At the same time aviation is one of the contributors to the global greenhouse gas (GHG) emission.Given the trans-boundary nature of climate change, a global solution would be the most efficient and effective option for addressing the related GHG-emission. However, global negotiations so far have not been successful. Against this background, the EU has decided to include aviation in its Emission Trading System (ETS) from 2012. with this background, this book brings into focus the legality of EU aviation directive 2008/101 under GATT rules and the doctrine of sovereignty. Through analysis, the book addresses questions on whether EU aviation directive violates the doctrine of sovereignty reflected under Chicago Convention on International Civil Aviation Organization and the UN Charter, whether the unilateral and extraterritorial measure of EU can be justified under GATT rules and whether the GATT exceptions will be applicable to EU ETS scheme.

Most of the research laid its focus on specific industry levels such as the individual airline, the aviation industry in general or macroeconomic aspects. In this context, these studies tried to anticipate market reactions triggered by the EU-ETS by analyzing specific issues such as the financial impact on airlines, changes in competitive behavior or implications for the overall industry development. As a consequence, the existing studies took only a limited market view and made assumptions about expected developments in specific fields of the aviation industry. However, at the time of writing this thesis, conclusions about the scope of impact could hardly be drawn from existing impact assessments because of the wide range of issues that exceeded the scope of most impact studies. Hence, a broader research approach is needed which takes different analytical perspectives to describe the scope of impact of the EU-ETS and depict potential effects for the aviation industry.

Book excerpt: The aviation industry will be included in the EU's emissions trading system (ETS) from 1 January 2012. Airlines will have to acquire and 'surrender' allowances for the carbon emissions produced by their flights. The scheme is comprehensive: it applies to EU and non-EU airlines (subject to a potential exemption), to passenger and cargo flights, and to flights between EU airports and between EU and non-EU airports. An airline that fails to surrender allowances is fined €100 per allowance and must make up the shortfall the following year. The EU's scheme has already given rise to legal action in connection with the EU's international civil aviation obligations. But, due to its impacts on trade in goods and services, the scheme also has implications for the EU's obligations under the WTO law: specifically, under the General Agreement on Tariffs and Trade (GATT) and the General Agreement on Trade in Services (GATS). In particular, this raises the question of the scope of application of the GATS Annex on Air Transport Services. As this article shows, it is challenging to design a carbon scheme that is both administratively feasible and justifiable under WTO law.

European-based airlines in turn fear a disadvantage against their non-european competitors, as the need for emission certificates will burden their already high cost structures even further. The paper should first explain the concept of emission trading schemes as well as the current plan of introducing emission trading in the European Union. The second part will then elaborate on the airline’s perspective on emission trading and the included risks/ disadvantages originating from an introduction of such a system. A third part will then analyze the correlation between announcements concerning the emission trading system and the performance of airline stock prices. The analysis shall be based on the stock performance of major European airlines, as they will be the ones facing major discrimination if the system gets introduced. Finally, the usefulness of an emission trading system is going to be discussed and alternatives to solve the climate change issue will be presented.

Book excerpt: To realize international emission reduction targets, the European Union introduced a scheme for emission allowance trading. Despite large resistance from countries and companies, aviation activities were included in the scope of the trading scheme. In Air Transport Ass'n of America v. Secretary of State for Energy & Climate Change, the Court of Justice of the European Union had to decide whether the scheme was contrary to international law. After long disagreement at an international level, the International Civil Aviation Organization decided to look into market-based models for international aviation. Therefore, the European Union decided to temporarily derogate from the enforcement of its scheme. Whether this will give rise to a global scheme by 2020 is yet to be revealed.This article shows what led the European Union to introduce its scheme for emission allowance trading in the field of aviation. Nevertheless, the main question is why the European Union decided to “stop the clock” on the application of aviation activities. Perhaps it could be as a result of large international concerns or a desire to create an international market-based model. The question remains whether the application of the emission allowance trading in the field of aviation is contrary to international agreements and customary international law, or whether the European Union wanted to take a leading role with its emission allowance trading scheme. The final question is if there is a future for the European Union emission trading scheme for aviation activities or whether the scheme will be substituted for a worldwide market-based measure.

Book excerpt: The European Trading System (EU ETS) for carbon emissions has been extended to apply to aviation as well, including planes of foreign companies flying between, into and out of European Union (EU) airports: this extension has entailed extensive discussions, especially (but not only) across the legal community. Recently, the EU decided to postpone the application of the EU ETS for flights to and from Europe, but not within, for one year in order to facilitate attempts to look for a global solution under the aegis of the International Civil Aviation Organization (ICAO). In this paper, we discuss the consistency of the regime with the multilateral trading rules. In our view, there are good arguments to support the thesis that the regime adopted by the EU does not run afoul of the relevant rules established by the World Trade Organization (WTO). We stop short of assessing the EU's policy-decision to postpone the ETS application, and the ensuing question of whether a global solution is feasible, since this paper is confined to a pure legal evaluation of the EU ETS using WTO law as a benchmark.
