Book excerpt: Permanent organizations of the society of nations began with the Second Hague Peace Conferences of 1899 and 1907 and the Permanent Court of Arbitration founded by the Peace Conference of 1899. The establishment of the League of Nations by the Paris Peace Conference of 1919 began a second period in the history of international organization. A third period began in 1945 when the United Nations replaced the League of Nations. In his prize-winning book, The United States and the First Hague Peace Conference, Professor Davis told the story of American participation in the Peace Conference of 1899. In the present volume he focuses on the role of the United States in the Peace Conference of 1907, but also describes the connections between that conference and the Pan-American Conferences, the Geneva Conference of 1906, the London Naval Conference and may other important relations of the era. He concludes this new book with a discussion of connections between the internationalism of the Hague period and the League of Nations and the United Nations.

Book excerpt: "Since the publication of the first edition of War and Cultural Heritage in 2004 there have been a number of important developments. The Second Protocol to the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict has entered into force and there are now 64 States Parties. The Committee for the Protection of Cultural Property in the Event of Armed Conflict provided for under the Second Protocol has been set up and has adopted the Guidelines for the Implementation of the Second Protocol. Disbursements have been made from the Fund for the Protection of Cultural Property in the Event of Armed Conflict. In 2008 the United Kingdom published for public consultation the draft Cultural Property (Armed Conflicts) Bill, the legislation to enable the United Kingdom to become a Party to the 1954 Convention and its two Protocols and in 2009 the United States ratified the 1954 Hague Convention (but neither of its two Protocols). The time to publish a second edition of War and Cultural Heritage to take account of these and other developments is long overdue. The civil war in Syria has resulted in extensive destruction of that nation's cultural heritage. More recently in the conflict of Mali Islamist insurgents retreating from Timbuktu set fire to a library containing thousands of priceless historic manuscripts, described by the town's mayor as a 'devastating blow' to world heritage. These incidents demonstrate the need for all parties engaged in armed conflict to have regard to the rules of international law concerning the protection of cultural property. War and Cultural Heritage contains in a single volume an article-by-article commentary on the 1954 Hague Convention and its Two Protocols. The book also analyses other instruments of international humanitarian law relevant to the protection of cultural property. These include the 1949 Geneva Conventions and the 1977 Additional Protocols, which had a profound influence on the drafting of the 1954 Convention and the Second Protocol respectively. The book also examines the extent to which the provisions of the 1954 Convention and its Protocols are part of customary international humanitarian law. The book takes into account the latest developments regarding the international efforts to secure restitution of Holocaust-looted cultural property, including the work of the UK's Spoliation Advisory Panel"--Page 4 of cover

Available in PDF, EPUB and Kindle. Book excerpt: The exact legacies of the two Hague Peace Conferences remain unclear. On the one hand, diplomatic and military historians, who cast their gaze to 1914, traditionally dismiss the events of 1899 and 1907 as insignificant footnotes on the path to the First World War. On the other, experts in international law posit that The Hague’s foremost legacy lies in the manner in which the conferences progressed the law of war and the concept and application of international justice. This volume brings together some of the latest scholarship on the legacies of the Hague Peace Conferences in a comprehensive volume, drawing together an international team of contributors.

Book excerpt: Excerpt from American Addresses at the Second Hague Peace Conference The following collection consists of addresses delivered by three members of the American delegation to the Second Hague Peace Conference, dealing with the subjects of the immunity of unoffending private property of the enemy upon the high seas, the limitation of force in the collection of contract debts, arbitration, an international prize court, and the project for the establishment of a permanent court of arbitral justice, composed of judges acting under a sense of judicial responsibility and representing the various languages and systems of law. General in their nature, it is believed that the publication of these addresses may be of some interest, if not of permanent value. It has been deemed advisable to include, by way of introduction, an address delivered by each of the three members upon the conference and the results actually achieved by it. A brief note on formal and informal addresses at The Hague has been prefixed, and, where considered necessary to the understanding of the addresses proper, a brief introductory note has been supplied. An appendix has been added, containing the texts discussed in the various addresses. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: In 2009 it was ten years since the adoption of the Second Protocol to the 1954 Hague Convention for the Protection of Cultural Property in the Event of an Armed Conflict. To celebrate this anniversary, a variety of contributions, focussing on the legal and cultural aspects of the Protocol are presented by Van Woudenberg and Lijnzaad. The innovative aspects of the Second Protocol such as enhanced protection, criminal responsibility and jurisdiction, and the protection of cultural property in armed conflicts not of an international character are addressed. Some country-specific studies are included. It is hoped that this publication will inspire States to accede to the Protocol and that it will serve as a source of inspiration to legal advisers, military personnel and cultural property experts.

This book was released on 2018-10-18 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: Beginning with the extraordinary rescript by Tsar Nicholas II in August 1898 calling the world's governments to a disarmament conference, this book charts the history of the two Hague peace conferences of 1899 and 1907 – and the third conference of 1915 that was never held – using diplomatic correspondence, newspaper reports, contemporary publications and the papers of internationalist organizations and peace activists. Focusing on the international media frenzy that developed around them, Maartje Abbenhuis provides a new angle on the conferences. Highlighting the conventions that they brought about, she demonstrates how The Hague set the tone for international politics in the years leading up to the First World War, permeating media reports and shaping the views and activities of key organizations such as the inter-parliamentary union, the international council of women and the Institut de droit international (Institute of International Law). Based on extensive archival research in the Netherlands, Great Britain, Switzerland and the United States alongside contemporary publications in a range of languages, this book considers the history of the Hague conferences in a new way, and presents a powerful case for the importance of The Hague conferences in shaping twentieth century international politics.

Book excerpt: This volume of the Proceedings of the Nineteenth Session of the Hague Conference on Private International Law encompasses all preparatory work and records of meetings which led to the adoption of the Hague Convention on the Law Applicable to Certain Rights in Respect of Securities held with an Intermediary (the Hague Securities Convention). The signing of this Convention on 5 July 2006 by two of the world's major financial markets, the United States and Switzerland, shows the relevance of the new treaty. Traditional rules, based on physical transfers and direct holdings, are too diverse and inadequate to deal with securities which are nowadays transferred and pledged by electronic entries to accounts with clearing and settlement systems and other intermediaries. By identifying specific conflict rules, the Hague Securities Convention provides a means to remedy this lack of legal certainty which has characterized for too long the field of security transactions. The Proceedings will enable the financial world, but also legal practitioners and academics to grasp the background and full objectives of this very innovative international instrument.
