Monetary penalties outnumber all other sanctions delivered by criminal justice in many jurisdictions, imprisonment included. More people pay fines than go to prison and in some jurisdictions many of those in prison are there because of failure to pay their fines. Therefore, it is surprising how little has been written in the Anglophone academic world about the nature of money sanctions and their specific characteristics as legal sanctions. In many ways, legal innovations related to money sanctions have been poorly understood. This book argues that they are a direct consequence of the changing meaning of money. Considering the ‘meaninglessness’ of modern money, the book aims to examine the history of changing conceptions in how fines have been conceived and used. Using a set of interpretative techniques sensitive to how money and freedom are perceived, the genealogy of the penal fine is presented as a story of constant reformulation in response to shifting political pressures and changes in intellectual developments that influenced ideological commitments of legislators and practitioners. This book is multi-disciplinary and will appeal to those engaged with criminology, sociology and philosophy of punishment, socio-legal studies, and criminal law.

Book excerpt: Gabriel Tarde was a highly influential figure in 19th century French sociology: a prolific and evocative writer whose understanding of the social differed radically from that of his younger opponent Emile Durkheim. Whereas Durkheimian sociology went on to become the core of the social scientific canon throughout much of the 20th century, Tarde’s sociology fell out of the picture, and he was remembered mostly through a few footnotes in which Durkheim dismissed him as an individualist, a psychologist and a metaphysician. The social sciences and humanities are now being swept by a Tardean revival, a rediscovery and reappraisal of the work of this truly unique thinker, for whom ‘every thing is a society and every science a sociology’. Tarde is being brought forward as the misrecognised forerunner of a post-Durkheimian era. Reclaimed from a century of near-oblivion, his sociology has been linked to Foucaultian microphysics of power, to Deleuze's philosophy of difference, and most recently to the spectrum of approaches related to Actor Network Theory. In this connection, Bruno Latour hailed Tarde’s sociology as "an alternative beginning for an alternative social science". This volume asks what such an alternative social science might look like. It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely.
