Book excerpt: Globalisation turns out to be untenable because it does not guarantee minimum social equity, peace and respect for the environment, and therefore does not guarantee the effective accomplishment of human rights. This book analyzes this issue and raises proposals for a new perspective. The first part describes the soft threats to human rights, derived from the devaluation of the politics and the productive economy with regard to the finance. It entails the concealment of the reality in the shape of exploitation as the tax havens and in the shape of marginalization of the persons with different abilities. The second part include a study of hard threats to human rights and examines two cases of failed states: Afghanistan and Somalia, in which the violence has supplanted the politics and the economy. In view of these situations it is necessary to rethink the force of classic ius gentium and the humanitarian right. The third part presents the European Union as a legal and political space in which conditions of a worthy life are better defended by means of the Primacy of Practical Reason and Social State of Law, and by the requirement of peace as the main rule of international relations.

This is particularly evident in the enhanced concerns of states with issues of national security, as they are perceived in so many different ways. At the same time, states' ability to govern and deliver public services are increasingly being challenged. Science and technology dominate the present state of globalization, having increased human interdependence and interconnectedness, but with paradoxical positive and negative effects and outcomes. They enhance the power and wealth of certain states while increasing the gap between those states and others. Social, economic, and political disparities have intensified. Internal state dysfunction is on the increase as evidenced by the number of failed and failing states among developing and under-developed societies. Globalization has also provided some states with a greater claim of exceptionalism. That claim is also extended to certain multi-national corporations and other non-state actors (NSAs) because of their wealth, worldwide activities, and their economic and political power. As a result, such entities have benefited from impunity, notwithstanding the harmful consequences of their conduct on human beings and on the environment. Environmental changes will continue to unleash harmful consequences on certain parts of the world, which will impact certain populations. As these and other negative consequences of globalization occur, the values and legal protections afforded to human rights, including an end to impunity for international crimes, is receding. In Decolonization and the Evolution of International Human Rights, Roland Burke explores the changing impact of decolonization on the UN human rights program. By recovering the contributions of those Asian, African, and Arab voices that joined the global rights debate, Burke demonstrates the central importance of Third World influence across the most pivotal battles in the United Nations, from those that secured the principle of universality, to the passage of the first binding human rights treaties, to the flawed but radical step of studying individual pleas for help. The very presence of so many independent voices from outside the West, and the often defensive nature of Western interventions, complicates the common presumption that the postwar human rights project was driven by Europe and the United States. Drawing on UN transcripts, archives, and the personal papers of key historical actors, this book challenges the notion that the international rights order was imposed on an unwilling and marginalized Third World. Far from being excluded, Asian, African, and Middle Eastern diplomats were powerful agents in both advancing and later obstructing the promotion of human rights.
