Excerpt: ... chapter iii. on the solicitude of the state tor the positive welfahe of the citizen. Keeping in view the conclusions arrived at in the last chapter, we might embody in a general formula our idea of State agency when restricted to its just limits, and define its objects as all that a government could accomplish for the common weal, without departing from the principle just established; while, from this position, we could proceed to derive the still stricter limitation, that any State inter-ference in private affairs, not directly implying violence done to individual rights, should be absolutely condemned. It will be necessary, however, to examine in succession the different departments of a State's usual or possible activity, before we can circumscribe its sphere more positively, and arrive at a full solution of the question proposed. A State, then, has one of two ends in view; it designs either to promote happiness, or simply to prevent evil; and. in this latter case, the evil which arises from natural causes, or that which springs from man's disregard for his neighbour's rights. If it restricts its solicitude to the second of these objects, it aims merely at security j and I would here / oppose this term security to every other possible end of !v State agency, and comprise these last under the general head . of Positive Welfare. Further, the various means adopted; by a State, as subservient to its purposes, affect in very different measure the extension of its activity. It may endeavour, for instance, to secure the accomplishment of these immediately, either with the aid of coercio

Book excerpt: Excerpt from The Sphere and Duties of Government: Translated From the German But whatever the natural course of political development may be, and whatever the relation between the desire for freedom and the excessive tendency to governmental activity, it is still evident that the inquiry into the proper aims and limits of State agency must be of the highest importance nay, that it is perhaps more vitally momentous than any other political question. That such an investigation com prises the ultimate object of all political science, has been already pointed out; but it is a truth that admits also of extensive practical application. Book excerpt: This text is important both as one of the most interesting contributions to the liberalism of the German Enlightenment, and as the most significant source for the ideas which John Stuart Mill popularized in his essay On Liberty. Humboldt's concern is to define the criteria by which the permissible limits of the state's activities may be determined. His basic principle, like that of Mill, is that the only justification for government interference is the prevention of harm to others. He discusses in detail the role and limits of the state's responsibility for the welfare, security and morals of its citizens. Humboldt's special achievement in this work is to enlarge our sense of what a liberal political theory might be by his particularly sensitive grasp of the complexity of our attitudes to and our need of other people. Dr Burrow has based his translation on Coulthard's version of 1854. In an important introduction, he provides a most perceptive as well as scholarly guide to Humboldt's political thought.

Book excerpt: Originally published in 1870, this essay by the American anarchist and political philosopher Lysander Spooner is here reproduced. Described by Murray Rothbard as “the greatest case for anarchist political philosophy ever written”, Spooner’s lengthy essay is still referenced by anarchists and philosophers today. In it, he argues that the American Civil War violated the US Constitution, thus rendering it null and void. An indispensable read for political historians both amateur and professional alike. Many of the earliest books, particularly those dating back to the 1900s and before, are now extremely scarce and increasingly expensive. We are republishing these classic works in affordable, high quality, modern editions, using the original text and artwork.

Book excerpt: William Penn (1644-1718) played a crucial role in the articulation of religious liberty as a philosophical and political value during the second half of the seventeenth century and as a core element of the classical liberal tradition in general. Penn was not only one of the most vocal spokesmen for liberty of conscience in Restoration England, but he also oversaw a great colonizing endeavor that attempted to instantiate his tolerationist commitments in practice. His thought has relevance not only for scholars of English political and religious history, but also for those who are interested in the foundations of American religious liberty, political development, and colonial history. This volume illuminates the origins and development of Penn's thought by presenting, for the first time, complete and annotated texts of all his important political works. Penn's early political writings illuminate the Whig understanding of English politics as guided by the ancient constitution (epitomized by Magna Charta and its elaboration of English native rights). The ancient constitution symbolized, for Penn and other Whigs, a balanced governing relationship between King and Parliament, established from antiquity and offering a standard against which to judge the actions of particular Parliaments. The values of liberty, property, and consent (as represented by Parliament) provide the basis for Penn's advocacy of liberty of conscience in Restoration England. His social status, indefatigable energy for publication, and command of biblical and historical sources give Penn's political writings a twofold significance: as a window on toleration and liberty of conscience, perhaps the most vexing issue of Restoration politics; and as part of a broader current of thought that would influence political thought and practice in the colonies as well as in the mother country.
