Book excerpt: The Secret Treaties of History is the first general index for locating the texts of agreements that nations entered into secretly. It lists and explains 593 secret treaties made from 1521 to 2000 among 110 nations and political entities. Each secret treaty entry in the list has the treaty's title, its contracting states, the city and date of signature, a citation to at least one source of text and/or credible information, and an annotation for its background or content. Most of these treaties were concluded for political or military ends. They are found among scores of treaty collections, in documentaries, in government reports, in research reports based on scholarly work in archives, in a small number of history books, and in articles in learned journals and articles by investigative journalists. The entire list, which makes up Chapter 1, is indexed by nation. It will be of direct use to professors and students of history, political science, and international law and, of course, to librarians and journalists. Chapter 2 is a guide to the many sources of secret treaty texts cited to in the first chapter. Chapter 3 is an annotated bibliography for the study of secret diplomacy and secret agreement making and for statements (including denials) made by American leaders on secrecy in diplomacy and treaty negotiations. Chapter 4 is an essay on the characteristics of secret treaties themselves and their signers. Chapter 5 explains the legal rules that the American President must abide by when he makes confidential, unpublished treaties with other world leaders. This chapter should interest foreign government officials, legal theorists, and international lawyers. Chapter 6 consists of an introduction to the Treaty of Crépi of 1544, four pages of photocopies of the original handwritten text of the secret articles to this treaty, and an English language translation of them. Neither the French nor the Spanish Ministries of Foreign Affairs have a copy of this treaty's secret articles, nor are they published in any other book or journal article. This text and translation will be useful to a historian or biographer who needs full information on Francis I of France or Charles V of Spain. The appendix is an alphabetized list of foreign and specialty words, abbreviations, acronyms, idioms, and phrases found particularly within treaties or used in the treaty making process. Following the appendix, are the two indexes, for Chapters 1 and 3. The Secret Treaties of History is meant for purchase by research libraries, law school libraries, historical archives, international affairs interest groups, lobby groups, and European ministries of foreign affairs.

Lundy explores the relationship between formal treaties under international law and documents of lesser status, commonly known as memorandums of understanding. The book critically examines the gaps in diplomatic policy, with a particular focus on the Australian Government’s casual approach to these non-treaty documents. Featuring original copies of the historic Five Eyes Agreement between the British Government and the United States, the book offers a unique perspective on significant international relations. Lundy delves into the consequences of relying on such agreements, notably highlighting the atomic bomb tests at Maralinga in South Australia. Beyond identifying these issues, the book proposes methods to address the inconsistencies in how the Australian Government handles non-treaty documents. It also compares the approaches of other nations, including the United States, the United Kingdom, and the European Community, offering solutions to the challenges Australia has faced in the past.

Cloth. $95. * Surveys the League's components and the role of its chief associated bodies, the International Court of Justice and the International Labor Organization. Other sections consider its approach to open and secret diplomacy, the ratification of conventions and the function of related technical organizations. The author, though enthusiastic about the League, appreciates the weaknesses in its charter and organization. He argues that these flaws are not inherent but are a consequence of the League's reliance on prior international law, which is plagued by weakness and ambiguity.

Available in PDF, EPUB and Kindle. Book excerpt: Military alliances drive international politics. They embody conflict and cooperation among states and shape the international political landscape. Despite the profound effect alliances have on the course of international politics, many gaps remain in our understanding of their formation, continuance, and cohesion. In this book, Patricia Weitsman introduces a comprehensive theory that unifies current ideas about alliances and examines the relationship between threat and alliance politics under conditions of both war and peace. Examining military alliances before and during World War I, Weitsman provides a new interpretation of the politics of the great powers of this period. She reveals that states frequently form alliances to keep peace among the allied countries, not simply to counter shared external threats. Though alliances may be perceived by others to present a unified and threatening front, countries often face significant threats from within their own alliances. It is this paradox that underscores Weitsman's theory: although alliances are frequently forged to sustain peace, they may, in fact, increase the prospects of war.

This book was released on 2020-09-03 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: This addition to the Elements of International Law series explores the role of international law as an integral part of the Russian legal system, with particular reference to the role of international treaties and of generally-recognized principles and norms of international law. Following a discussion of the historical place of treaties in Russian legal history and the sources of the Russian law of treaties, the book strikes new ground in exploring contemporary treaty-making in the Russian Federation by drawing upon sources not believed to have been previously used in Russian or western doctrinal writings. Special attention is devoted to investment protection treaties. The importance of publishing treaties as a condition of their application by Russian courts is explored. For the first time a detailed account is given of the constitutional history of treaty ratification in Russia, the outcome being that present constitutional practice is inconsistent with the drafting history of the relevant constitutional provisions. The volume gives attention to the role of the Russian Supreme Court in developing treaty practice through the issuance of "guiding documents" binding on lower courts, the reaction of the Russian Constitutional Court to judgments of the European Court of Human Rights, and the place of treaties as an integral part of the Russian legal system. Butler further explores the hierarchy of sources of law, together with other facets of Russian arbitral and judicial practice with respect to treaties and other sources of international law. He concludes with a consideration of the 'generally-recognized principles and norms of international law' and their role as part of the Russian system.

The texts are uniformly structured: (I) Purpose and Function of the Article, (II) Historical Background and Negotiating History, and (III) Elements of the Article. The Vienna Convention on Treaties between States and IOs and between IOs is taken into account where appropriate. In sum, the present Commentary contains a comprehensive legal analysis of all aspects of the international law of treaties. Where the law of treaties reaches into other fields of international law, e.g. the law of state responsibility, the relevant interfaces are discussed and contextualized. With its focus on international practice, the Commentary is addressed to academia, as well as to practitioners of international law.
