Available in PDF, EPUB and Kindle. Book excerpt: The Anti-Federalist Luther Martin of Maryland is known to us—if he is known at all—as the wild man of the Constitutional Convention: a verbose, frequently drunken radical who annoyed the hell out of James Madison, George Washington, Gouverneur Morris, and the other giants responsible for the creation of the Constitution in Philadelphia that summer of 1787. In Bill Kauffman's rollicking account of his turbulent life and times, Martin is still something of a fitfully charming reprobate, but he is also a prophetic voice, warning his heedless contemporaries and his amnesiac posterity that the Constitution, whatever its devisers' intentions, would come to be used as a blueprint for centralized government and a militaristic foreign policy. In Martin's view, the Constitution was the tool of a counterrevolution aimed at reducing the states to ciphers and at fortifying a national government whose powers to tax and coerce would be frightening. Martin delivered the most forceful and sustained attack on the Constitution ever levied—a critique that modern readers might find jarringly relevant. And Martin's post-convention career, though clouded by drink and scandal, found him as defense counsel in two of the great trials of the age: the Senate trial of the impeached Supreme Court justice Samuel Chase and the treason trial of his friend Aaron Burr. Kauffman's Luther Martin is a brilliant and passionate polemicist, a stubborn and admirable defender of a decentralized republic who fights for the principles of 1776 all the way to the last ditch and last drop. In remembering this forgotten founder, we remember also the principles that once animated many of the earliest—and many later—American patriots.

Available in PDF, EPUB and Kindle. Book excerpt: On the steps of the Lincoln Memorial in 1963, Martin Luther King outlined a dream of an America where people would not be judged by the color of their skin. That dream has yet to be realized, but some three centuries ago it was a reality. Back then, neither social practice nor law recognized any special privileges in connection with being white. But by the early decades of the eighteenth century, that had all changed. Racial oppression became the norm in the plantation colonies, and African Americans suffered under its yoke for more than two hundred years. In Volume II of The Invention of the White Race, Theodore Allen explores the transformation that turned African bond-laborers into slaves and segregated them from their fellow proletarians of European origin. In response to labor unrest, where solidarities were not determined by skin color, the plantation bourgeoisie sought to construct a buffer of poor whites, whose new racial identity would protect them from the enslavement visited upon African Americans. This was the invention of the white race, an act of cruel ingenuity that haunts America to this day. Allen's acclaimed study has become indispensable in debates on the origins of racial oppression in America. In this updated edition, scholar Jeffrey B. Perry provides a new introduction, a select bibliography and a study guide.

Here, for some time, he remained wandering up and down the' shaded alleys, or reclining on one of the seats, until a sudden longing for an ice took possession of him, and he summoned sufficient energy to return to his hotel for the purpose of getting one. Available in PDF, EPUB and Kindle. Book excerpt: The King's Felons examines the subtle but intentional development of criminal confinement as an alternative to capital punishment in early Tudor England. As the judicial establishment looked for ways to enhance law and order without provoking political opposition, they increasingly turned to two traditional mitigations of criminal punishment: benefit of clergy and sanctuary. Often reviled as corrupt clerical rights which served to undermine secular authority and the rule of law, benefit of clergy and sanctuary in fact provided the justices with room to manoeuvre, allowing them to punish a larger number of felons less harshly while avoiding political scrutiny. The King's Felons explores the evolution of this approach over a period of sixty years, allowing us to see not only the internal development of both law and process, but the ways in which the judicialsystem responded to external pressures. The dissolution of the monasteries between 1536 and 1540, together with the steady erosion of the wealth and power of the bishops, meant that the institutional and financial foundations on which the justices built this system began to crumble as it was reaching fruition. Over the next two decades they scrambled, with limited success, to secure some small vestiges of the system they had built. The epilogue connects the state of the system in the aftermath of this collapse to our existingunderstanding of the system in the later part of the century.Providing the first detailed study of criminal justice in the early Tudor period, The King's Felons highlights the role of the Church in the administration of criminal justice and reframes our understanding of many significant acts of the Reformation parliament. This book is a must-read for students and scholars of Tudor history, legal historians and those interested in the role of the church with regard to politics, law, and crime.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a successor to the commentaries by Nisbet and Hubbard on Odes I and II, but it takes critical note of the abundant recent writing on Horace. It starts from the precise interpretation of the Latin; attention is paid to the nuances implied by the word-order; parallel passages are quoted, not to depreciate the poet's originality but to elucidate his meaning and to show how he adapted his predecessors; sometimes major English poets are cited to exemplify his influence on the tradition. In expounding the so-called Roman Odes the editors reject not only uncritical acceptance of Augustan ideology but also more recent attempts to find subversion in a court-poet. They show how Greek moralizing, particularly by the Epicureans, is applied to contemporary social situations. Poems on country festivals are treated sympathetically in the belief that the tolerant and inclusive religion of the Romans can easily be misunderstood. The poet's wit is emphasized in his addresses both to eminent Romans and to women with Greek names; the latter poems are taken as reflecting his general experience rather than particular occasions. Though Horace's ironic self-presentation must not be understood too literally, the editors reject the modern tendency to treat the author as unknowable. Although the text of the Odes is not printed separately, the headings to the notes provide a continuous text. The editors put forward a number of conjectures, most of them necessarily tentative, and in the few cases where they disagree, both opinions are summarized.
