Available in PDF, EPUB and Kindle. Book excerpt: The effectiveness of property rights - and the rule of law more broadly - is often depicted as depending primarily on rulers' 'supply' of legal institutions. Yet the crucial importance of private sector 'demand' for law is frequently overlooked. This book develops a novel framework that unpacks the demand for law in Russia, building on an original enterprise survey as well as extensive interviews with lawyers, firms, and private security agencies. By tracing the evolution of firms' reliance on violence, corruption, and law over the two decades following the Soviet Union's collapse, the book clarifies why firms in various contexts may turn to law for property rights protection, even if legal institutions remain ineffective or corrupt. The author's detailed demand-side analysis of property rights draws attention to the extensive role that law plays in the Russian business world, contrary to frequent depictions of Russia as lawless.

Available in PDF, EPUB and Kindle. Book excerpt: This study is based on original Russian sources, due atten tion being paid to some authoritative views advanced by foreign lawyers. Leaving aside the essentials of the work in the hope that they will speak for themselves; I should like to make some prelim inary remarks regarding the linguistic and other formal aspects. First of all it should be noted that many of the Soviet laws have already been translated into English either in the USSR itself or in Western countries. This fact is fully reflected in the bibliographical survey at the end of this study. Some laws have been translated both in the Soviet Union and abroad, as for instance the Fundamentals of Soviet Civil Legislation. In such a case I have used the translation made in the USSR even though linguistically it may be inferior to the translation made in the West. The author has translated only those legal provi sions of which no English translation was available. For transliteration, I have used the system of the Library of Congress of the USA without its diacritical marks. Further, a word should be said about the references in the notes. They are very brief and consist of the surnames of the authors concerned and if necessary an additional element, e. g.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first treatise on Russia's new legal system, as it emerged from the dissolution of the Soviet Union. The first part of the book analyses in detail the political and economic origins of "perestroika," indispensable for understanding the basic parameters of the evolution of Russian law. In the following chapters all major legal subjects are discussed against the background of their Soviet past and as the result of the radical changes in the political, social and economic make-up of the country. The appendices include the texts of the U.S.S.R. and Russian Constitutions, the Agreement of Minsk, The Russian Federation Treaty, bibliographical sources, and extensive indices of Soviet and Russian legislation. The book has been written for legal practitioners, comparative lawyers, and students of Russian law, but will also be of interest to a wider audience of political scientists, journalists, etc.

Available in PDF, EPUB and Kindle. Book excerpt: The Soviet legal system is constantly changing. The authors examined the reasons for this change, and the extent that further change may be expected. The main objective of the system of legal regulation of the Soviet economy is political rather than economic efficiency, political efficiency in the sense of preventing the appearance of any independent centers of power that might challenge the political authority of the top level of the Party . A second conclusion is that economic efficiency is sought by continual legal reforms, whose effectiveness is limited however by the fact that they are stopped or reversed as soon as they reach the point of threatening political goals .
