Available in PDF, EPUB and Kindle. Book excerpt: In this work it is argued that legal justification can best be studied from a procedural, dialogical point of view: legal statements are justified if the audience is convinced in an argumentative dialog. The formalized and implemented model DiaLaw guards the procedure in which two players aim at justifying statements. DiaLaw shows the advances and problems linked to procedural models of legal justification. Moreover, an instructive discussion of the different models of procedural justification is provided. It is stressed that in legal justification not only logically compelling arguments should be considered, but also convincing arguments. Therefore DiaLaw also deals with the rhetorical, psychological aspects of argument. This book is relevant for scholars in legal theory, artificial intelligence, and argumentation, and can be used in graduate courses on AI and Law, and legal argumentation.

Available in PDF, EPUB and Kindle. Book excerpt: The first move, or “key,” of a conventional chess problem is almost never a capture. But convention is turned on its head in this collection of 200 original problems in which every move of the white pieces requires the capture of a black piece! The advantages are several: for one thing, jaded problem fans are sure to appreciate the totally fresh approach. For another, unlike traditional problems, which require a rarefied and artificial type of thinking, these “take and mate” problems demand the same thought processes that players use in over-the-board play. Arranged in order of difficulty and coupled with a built-in scoring system, they offer a unique way for players at all levels to sharpen their tactical skills.

His "phenomenological" approach marks a sharp departure from older homiletics.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers multiple interconnected perspectives on the largely untapped potential of elementary number theory for mathematics education: its formal and cognitive nature, its relation to arithmetic and algebra, its accessibility, its utility and intrinsic merits, to name just a few. Its purpose is to promote explication and critical dialogue about these issues within the international mathematics education community. The studies comprise a variety of pedagogical and research orientations by an international group of researchers that, collectively, make a compelling case for the relevance and importance of number theory in mathematics education in both pre K-16 settings and mathematics teacher education. Topics variously engaged include: *understanding particular concepts related to numerical structure and number theory; *elaborating on the historical and psychological relevance of number theory in concept development; *attaining a smooth transition and extension from pattern recognition to formative principles; *appreciating the aesthetics of number structure; *exploring its suitability in terms of making connections leading to aha! insights and reaching toward the learner's affective domain; *reexamining previously constructed knowledge from a novel angle; *investigating connections between technique and theory; *utilizing computers and calculators as pedagogical tools; and *generally illuminating the role number theory concepts could play in developing mathematical knowledge and reasoning in students and teachers. Overall, the chapters of this book highlight number theory-related topics as a stepping-stone from arithmetic toward generalization and algebraic formalism, and as a means for providing intuitively grounded meanings of numbers, variables, functions, and proofs. Number Theory in Mathematics Education: Perspectives and Prospects is of interest to researchers, teacher educators, and students in the field of mathematics education, and is well suited as a text for upper-level mathematics education courses.

Available in PDF, EPUB and Kindle. Book excerpt: This intellectual biography of Immanuel Kant's early years-- from 1746 when he wrote his first book, to 1766 when he lost his faith in metaphysics --makes an outstanding contribution to Kant scholarship. Schönfeld meticulously examines most of Kant's early works, summarizes their content, and exhibits their shortcomings and strengths. He places the early theories in their historical context and describes the scientific discoveries and philosophical innovations that distinguish Kant's pre-critical works. Schönfeld argues that these works were all aspects of a single project carried out by Kant to reconcile metaphysical and scientific perspectives and combine them into a coherent model of nature.

Available in PDF, EPUB and Kindle. Book excerpt: Examining the role of implicit, unconscious thinking on reasoning, decision making, problem solving, creativity, and its neurocognitive basis, for a genuinely psychological conception of rationality. This volume contributes to a current debate within the psychology of thought that has wide implications for our ideas about creativity, decision making, and economic behavior. The essays focus on the role of implicit, unconscious thinking in creativity and problem solving, the interaction of intuition and analytic thinking, and the relationship between communicative heuristics and thought. The analyses move beyond the conventional conception of mind informed by extra-psychological theoretical models toward a genuinely psychological conception of rationality—a rationality no longer limited to conscious, explicit thought, but able to exploit the intentional implicit level. The contributors consider a new conception of human rationality that must cope with the uncertainty of the real world; the implications of abandoning the normative model of classic logic and adopting a probabilistic approach instead; the argumentative and linguistic aspects of reasoning; and the role of implicit thought in reasoning, creativity, and its neurological base.
