‘agency with and beyond the state’ model to other sectors and to climate governance as a whole.
