Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Marriage Process in the United States The subject of these pages - the marriage process - is comparatively new in this country. Down to the year 1884, marriage disputes, even those involving the validity of marriages already contracted, were, as a rule, decided, with us, by the bishop, or also by rectors of parishes, and sometimes even by assistant priests, without any judicial formalities whatever. This mode of procedure was naturally open to serious inconveniences, and was calculated to imperil, in many cases, the stability and indissolubility of marriages. To obviate these disadvantages, the S. C. de Prop. Fide, in 1884, issued the Instruction Causae Matrimoniales for this country. This Instruction or law substantially lays down and makes obligatory here, in matrimonial contentions involving the validity of a marriage contracted, the manner of proceeding which is prescribed by the general law of the Church and obtains throughout the entire Church. This mode of deciding marriage disputes is judicial, and is to be conducted by the bishop's court for marriage causes. In some respects the judicial formalities of the marriage process are the same as those of other ecclesiastical trials. But in no small number of points there are wide divergencies between the two. From the very nature of the subject-matter in dispute, the marriage trial has many peculiarities, and is frequently more intricate and complex than other ecclesiastical trials. Book excerpt: Excerpt from Common Law Marriage, and Its Development, in the United States Again, the strictly legal aspects of marriage cover a wide area in the field of jurisprudence. Our present con cern, however, is only with the legal effect of informal or irregular marriages by the common law of England and the development of that law in the United States. Common law marriage may be defined as a marriage which does not depend for its validity upon any religious or civil ceremony but is created by the consent of the parties as any other contract. The term common law marriage, however, is not strictly an accurate one. Some writers on the subject prefer not to call it by that name, and some of those that do, make apologies for it. Book excerpt: Excerpt from American Marriage Laws: In Their Social Aspects; A Digest Someone has remarked that the whole of social reform is implied in social case work - if it be thorough enough. This is an overstatement; social reform has many approaches, and we could ill afford to dispense with a single one of them. It does happen, however, that the plan of study to which the present Digest is merely preliminary grew out of social case work in one of the large family agencies of New York, and that this brief study illustrates, in a fashion, the relation between the social worker's attempt to find a way out for a few people in grievous trouble and human issues of wider significance. I have served for several years on the committee of a society for family social work to which have been referred its especially puzzling problems of individual welfare. In about three-fifths of all the cases so referred, the committee found that the core of the difficulty centered around marital maladjustments. (Their proportion in the whole work of the society, it should be added, would not be nearly so large.) These troubles of the Smiths, the Browns, and the Robinsons brought more forcibly to our attention than ever before certain ancient evils and certain proposed remedies. As a part of the general public, we had already noted the alarming increase in the number of divorces, but we had never fully realized before the close relation between divorce and our ill-devised, variously-administered marriage laws. We began to wonder why so much attention had been given to the defects of our divorce laws and so little to those regulating marriage. Of course, law is only a small part of the problem as compared with public education and early training, yet it shapes our social ideals, in part at least, besides having much to do with the practical adjustments of daily living. To those who champion one wholesale remedy for marital unhappiness, the plans growing out of this committee work - plans for a series of brief studies to be made by the Russell Sage Foundation - will seem futile. The views of these extremists are supplemented by writers like Mr. Richard, who seeks in this age, near the dawn of the twentieth century, to bolster up the curse of polygamy, by arguments to prove that it is the form of marriage not only authorized but distinctly sanctioned by the Almighty and the Marquis of Queensberry, who seriously objects to monogamy as a grievous error, and altogether a barbarous institution born of hypocrisy and bigotry. Book excerpt: Excerpt from When You Marry The authors of this book, who had already served as two of the memo bers of the committee that prepared the outline of the course, were asked to prepare a workbook to be used in conjunction with a textbook as the basis of a prospective course in the United States Armed Forces Institute. Although a course in Marriage and the Family has not yet been included in the program of the Institute, the authors were encour aged, by indications of widespread interest in a course with the same objectives for all young people preparing for marriage, to write the pres ent volume. The authors of When You Marry are unusually well qualified by their training and experience to prepare a volume meeting the present pressing needs and concerns of young people. Evelyn Millis Duvall has a thorough background in biology, and has completed her residence requirements for the doctor's degree in the field of human development, which is an integrated program of study including pertinent courses in anthropology, biology, economics, nutrition, psychiatry, psychology, and sociology. As director for eight years of the Association for Family Living she gained an understanding of the problems of young people of all social classes, and of ways of working with them in the discussion of their questions. Dr. Reuben Hill had his graduate training in so ciology. Organizer and director for four years of the interdepartmental courses in marriage at the University of Wisconsin, with further experi ence in the University of South Dakota, Iowa State College, and nu merous informal collegiate situations, he has intimate knowledge of the problems of college youth and experience and skill in methods of teach ing adapted to their interests. Book excerpt: Excerpt from Getting Married N.B. - There is a point of some technical interest to be noted in this play. The customary division into acts and scenes has been disused, and a return made to unity of time and place, as observed in the ancient Greek drama. In the foregoing tragedy, The Doctor's Dilemma, there are five acts; the place is altered five times; and the time is spread over an undetermined period of more than a year. No doubt the strain on the attention of the audience and on the ingenuity of the playwright is much less; but I find in practice that the Greek form is inevitable when drama reaches a certain point in poetic and intellectual evolution. Its adoption was not, on my part, a deliberate display of virtuosity in form, but simply the spontaneous falling of a play of ideas into the form most suitable to it, which turned out to be the classical form. Getting Married, in several acts and scenes, with the time spread over a long period, would be impossible.
