The King of Prussia is ipso facto German Emperor. The legislative power rests with two bodies, the Bundesrat, or Federal Council, and the Reichstag. The Emperor declares war with the consent of the Bundesrat, the assent of the Reichstag not being required. Not even the Bundesrat need be consulted if the war is defensive, and as the Hohen zollerns have always claimed to make defensive warfare it is not surprising that even the unrepresentative Bundesrat was officially informed about the present war three days after the Emperor declared it. He is commander in chief of the army and navy, he has charge of foreign affairs, and makes treaties, subject to the limitation that certain kinds of treaties must be ratified by Parliament. He is assisted by a chancellor, whom he appoints and whom he removes, and who is responsible to him and to him alone. Under the chancellor are various secretaries of state, who simply ad minister departments, but who do not form a cabinet, either in the English or French or American sense. When President Wilson went to New York, to Rome, Georgia, to Philadephia and other cities after the outbreak of the war, I accompanied him as one of the Washington correspondents. Nor IS this unnatural for human nature bears adversity better than prosperity, and endurance is distinctively a virtue of the German. The Germans distinguish between the territorial victory which the French have won over them, and our victory, which, for want of a better word, I shallcall moral. With the French, their age-old enemies of alien race and qualities, the Germans have often quarrelled about the buffer-lands between the two countries. With ourselves, whom they thought nearer them in nature, they fought fora mastery which, again, I shall call moral. They seem to me to realise their failure and the collapse of their gigantic effort to win world leadership, which has brought them loss and suffering and despair, has opened their eyes to many things. They realise, as never before, the elements of superiority in British life and character. It is not unfair to say that in the Great War our own Overseas Dominions and the United States rediscovered Britain for themselves. So have the Germans done. I found many Germans ready to admit that German nerves are inferior to British, and that life in this country distils somehow a something which makes for victory in the supreme encounters. On the political side they see how' much wiser was Bismarck's policy of maintaining good relations with Britain and Russia than the Haunting provocations of William II. Their experiments in free constitutional government have the hearty backing of most of the nation it is only a minority, of uncertain size, that wishes to go back to the old regime under which the Kaiser, the General Staff of the Army, and the bureaucracy ruled, while the Reichstag provided the decorative exterior of Government. The new experiment is conducted under difficulties. One of these difficulties is that Britain, the home of the Parliamentary principle, views the experiment somewhat sceptically, whereas the Germans, very earnest in the matter, and, perhaps, a little na'r've, had hoped for her benevolence and encouragement. Book excerpt: Excerpt from The New German Constitution The rhythm of human affairs is such that we may reason ably expect a return to the constitutional searchings of 1912 on a higher and different plane. Those who fix their eyes not upon the written letter of our Constitution, but upon judi cial decisions, political practice, and congressional procedure are never under the delusion that our constitutional system does not change. If, as Professor Seligman long ago pointed out, economic conditions are rapidly becoming the same all over the world with similar legal results, then we may, with proper warrant, expect very soon a new and lively examina tion of constitutional principles to break in upon us. M. Brunet's book fits in with the signs of the times. No person who pretends to be intelligent about constitutional matters can neglect it. It would be difficult to imagine anything more illuminating than a comparison of the Constitution of the United States drawn up in 1787, the fundamental law of the Australian Commonwealth adopted in 1900, and the new German Reichsverfassung of 1919, which vibrates with the tramp of the proletariat. In the attempt of the Germans to combine the strength of Hamilton's government with the democratic control so vaunted by Jefferson we have an experiment that ought to stir our deepest interest. In the provisions for social, not to say socialistic, enterprise, both the Australian and the German constitutions ofi'er noteworthy contrasts to our own fundamental law. It will not escape the close observer that the Germans have not created a Supreme court, on the model of our own, endowed with power to set aside acts of the executive and legislative branches of the government. The relations established by the Germans between the federal government and the states, ingenious compromises all must admit, ought to be studied in connection with Mr. Roosevelt's New Nationalism - not as an echo of a dead past but as a prophecy of the future.
