Previous literature has focused on how EMU came into being and on the policy issues that it raises. European States and the Euro seeks to move the discussion forwards by offering the first systematic evaluation of how it is affecting EU states, both members and non-members of the Euro-Zone. It is the first book to explicitly situate EMU in the growing literature on Europeanization. It examines the effects on public policies, political structures, discourses, and identities. The book seeks to identify the scope of EMU's effects, the direction that it imparts to political and policy changes, the mechanisms by which it produces its effects, and the role of domestic institutions, political leadership and specific forms of discourse in shaping responses. In addition, the book assesses how, and with what effects, EMU is affecting key policy sectors labour markets and wages, welfare states, and financial market governance. What conditions the degree of convergence discernible in these sectors? Finally, the book seeks to 'contextualize' EMU by assessing its effects both in comparison with other variables like globalization and in a historical perspective of the European Monetary System as a 'training ground'. The book combines sectoral and country case studies with a thematic treatment by recognized experts in their fields. It moves from globalization, through EU-level changes, to member states and finally to specific sectors. The main conclusions are that EMU is most important in affecting the timing, tempo and rhythm of domestic change that these changes are experienced pre-eminently at the level of policy; that it strengthens pressures for convergence; but that different domestic institutional arrangements and discourses lead to variations in policy processes and effects and in the way change is 'framed'. In particular, whilst EMU contains a neo-liberalizing tendency exhibited most clearly in financial market effects, it is not to be characterized as a neo-liberal project by means of which the EU is becoming an economic and social space simply converging around Anglo-American market capitalism.

Book excerpt: The European Scrutiny Committee's report (HCP 1817, ISBN 9780215043665) on the Treaty on Stability, Coordination and Governance (SCG), states that it is impossible to enforce and there are serious concerns over the rule of law, with no concessions for the UK. The Committee also views the SCG Treaty as doing little towards solving the eurozone crisis, except providing some comfort to international markets. It is also possible that the Treaty will prove to be politically impossible to enforce. Some form of breakdown of the eurozone clearly remains possible. The approach taken to proceed with the fiscal compact raises a fundamental question about the application of the rule of law within the EU. The SCG Treaty would have been an EU treaty but for the veto. However, the EU institutions and the governments of the 25 Member States who have signed the Treaty, have embarked on a dangerous precedent in seeking to attain their political objectives irrespective of the rule of law in the EU. The Government has made clear that it has serious reservations about the legality of what has been done, but the question of what it intends to do remains unsatisfactorily unresolved. When looking at the unprecedented letter sent from Sir John Cunliffe, the UK Ambassador to the EU, to the Secretary-General of the Council on 22 February, it appears that the Government does not want to stand in the way of 25 States reinforcing the eurozone, but sees the use of the institutions outside the EU Treaties, without the consent of all 27 Member States, as unlawful, irrespective of the consequences to and the lack of concessions for the United Kingdom and the current failure to take the issue of legality further. To the Committee it therefore seems that the SCG Treaty must be deemed unlawful in the Government's view. Although questions have been raised as to what the UK achieved by the use of its veto, the Committee concludes that the veto was justified because of the very real concerns about a breach of EU law, even if this was not the reason given exclusively for the use of the veto in the first place. The Committee notes that there is an increasing tendency for the EU to propound the virtues of the rule of law but not to apply it in practice.

To answer these questions it is essential to look at the role of national parliaments in the EU system first. In a second step we want to have a closer look at the role of the parliament in the Spanish political system to better understand the then following part that is dealing with what scrutiny measures the Cortes possess and how actively it has been using them during the Eurozone-crisis. During the last decades, the process of European integration has fundamentally changed patterns of governance in Europe and led to the establishment of a new institutional framework on the continent. The ongoing transfer of competencies from the national to the supranational level has created a multi-level governance system in which new institutions emerged and already existing ones are looking for a new role in this very complex system. Since the national parliaments represent the will of the citizens, they play a crucial role in legitimating decision-making at the EU level and therefore are under pressure to find ways of influencing EU policy. This is especially crucial since national executives to an increasing degree exercise legislative competencies at the EU level (namely in the EU Council) and as a consequence increasingly restrict national parliaments in influencing policy-making at the EU level. The beginning of the European debt crisis in 2010 reinforced this tendency, since measures to counter the Eurozone-crisis, such as the establishment of the European Stability Mechanism (ESM), intergovernmental treaties outside the legal framework of the EU like the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union (TSCG, also known as Fiscal Compact), and especially the European Semester strongly limit the national parliament’s key prerogative: budgetary authority. Since their legislative competencies have been limited, national parliaments have elaborated different mechanisms to scrutinize decision-making at the supranational level to ensure democratic legitimacy.
