Koh, Star2 This is a much-welcome new edition of the seminal introduction to Malaysia's constitution by the leading expert in the field. Retaining its comprehensive approach, it examines constitutional governance in light of authoritarianism and continuing inter-communal strife, as well as examining the impact of colonisation on Malaysia's legal public law structure. Updated throughout to include all statutory and case law developments, it also retains its socio-political perspective. A must read for all students and scholars of Malaysian law.

Available in PDF, EPUB and Kindle. Book excerpt: In this book, HP Lee explores how the separation of powers doctrine in Malaysia has been adversely affected by a number of major constitutional conflicts among the various important organs of government. The author first analyses the struggle by parliament for supremacy over the Malay Rulers or Sultans by expunging the need for the royal assent to the enactment of legislation and removing royal immunities. Lee then turns to the contemporary role of the Malay Rulers and the reasons for the perceived rejuvenation of these Malay Rulers. The book goes on to examine the series of controversies and scandals which have plagued the judiciary since the tumultuous judiciary crisis of 1988, and the efficacy of the reforms which have been introduced to restore public confidence in the judiciary. These conflicts and a number of statutory enactments are analysed to determine their impact on the state of constitutionalism in Malaysia. The book concludes with the author's thoughts on the trajectory of constitutional development in Malaysia.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a systematic and interdisciplinary examination of law and legal institutions in Malaysia. It examines legal issues from historical, social, and political perspectives, and discusses the role of law in relation to Malaysian multiculturalism, religion, politics, and society. It shows how the Malaysian legal system is at the heart of debates about how to deal with the country's problems, which include ethnic and religious divisions, uneven and unsustainable development, and political authoritarianism; and it argues that the Malaysian legal system has much to teach other plural polities, nations within the common law tradition, and federal states.

Book excerpt: This book examines how the Crown has performed as Head of State across the UK and post war Commonwealth during times of political crisis. It explores the little-known relationships, powers and imperial legacies regarding modern heads of state in parliamentary regimes where so many decisions occur without parliamentary or public scrutiny. This original study highlights how the Queen’s position has been replicated across continents with surprising results. It also shows the topicality and contemporary relevance of this historical research to interpret and understand crises of governance and the enduring legacy of monarchy and colonialism to modern politics. This collection uniquely brings together a diverse set of states including specific chapters on England, Scotland, Northern Ireland, Sri Lanka, Malaysia, Brunei, Ghana, Nigeria, Zimbabwe/Rhodesia, Australia, Tuvalu, and the Commonwealth Caribbean. Viceregalism is written and conceptualised to remind that the Crown is not just a ceremonial part of the constitution, but a crucial political and international actor of real importance.

Available in PDF, EPUB and Kindle. Book excerpt: Does the industrial development of a country entail the democratization of its political system? Malaysia in the World Economy examines this theme with regards to Malaysia in the period between 1824 and 2011. Capitalism was first introduced into Malaysia through colonialism specifically to supply Britain with much-needed raw materials for its industrial development. Aside from economic exploitation, colonial rule had also produced a highly unequal and socially distant multicultural society, whose multifaceted divisions kept the colonial rulers in supreme authority. After independence, Britain ensured that Malaysia became a staunch western ally by structuring in a capitalist system specifically helmed by western-educated elites through what appeared to be "formal" democratic institutions. In such a system, the Malaysian ruling elites have been able to "manage" the country's democratic processes to its advantage as well as preempt or suppress serious internal challenges to its power, often in the name of national stability. As a result, an increasingly unpopular National Front political coalition has remained in power in the country since 1957. Meanwhile, Malaysia's marginal position in the world economy, which has maintained its economic subordination to the developed countries of the west and Japan, has reproduced the internal social inequities inherited from colonial rule and channeled the largest returns of economic growths into the hands of the country's foreign investors as well as local elites associated with the ruling machinery. Over the years however, the state has lost some of its political legitimacy in the face of widening social disparities, increased ethnic polarization, and prevalent corruption. This has been made possible by extensive exposures of these issues via new social media and communications technology. Hence, informational globalization may have begun to empower Malaysians in a new struggle for political reform, thereby reconfiguring the balance of power between the state and civil society. Unlike other past research, Malaysia in the World Economy combines both macro- and micro-theoretical approaches in critically analyzing the relationship between capitalist development and democratization in Malaysia within a comparative-historical and world-systemic context.

From mundane topics like “Tips for Interviewees” to such contentious and sensitive issues as ethnic relations, Islam and the Constitution, and electoral democracy, the book gives us a simple, warm and sympathetic commentary on some of the burning issues of our times. There are simple but searching essays on good governance, local government, law reform, universities and the law, and legal education. The reflections of the East and the perceptions of the West on human rights are discussed eloquently. The international law on war and peace is viewed in the context of our troubled world. Difficult issues are made simple and simple issues are made rich. All essays are guided by reason and driven by passion. The work is animated by a spirit of moderation, compassion and erudition.

Available in PDF, EPUB and Kindle. Book excerpt: Summary: "Malaysia's former Prime Minister Mahathir Mohamad is often seen as the sole author of the country's foreign policy. Malaysian Foreign Policy in the Mahathir Era shows that while Mahathir's personality, leadership style, political ideology and brand of nationalism unquestionably had a deep impact, so too did domestic issues and external forces associated with globalization. The book examines seven major foreign policy initiatives of the Mahathir period: Buy British Last, Anti-Commonwealth, Look East, Third World Spokesmanship, Regional Engagement, Islamic Posturing and Commercial and Developmental Diplomacy. In discussing these topics, the author explains the significance for foreign policy of communal concerns, the regime's need to maintain its own authority in the face of political and social initiatives (some rooted in Islam), and its desire to achieve national development. He also discusses external pressures, including Japan's regional designs, Singapore's defense posture and the growing importance of China for the region. The approach breaks away from the elitist decision making styles and single factor models usually employed to explain the foreign policy of developing nations, and establishes a direct link between domestic politics and foreign policy during the period studied, suggesting that the latter was truly an extension of the former."--Publisher description.
