The Committee is sceptical that other Member States would be willing to renegotiate existing EU law so as to allow the UK on its own to reduce its degree of integration, especially where this could be seen as undermining the integrity of the Single Market. Other Member States appear to want the UK to remain an EU Member. Closer Eurozone integration is a potential risk to the position of the UK and other non-Eurozone states in the EU. However, the December 2012 agreement on the Single Supervisory Mechanism for banking regulation shows what the UK can achieve to protect its position. The Eurozone is in any case far from a homogenous bloc and the expansion and closer integration of the Eurozone does not therefore necessarily render the UK's position in the EU impossible or worthless. This report does not examine whether the UK should remain in the EU or withdraw. However, it agrees with the Government that, if the UK were to leave the EU, the current arrangements for relations with the EU which are maintained by Norway or Switzerland would not be appropriate for the UK. If it is in the UK's interest to remain in the Single Market, the UK should either remain in the EU, or launch an effort for radical institutional change in Europe to give decision-making rights in the Single Market to all its participating states

Book excerpt: Under the Public Bodies Reform Programme the Government is reducing the number of its arm's length bodies from 904 to between 632 and 642 by the end of the current Spending Review period and will have a substantial and lasting impact. The Programme is intended to improve accountability for functions currently carried out at arm's length from Ministers. The Cabinet Office says it is on track to make £2.6 billion of administrative savings by 2015. However there are substantial reservations about the robustness of this claim. Key concerns are that: there is a risk departments are claiming savings which are actually cuts to services, when they should be including only genuine savings arising from administrative reorganisations; estimates of transition costs such as redundancy and pension costs are incomplete; the savings estimate does not fully take account of the ongoing costs to other parts of government of taking on functions being transferred from abolished bodies and some departments have wrongly included wider savings from bodies being retained, rather than just administrative savings from bodies being abolished or substantially reformed. The Cabinet Office has accepted that its savings estimate needs to be reassessed and has undertaken to 'rebase' it. Focus now needs to be on managing the Programme effectively. Departments have decided on the form of individual reorganisations themselves without clear direction from the centre, leading in some cases to inconsistent treatment of bodies with similar functions. Furthermore, departments may not be getting the best value for money from the sale or transfer of assets of bodies being abolished

Book excerpt: HMRC estimates that the tax gap - the difference between taxes due and the amount actually collected - stood at £35 billion (7.9% of tax due) in 2009-10, although other estimates suggest the figure is much greater. The Compliance and Enforcement Programme brought in £4.32 billion of tax revenue over the five years to 2010-11and is expected to generate a further £8.87 billion by 2014-15. However, in shedding more than 3,300 staff, the Department lost £1.1 billion in potential tax revenue: about £10 in tax lost for every £1 in running costs saved. The Committee is also not confident that the Department is sufficiently clear about the marginal rate of return it could achieve from different levels of spending. In order to live within funding limits, the Department had to defer the introduction of new systems or reduce their scope. In particular, by delaying implementation of its new Caseflow and Spectrum systems, the Department reduced the expected additional tax revenue of £743 million by 2010-11 to £547 million by 2014-15. In this Spending Review period £917 million has been allocated to further activities to tackle tax evasion and avoidance, and to collect more debt. This investment is more than double the money spent on the Programme over the last five years, and is expected to generate an additional £7 billion a year by 2014-15. It is therefore essential that the Department learns and applies lessons learnt. There was also alarm at reports that the Department had advised that the use of managed service companies to avoid tax could ever be appropriate for full-time employees of public bodies

The Committee welcomes this major step forward in improving transparency and accountability and highlights some of the information it contains: at 31 March 2010 the government's public service pensions liability was around £1,132 billion; the present value of its future commitments under PFI schemes was £131.5 billion; the government wrote off £10.9 billion in unpaid taxes and expected to have to pay £15.7 billion for outstanding clinical negligence claims; cost of future nuclear decommissioning (£56.7 billion); the need for stronger accountability systems to secure effective responsibility for cost and value for money at local levels - academies, Free Schools, Foundation Trusts and GP consortia. But the WGA will only serve its purpose- showing what the government owns, owes, spends and receives - if it is timely and robust. The figures in the first audited WGA are too dated because Treasury took 20 months to prepare and publish the report. Treasury must address the issues that led the Comptroller and Auditor General to qualify his audit opinion on the WGA 2009-10. A key issue is Treasury's decision to deviate from accounting standards, by omitting Network Rail, the publicly owned banks, and various other government-controlled or owned bodies from the WGA. The Committee sets out a set of principles that future accounts should follow.

Nevertheless, it expects both bodies to set out what actions they have taken to improve their financial management and avoid exceeding their allocated resources in the future.

Book excerpt: The Commons Public Accounts Committee publishes its 61st Report of the Session which, on the basis of evidence from the Cabinet Office and HM Revenue and Customs (HMRC), examined tax disputes. At 31 March 2011 HM Revenue & Customs was seeking to resolve tax issues valued at over £25 billion with large companies, some of which included disputes over outstanding tax. In this report, the Committee expresses concern about how the Department handled some cases involving large settlements and that there needs to be proper separation between the negotiation of tax settlements and the authorization of such settlements. The Committee also states that HMRC made matters worse by trying to avoid scrutiny of these settlements, keeping confidential the details of specific settlements with large companies. This effects Parliament's ability to establish value for money, compounded further by imprecise, inconsistent and potentially misleading answers given by senior departmental officials, including the Permanent Secretary for Tax in particular over his evidence on his relationship with Goldman Sachs, in facilitating a settlement with the company over their tax dispute. HMRC governance processes in these matters were inconsistent and it has now appointed two new Commissioners with tax expertise, and plans to introduce a new assessor role to permit independent review of large settlements before they are finalised. The Committee further states that it saw little evidence of personal accountability within the Department, and that a perception has developed that large companies are treated more favourably, receiving preferential treatment compared to small businesses and individuals.

As the sector has begun the transition to a new system of funding in which Funding Council grants to institutions will be replaced by higher tuition fees the Higher Education Funding Council's role in the allocation of funds & influence will diminish. The Department for Education will need to provide new powers for the Funding Council to regulate these institutions and the Funding Council must monitor risks as they emerge and respond quickly. All the indications are that more institutions will charge significantly higher fees than was anticipated by the Department. The Office for Fair Access has yet to agree the measures universities will adopt to widen participation where the proposed fees are above the £6000 level. However it is likely that a significant funding gap of hundreds of millions of pounds for the taxpayer will occur. The Funding Council also has a responsibility for promoting value for money, although it does not assess the value for money of institutions. In future, prospective students will need better information to make an informed choice about where they will study, including comparable information on the financial health of, and value for money provided by, individual institutions. The Funding Council does not normally publish the names of institutions it judges to be at financial risk, so as to protect them while they are in recovery. Now that students are required to make a substantial financial investment in their degree, the Funding Council needs to strike a suitable balance between the interests of institutions and those of prospective students

Book excerpt: The InterCity East Coast Mainline is a hugely significant rail service, carrying around 19 million passengers a year between London, the North East and Scotland. In 2005, a contract was awarded to Great North Eastern Railway, but financial difficulties at its holding company meant that the franchise failed 18 months later. In 2007, a new contract was awarded to National Express to run the franchise on the basis that it would pay the Department £1.4 billion over seven and a half years. At the time, the East Coast franchise was one of three operated by National Express. As a result of the economic downturn, expected passenger revenues did not materialise and National Express announced in July 2009 that it wanted to opt out of the contract and would not provide the necessary financial support to the East Coast franchise. National Express paid just £120 million to walk away from a contract worth £1.4 billion to the taxpayer. The Department turned down the offer of an extra £30 million for a 'no fault' exit in order to send a warning to other holding companies. But the Department completely undermined its position by making clear that the termination would not be held against National Express in future bids. In doing so, the Department allowed National Express to get away scot free and with its reputation intact. By its actions in this case, the Department has potentially incentivised other holding companies with loss-making franchises to terminate, rather than renegotiate, their contracts. In future the Department must make clear to such companies that failure to deliver on their obligations will have serious lasting consequences.

The Funding Package does not cover the totality of the costs to the public purse of delivering the Games and their legacy, which are already heading for around £11 billion. Operational and financial risks have emerged in areas of the London Organising Committee of the Olympic and Paralympic Games' responsibility, and LOCOG itself now has almost no contingency left to meet further costs, even though it has done well in its revenue generation. The number of security guards required in and around the venues has more than doubled, and renegotiation of the contract for venue security does not appear to have secured any price advantage. With only 109,000 new people regularly participating in sport against an original target (which the new Government chose not to adopt) of 1 million by March 2013, the Department for Culture, Media and Sport has got poor value for money for the £450 million spent through sporting National Governing Bodies. It is unclear what the sporting participation legacy of the Games is intended to be. Responsibility for delivery of all legacy matters is shared across many different parts of Government, and this rings alarm bells about the effective integration of the various legacy plans and about clear accountability to the taxpayer.

The changes are likely to reduce costs to taxpayers of the pension schemes by £67 billion over 50 years, with costs stabilising at around 1% of Gross Domestic Product (GDP) or 2% of public expenditure. The Committee is concerned that the Treasury did not test the potential impact of changes in some of the key assumptions underpinning the long-term cost projections. In addition, the Treasury has not tested whether reducing the value of pensions would affect the public sector's ability to recruit and retain high quality staff. Three-fifths of the savings to the taxpayer were expected to come from the cost sharing and capping mechanism - a transfer, from employers to employees, of extra costs that arise if pensioners live longer than previously expected. Employees would potentially pay 70% more for their pensions over the next 50 years if life expectancy continues to increase more than expected. Implementation remains on hold while the Government decides how to respond to the Independent Public Service Pensions Commission (the Hutton Commission). Public service employees do not have a clear understanding of the value of their pensions because they are not provided with clear and intelligible information to enable them to make rational decisions. Further changes to public service pensions are expected as Hutton's recommendations are implemented, but this should bring a period of stability and certainty for long-term public service pensions policy.
