Book excerpt: The EU Services Directive is one of the cornerstones for the realization of the EU internal market and is fundamental to economic and legal experts in governments, trade and industry, as well as to the general public. This book analyses in detail the different steps taken by each of 26 EU Member States (all but Greece) in the implementation process of the Services Directive. It provides not only detailed information about the changes in national law adopted by the Member States, but also facilitates a comparison of the different implementation strategies. It gives an insight in the heterogeneity or homogeneity of implementation concepts and shows how European legislation affects legislation that was originally nationally dominated, such as the law of national administration. This book is valuable reading for academics interested in European and administrative law and the transposition of European directives into domestic law, as well as for practitioners and civil servants in ministries, chambers of commerce, local governments and other comparable institutions having to implement the Directive. Ulrich Stelkens and Wolfgang Weiß are both University Professors of Law at the German University of Administrative Sciences Speyer and Ordinary Members of the German Research Institute for Public Administration Speyer, Michael Mirschberger (Ass. Jur.) is research assistant at both institutions.

Available in PDF, EPUB and Kindle. Book excerpt: The EU Services Directive is difficult to achieve without also affecting issues of national social policy, closely related to the welfare state. The EU Services Directive’s characteristics have raised numerous legal questions essential for its full understanding and implementation. It has become a “moving target” for the national administrations. In this book important issues are covered: is the EU Services Directive to be interpreted as law or simply policy and what are its actual effects on the regulatory autonomy of the Member States? Does it represent a new and innovative instrument which facilitates prosperous integration within the EU or, has the EU legislator gone beyond its regulatory competence? This book helps to understand the EU Services Directive and its effects on the regulatory autonomy of the Member States of the European Union in a broader perspective. It is valuable for academics, practitioners and officials both nationally as well within the EU institutions.

Available in PDF, EPUB and Kindle. Book excerpt: The EU Services Directive was adopted in 2006 to foster competition in services across Europe. However, progress in liberalizing services has fallen short of expectations due to the article 15 of the Directive, which allows countries to maintain pre-existing restrictions if judged necessary to protect the public interest. Through input output analysis, this paper finds important multiplier effects of greater efficiency services to the rest of the economy. A renewed impulse to the liberalization process could be given by enhancing the advocacy role of national competition authorities in interpreting the notion of public interest underpinning existing regulations.

This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work deals with the legal problems and expectations of the transposition of the Directive 2006/123/EC (Services Directive) in Spain. This contribution reviews the national debates on the implementing rules, the constitutional repercussions arising from its transposition, and the scope and effects of the Services Directive in Spanish law, taking into account both its substantive and procedural provisions. The major legal consequence of the implementation of the Services Directive in Spain will be administrative simplification. The Spanish services market suffers from legal opacity and complexity due to the mixture of regulating competencies of different Administrations. From a general point of view, this is the most important entry barrier for foreign providers of services. The establishment of points of single contact, accessible by electronic means, if successfully achieved, will represent a revolutionary progress in a traditionally burdensome and bureaucratic set of Administrations. It will also reduce the economic inefficiencies derived from political decentralisation. From a material point of view, the evaluation process may help to detect regional and local norms which have to be reconciled with Community law, and that have passed unnoticed in the past, because of their limited territorial scope of application.

Book excerpt: The implementation of the EU Services Directive (2006/123/CE) should entail a boost of freedom of enterprise and free competition in the services sector in Spain. Although a proper interpretation of both these constitutional principles should have already led to the elimination of many barriers and administrative obstacles to the exercise of business activities in Spain, the need to implement the EU Services Directive into Spanish Law will produce that result directly and immediately. However, repealing or amending regional and local regulations that contravene the requirements of the Directive is one of the most problematic issues posed by the transposition. So far, despite the coordination efforts, the EU Services Directive introduces a new concept of public involvement in service activities of great practical significance and the implementation process to date provides a glimpse into some obstacles and difficulties in fulfilling the mandates of the Services Directive Directive at regional and local level.

Book excerpt: The biggest reform step to date in the liberalisation and deepening of the EU internal market for services was taken with the EU Services Directive. Its implementation intended to provide a clear impetus for the removal of existing obstacles to the free movement of services, the freedom of establishment of services providers and for administrative simplification. The project quantifies the Directive's effects on Austrian and EU services trade and welfare but also highlights untapped potentials due to remaining administrative barriers and existing weaknesses in the implementation and enforcement of the Single Market rules. The estimation relies on a structural gravity model estimated on a disaggregated industry level.

Book excerpt: The objective of this book is to examine how the legal order of Malta, the EU's smallest Member State, manages to cope with the obligations of the EU's acquis communautaire. As far as the legal obligations are concerned, size does not matter. Smaller Member States have the same obligations as the largest, yet they have to meet these same obligations with very fewer resources. This book examines how the Maltese legal system manages to fulfil its obligations both in terms of the supremacy of EU law, as well as how the substantive EU law is transposed and implemented. It also explores how Maltese courts look at EU law and how they manage, or not manage, to enforce it within the context of national law. It can serve as a model to demonstrate how EU law is being implemented in the smallest Member State and can serve as a basis to study the effectiveness of EU law into the domestic law of its Member States in general.

Available in PDF, EPUB and Kindle. Book excerpt: The European audiovisual industry is one of the most dynamic markets in the European Union. The Audiovisual Media Services Directive is the bedrock of the EU's audiovisual and media policies. It regulates diverse aspects for providers of television broadcasting and on-demand services and entered into force in December 2007. Due to the volatility of a market facing convergence of media and important policy choices, for instance whether to allow product placement, Member States have struggled with the transposition of this Directive. This completely new commentary employs an innovative approach: Based on English translations, the study systematically examines the national implementing measures of the future 28 Member States (including Croatia). It sets out, article-by-article, the original provisions contained in the Directive before analysing domestic transpositions. National measures are grouped in order to reveal similarities and differences and examined for compliance with the Directive. This comparative perspective contributes to the discussions on reforms of the Directive or the EU's approach to new media services.
