Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Governance of England A re-touched portrait is seldom a satisfactory production. It is a fact I have bad to keep in mind in preparing for the press this new edition of a book first published more than nine years ago. Such fidelity to the original as the sketch may hare possessed when executed might be lost in the attempt to make it a register of all the changes which time has wrought upon the features of the subject. The task would be one of peculiar difficulty at the present moment; for my revised edition is called for, as it happens, while the structure of our polity is undergoing a process of reconstruction still incomplete. With the ultimate form and powers of the Upper Chamber in suspense, and with the revolution in the government of Ireland impending but undecided, it would be futile to pass a definite judgment on transitory developments which must eventually assume a more definite and tangible shape. And so, while drawing some fresh illustrations and arguments from the events of the past few years, I prefer to leave this book as, in the main, an account of the "working constitution" of the United Kingdom in the opening decade of the twentieth century. Book excerpt: Excerpt from The Governance of England: Otherwise Called the Difference Between an Absolute and a Limited Monarchy This connexion of the work with the history of the time I have endeavoured to draw out, by bringing together from contemporary authorities whatever seemed to illustrate the meaning of the author. The closeness of the connexion is shown by the fact, more than once pointed out in the notes to the present edition, that the language of Fortescue is often identical with that of the public documents of the period. And this in turn illustrates another point of some importance to which I have also drawn attention; the fact namely that Fortescue, first of medieval political philoso phers, based his reasonings mainly on observation of exist ing constitutions, instead of merely copying or commenting on Aristotle. Above all, historical studies were but in their infancy: nor had the zeal and labour of successive genera tions of scholars yet established that critical apparatus, without which so many problems in chronology and philolog y would still remain unsolved. Book excerpt: Excerpt from Rise of Constitutional Government in England That constitutional history is very dry, is' an axiom admitted by almost all who have; never read it; that it is far more interesting than what is commonly received as history, is almost equally admitted by those who have. Constitutional histories are usually left un read, partly because they are long, ' partly because they generally contain a great deal of matter which the ordinary reader does not want to know, and partly because their arrange ment is such that it is difficult to pick out exactly the information that is sought. Book excerpt: Excerpt from The Government of England: Its Structure and Its Development The English Constitution forms a part of the Common Law. Our government by King, Lords, and Commons, the mutual relations of these several powers, our Constitution courts of law and of equity, our great offices of State, are all, and from their earliest rudiments have been, known to the law, and recognized by it. Obvious as this proposition now appears, it has not always been followed in practice; even yet, perhaps, it sometimes is not thoroughly understood. To the ingenious inventors of paper constitutions in the last century the unwritten traditions of our political system supplied a favourite subject for sarcasm and contempt. These politicians could not believe in any system of polity which was not expressed in words and figures; where there was no delicate adjustment of powers, and where the right of men to cashier their rulers was not prominently set forth. But the law of political conditions, like the law of property or the law of obligations, or any other portion of our jural system, needs not the formal statement of a code. "That ancient collection of unwritten maxims and customs," of which this branch of our law forms a part, has its own inherent vitality. It is no subtle contrivance of human art, but is one of the forms in which national life is manifested. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Governance of London: Studies on the Place Occupied by London in English Institutions In this book I have presented an anthropologist's view of London history. History to be of value must concern itself with something definite, and the something definite on which it appears to me to have been worth writing is the position of London as an English institution. Anthropologists know that institutions of quite unequal development do not coalesce, and the difficulty in the way of a Romanised Britain has always been that both tribal Celt and tribal Teuton stood in the way. The book, I hope, shows this difficulty, which was a very real one to our ancestors, to be an historical episode of very considerable importance in the evolution of the English, state. Whether I have successfully solved it is another question. Perhaps anthropologists may question my right to apply their science and their principles to so purely a historical subject, and may dispute my conclusions as unscientific from that point of view. The period is short, but meanwhile events have occurred which strengthen two at least of the posi tions maintained in England's Case against Home Rule.' The Gladstonian constitution, I contended, failed to fulfil the conditions which it was meant to satisfy. That this is so is all but admitted even by Home Rulers. The defence of the Gladstonian constitution has been' abandoned, if not by its author, at least by his followers. Few indeed are the eulogies which since the dissolution of Parliament have been pronounced by the advocates of Home Rule on the Government of Ireland Bill. Criticism' has not missed its mark; the vital defects of the measure pressed last summer on the acceptance of Parliament have' been made patent to all the world. Throughout my statement of the case against Home Rule the opinion is maintained that the discontent of the: Irish people is due far more to agrarian than to political causes. Book excerpt: Excerpt from The Government of the New England States All agree that in a republic like ours there is urgent need that every citizen know something of the government under which he lives, something of its functions, of its history, of the principles underlying it, and, particularly, of his personal relation to it. There is also universal agreement that this study of government and this training for citizenship should form one of the important branches of study in our elementary schools. This is evidenced by the trend of the discussions heard at educational meetings and among citizens generally throughout the country, by the appointment of committees by educational societies to consider courses and methods in the subject, by the organization of civic leagues for the express purpose of promoting civic instruction in our schools, and by the appearance of many elementary text-books designed for use in the grammar schools. Most of these text-books have attempted to cover the United States, and, therefore, in the treatment of all except the federal government, have been obliged to limit themselves to generalities. Those which have dealt with the government of a single State have proved unsatisfactory because of their tendency to leave the pupil with a narrow and imperfect view of his own local and State government. Book excerpt: Excerpt from A d104 Book on Civil Government in the United States If all the laws Of the state are self-imposed, that is, if there is no power outside its body of peo ple which dictates to it in any way, the sovereignty state is said to be sovereign. This word does not admit of comparison: one state cannot be more sovereign than another; and a small state, in this respect, stands on an equality with a large one. The sovereignty of a state consists in the absolute right to control its own members, and in the absolute right to resist any inter ference in its affairs by any other state. The first of these rights constitutes its internal sovereignty; the second, its external sovereignty. From these state ments it will be seen that Boston is not a state, that Massachusetts is not a sovereign state. The United States is a sovereign state or nation. Great Britain and Russia are both sovereign states. Having now defined a state, we are prepared to define civil government as control by law exercised by the state over its members as such. Book excerpt: Excerpt from The Origin and Development of Local Self-Government: In England and the United States An eminent historian has said that the institution of municipal corporations contributed more, perhaps, than any other cause to the emancipation of Europe from the thraldom of feudalism. If we may believe all that the prophets of evil have to say about the condition of local self-government in the United States, the future historian will trace the destruction of liberty in the great republic to the development of those corporations, the original institution of which brought light out of darkness. The more conspicuous instances of misgovernment have been dwelt upon with such force, and to such an extent, that there is some danger of breeding a spirit, which, instead of seeking a remedy consistent with the preservation of the rights of self-government, will be content with nothing less than the destruction of those rights by the establishment of a centralized system of administration, such as exists in republican France. There has been a significant change during the last quarter of a century, and more especially since the late war, in the feelings with which the people of this country exercise what may be called their minor political duties.
