Book excerpt: A comprehensive study of transfer of technology for deep sea-bed mining under the 1982 Law of the Sea Convention and the controversies that have arisen about it. The book also discusses transfer of technology in international law in general and examines developments since the adoption of the 1982 Convention. These include national mining legislations of industrialized countries, extensive work by the Preparatory Commission for the establishment of the International Sea-Bed Authority and the International Tribunal for the Law of the Sea, and the new compromise Agreement relating to the deep sea-bed mining régime adopted by the General Assembly on 28 July, 1994. The book appears at the time when the Convention enters into force (16 November 1994). It will be of interest to academic lawyers and economists with an interest in the deep sea-bed mining issue, as well as to all those in the sea-bed mining industry, in public service (governmental and inter-governmental) and in UN organizations, who are likely to get involved in deep sea-bed mining and/or transfer of technology issues.

Book excerpt: The Third Uni ted Nations Conference on the Lawof the Sea is preparing rules far the establishment of an international legal regime governing the exploration and exploitation of the resources of the international seabed. The Draft Convention on the Law of the Sea (Informal Text) of 27 August 1980 which has so far been the result of the negotiations during the preceding sessions of the Conference, provides for a so-called "parallel system" under which an international "Enterprise" as weIl as national private or state-owned companies will be granted access to the resources of the international seabed under the control of an International Seabed Authority. The Draft Convention also envisages the condusion of joint venture agreements between the international Enterprise and national companies or consortia, and encourages such cooperation through grant ing various incentives. Such joint ventures will probably play an important part in making the international Enterprise operative in the early years of its existence. At the Conference concerns have been expressed whether and when the Enterprise as a newcomer would be in a position to start seabed mining and to compete effectively with the national companies. The Draft Convention provides for a number of ways and means to enable the Enterprise to develop its technological and financial capabilities for deep sea mining as early as possible.

Available in PDF, EPUB and Kindle. Book excerpt: This three-volume work is concerned with the rules of international law governing the exploitation of the energy and mineral resources to be found on and under the sea-bed. Volume 3 complements the previous two volumes by making available a selection of the principal documents referred to in volume 1 "The" "Continental Shelf" and volume 2 "Sea-Bed Mining." The documents are arranged in three Parts. Part 1 includes document on the continental shelf and the exclusive economic zone; Part 2 covers the United Nations regime for the Area beyond the limits of national jurisdiction, including the landmark Mining Code adopted in July 2000; and Part 3 has a selection of national legislation on sea-bed mining and related co-ordinating treaties. Also included is a table showing the status, as at 1 October 2000, of the UN Convention on the Law of the Sea, 1982 and the 1994 Agreement relating to the Implementation of the UN Convention. This volume will be a useful practical tool for academics, practitioners, and policy-makers concerned with the legal regime governing sea-bed energy and minerals and presents a carefully selected set of documents indispensable for a full understanding of the regimes analysed in the earlier volumes.

Book excerpt: This stronger alliance gave priority to negotiating an internationally acceptable treaty and safeguarding Canada's land-based nickel industry. A second coalition - officers from the Department of Finance, the Department of Industry, Trade, and Commerce, and the Ministry of State for Science and Technology - contended that the push for quantitive restrictions diverted attention from the more crucial areas of protection of technological and financial resources. Riddell-Dixon argues that the dominant coalition succeeded because of ministerial support, structural and functional advantages, and an effective choice of tactics. Consequently they were able to manage other domestic sources of foreign policy. Canada and the International Seabed addresses several debates central to Canadian foreign policy, including the relative importance of domestic determinants and international constraints, the nature of intra-governmental decision-making, the relationship between government decision-makers and interest groups, the role of provincial governments in foreign policy, and the role of international conferences in solving global problems.

Book excerpt: This monograph addresses the legal and policy issues relating to the commercial exploitation of natural resources in outer space. It begins by establishing the economic necessity and technical feasibility of space mining today, an estimate of the financial commitments required, followed by a risk analysis of a commercial mining venture in space, identifying the economic and legal risks. This leads to the recognition that the legal risks must be minimised to enable such projects to be financed. This is followed by a discussion of the principles of international space law, particularly dealing with state responsibility and international liability, as well as some of the issues arising from space mining activities. Much detail is devoted to the analysis of the content of the common heritage of mankind doctrine. The monograph then attempts to balance such interests in creating a legal and policy compromise to create a new regulatory regime.

Available in PDF, EPUB and Kindle. Book excerpt: Unconventional Lawmaking in the Law of the Sea explores the ways that actors operating at the international level develop standards of behaviour to regulate varied maritime activities beyond traditional lawmaking. Other than conventions and customary international law, there is a plethora of international agreements that influence international conduct. This 'soft law' or 'informal law' is now prolific in ocean governance, and so it is time to consider its significance for the law of the sea. This monograph brings together women law-of-the-sea scholars with expertise in specific areas of the law of the sea, as well as international law more generally. Informal lawmaking is examined in relation to ocean resources, maritime security, shipping and navigation, and the marine environment. In each instance, there are reflections on the diverse actors, processes, and outputs shaping the regulation of the oceans. The analyses in this book further consider what this activity means within the rules on the sources, formation, and interpretation of international law. The growing reliance on informal agreements to fill legal gaps provides quick responses to pressing matters. We must assess and understand these new forms of cooperation in order to influence existing treaties or customary international law. Unconventional Lawmaking in the Law of the Sea surveys the scope of informal lawmaking in the law of the sea and evaluates the significance of this activity for the UN Convention on the Law of the Sea, as well as for ocean governance more broadly, now and in the future.
