Book excerpt: Excerpt from The Institutes of Justinian: Illustrated by English Law My reason for attempting a work like the present is the remembrance of the difficulty which I found as a student in comparing Roman law as I read it with our own system. Legal writers treat the subject either very shortly, or else only incidentally, as far as it is applicable to a particular branch of law. Lord Mackenzie, Sir P. Colquhoun, and Mr. Poste are examples of the first kind; Mr. Benjamin and Mr. Pollock of the second. Some of the comparisons in the succeeding pages may not meet with universal acceptance. I have tried, as far as possible, to avoid far-fetched analogies, but in occupying a ground hitherto almost untouched, I cannot hope to have avoided some errors. I have dealt with antiquarian matters less than I should like to have done, but it was necessary to confine the work within moderate bounds. Written by the Byzantine emperor Justinian in the 6th century, this seminal legal text was the basis for the development of civil law in Europe and beyond. This edition, with an English introduction, translation, and notes, provides a clear and accessible window into the world of ancient Roman law, its principles and practices, and its enduring legacy. This work has been selected by scholars as being culturally important, and is part of the knowledge base of civilization as we know it. Book excerpt: Excerpt from The Institutes of Justinian: With English Introduction, Translation, and Notes The original edition was in the main founded on the works of Ortolan, Ducaurroy, and Puchta. In subsequent editions I was greatly aided by the elaborate commentaries of Demangeat, to which those who wish to find in the 'Institutes' something more than an elementary work may be confidently referred. Lastly, I have derived assistance, which it is impossible to acknowledge too freely, from Mr. Poste's learned edition of 'Gaius, ' and from Mr. Hunter's admirable and exhaustive work on 'Roman Law;' while in revising the translation, I have had the great advantage of consulting the careful and accurate translation of Messrs. Abdy and Walker. The text adopted is, with few variations, that of Huschke (Leipzig, 1868). About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: The Institutes are a complete exposition of the elements of Roman law and are divided into four books—the first treating of persons and the differences of the status they may occupy in the eye of the law; the second-of things, and the modes in which rights over them may be acquired, including the law relating to wills; the third of intestate succession and of obligations; the fourth of actions and their forms. For many centuries they had been the familiar textbook of all students of Roman law.
