Book Synopsis Yearbook Maritime Law by : Ignacio Arroyo
Download or read book Yearbook Maritime Law written by Ignacio Arroyo and published by Springer Science & Business Media. This book was released on 2013-04-18 with total page 487 pages. Available in PDF, EPUB and Kindle. Book excerpt: I. The importance of legal questions related to the sea is obvious to everyone. It is hardly surprising that the subjects that make up international current events illustrate the leading role played by maritime affairs. Indeed, it is no coincidence that three quarters of the earth's surface is covered by oceans. Territorial seas, exclusive economic zones, exploitation of the seabed, fishing, transport, insurance, collision, and pollution raise many unresolved questions. On the other hand, the contrast of this importance with the modest attention that existing periodical publications merit must be underscored. Without undervaluing these publications, there has been a need for some time to create a vehicle of common expression, based on three central tenets: interdisciplinary framework, tendency towards uniform law, and both a theoretical and practical approach. a. A framework of interdisciplinary nature seems to be relevant as it is desirable to overcome the artificial separation between public and private law.

Download or read book Transport Law in Greece written by Kyriaki Noussia and published by Kluwer Law International B.V.. This book was released on 2023-05-20 with total page 114 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides a systematic approach to transport law as applied in Greece. The book describes the main sources of transport law, jurisdiction and courts, state immunity, and the legal role of transport intermediaries, with detailed reference to maritime law, transport by road, transport by air, transport by rail, and inland navigation. A special chapter is devoted to multimodal transport. Among the elements of transport law considered are the legal status of the vessel; its acquisition, ownership, and registration; vessel liens and mortgages; the position of master and crew; maritime salvage and assistance; marine pollution; collision; and carriage of passengers. Other topics discussed include liability and limitation of liability, charter parties, and transport under bill of lading. Case law, intergovernmental cooperation agreements, and interactions with environmental, tax, and competition law are also covered. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling transport contracts or cases affecting Greece. It will also be welcomed by researchers and academics for its contribution to a field that continues to gain significance in the study of comparative law.

Book Synopsis Maritime Cabotage Law by : Aniekan Akpan
Download or read book Maritime Cabotage Law written by Aniekan Akpan and published by Routledge. This book was released on 2018-12-17 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the most comprehensive review of maritime cabotage law. It introduces the new theory of Developmental Sovereignty to jurisprudence. The maritime cabotage law provisions and approaches as adopted in many states and jurisdictions has been extensively scrutinised. This book challenges the established and accepted wisdom surrounding maritime cabotage by presenting new reasoning on the underpinning principles of the concept of maritime cabotage law. The book offers a vibrant discussion on the adjustment in the regulatory approaches of maritime cabotage, from one that was intrinsically premised on the idea of national sovereignty, to one that now embraces the broader ideology of development. It investigates what the common understanding of the law of maritime cabotage should be and on what intellectual basis it can be justified. It reduces the inconsistencies and confusion that surround the concept and application of maritime cabotage law, to provide a more certain and more robust concept of maritime cabotage.
Book Synopsis The Law of the Sea by : Laura Pineschi
Download or read book The Law of the Sea written by Laura Pineschi and published by BRILL. This book was released on 2021-09-27 with total page 616 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.
Book Synopsis Maritime Law Volume II Enforced Sales of Vessels by : Lennart Hagberg
Download or read book Maritime Law Volume II Enforced Sales of Vessels written by Lennart Hagberg and published by Springer. This book was released on 2013-12-11 with total page 132 pages. Available in PDF, EPUB and Kindle. Book excerpt: 1t gives me great pleasure as Chairman of the Section on Business Law to write a foreword to this, the second volume in a series of books on Maritime Law. Volume I dealt with 'Arrest of Vessels' and the remain ing subjects tobe covered are 'Mortgages of Vessels' and 'Registration of Vessels'. The first volume has proved most successful and many lawyers have testified to its practical value. I am certain that this second volume will have an equally warm welcome. The series is the inspiration of Lennart Hagberg, the Chairman of the Section on Business Law's Committee on Maritime and Transport Law. Both he, and the contributors to the series who are all members of that Committee, are busy practising lawyers, and it is only by making sacrifices that they have been able to add this additional task to their already heavy commitments. In particular, Lennart Hagberg's task as editor has involved an enormous amount of work and I am most grateful to him and bis fellow-contributors for all that they have done. May I wish this Book and those following it every success.

Book Synopsis An Introduction to Transnational Criminal Law by : Neil Boister
Download or read book An Introduction to Transnational Criminal Law written by Neil Boister and published by Oxford University Press. This book was released on 2018-04-13 with total page 513 pages. Available in PDF, EPUB and Kindle. Book excerpt: National borders are permeable to all types of illicit action and contraband goods, whether it is trafficking humans, body parts, digital information, drugs, weapons, or money. Whilst criminals exist in a borderless world where territorial boundaries allow them to manipulate different markets in illicit goods, the authorities who pursue them can remain constrained inside their own jurisdictions. In a new edition of his ground-breaking work, Boister examines how states must cooperate to tackle some of the greatest security threats in this century so far, analyses to what extent vested interests have determined the course of global policy and law enforcement, and illustrates how responding to transnational crime itself becomes a form of international relations which reorders global political power and becomes, at least in part, an end in itself. Arguing that transnational criminal law is currently geared towards suppressing criminal activity, but is not as committed to ensuring justice, Boister suggests that it might be more strongly influenced by individual moral panics and a desire for criminal retribution than an interest in ensuring a proportional response to offences, protection of human rights, and the preservation of the rule of law.
