Book excerpt: This open access book assembles landmark studies on divorce and separation in European countries, and how this affects the life of parents and children. It focuses on four major areas of post-separation lives, namely (1) economic conditions, (2) parent-child relationships, (3) parent and child well-being, and (4) health. Through studies from several European countries, the book showcases how legal regulations and social policies influence parental and child well-being after divorce and separation. It also illustrates how social policies are interwoven with the normative fabric of a country. For example, it is shown that father-child contact after separation is more intense in those countries which have adopted policies that encourage shared parenting. Correspondingly, countries that have adopted these regulations are at the forefront of more egalitarian gender role attitudes. Apart from a strong emphasis on the legal and social policy context, the studies in this volume adopt a longitudinal perspective and situate post-separation behaviour and well-being in the life course. The longitudinal perspective opens up new avenues for research to understand how behaviour and conditions prior or at divorce and separation affect later behaviour and well-being. As such this book is of special appeal to scholars of family research as well as to anyone interested in the role of divorce and separation in Europe in the 21st century.

Available in PDF, EPUB and Kindle. Book excerpt: In 1991, the people of Ireland elected Mary Robinson, a women's rights crusader who supported legalized birth control and divorce, as their president. The country seemed poised for massive social and legal change, but it became apparent that even though Ireland at the dawn of the 21st century would be very different from the Ireland of the past, many fundamentals would remain the same. This book examines Irish abortion and divorce law in their historical, religious, and cultural contexts. Its main focus is on the well-publicized referenda and court cases of the 1980s and 1990s, with special attention given to their roots and potential long-term effects on the communitarian Irish culture and opportunities for Irish women. The author identifies and discusses three forces that have affected Irish law and mores, especially those relating to abortion and divorce: economic insecurity; a sense of group loyalty and identification, particularly within families and churches; and Catholic teaching about the common good.

Available in PDF, EPUB and Kindle. Book excerpt: The Changing Concept of ‘Family’ and Challenges for Domestic Family Law explores the changing concept of ‘family’, with the current social, political, medical and scientific challenges for domestic family law discussed in over 20 European jurisdictions. National reports describe the current law and legal development for ‘horizontal’ (the law of relationships between adults such as marriage, divorce, cohabitation, same-sex relationships), ‘vertical’ (the law governing the relationships between adults and children, such as parentage including artificial reproductive techniques and surrogacy, parental responsibility and adoption) and ‘individual’ (the law of names and recognition of gender identity) family law. They show that, while considerable legal and societal diversity still exists within Europe, family law, in many areas, is developing along similar lines, with a convergence towards a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

As each country has experienced spiralling divorce rates and has adopted more liberal rules for divorce, it has begun to be concerned about the social and economic consequences of these changes. The twenty-six eminent contributors to this volume investigate how the new laws work in practice, analyze the societal effects of rapid change, and grapple with the policy implications of their results.

Available in PDF, EPUB and Kindle. Book excerpt: Cohabiting couples and those entering religious-only marriages all too often end up with inadequate legal protection when the relationship ends. Yet, despite this shared experience, the linkages and overlaps between these two groups have largely been ignored in the legal literature. Based on wide-ranging empirical studies, this timely book brings together scholars working in both areas to explore the complexities of the law, the different ways in which individuals experience and navigate the existing legal framework and the potential solutions for reform. Illuminating pressing implications for social policy, this is an invaluable resource for policy makers, practitioners, researchers and students of family law.

Available in PDF, EPUB and Kindle. Book excerpt: Lone parenthood is an increasing reality in the 21st century, reinforced by the diffusion of divorce and separation. This volume provides a comprehensive portrait of lone parenthood at the beginning of the XXI century from a life course perspective. The contributions included in this volume examine the dynamics of lone parenthood in the life course and explore the trajectories of lone parents in terms of income, poverty, labour, market behaviour, wellbeing, and health. Throughout, comparative analyses of data from countries as France, the United Kingdom, Ireland, Germany, Belgium, Sweden, Switzerland, Hungary, and Australia help portray how lone parenthood varies between regions, cultures, generations, and institutional settings. The findings show that one-parent households are inhabited by a rather heterogeneous world of mothers and fathers facing different challenges. Readers will not only discover the demographics and diversity of lone parents, but also the variety of social representations and discourses about the changing phenomenon of lone parenthood. The book provides a mixture of qualitative and quantitative studies on lone parenthood. Using large scale and longitudinal panel and register data, the reader will gain insight in complex processes across time. More qualitative case studies on the other hand discuss the definition of lone parenthood, the public debate around it, and the social and subjective representations of lone parents themselves. This book aims at sociologists, demographers, psychologists, political scientists, family therapists, and policy makers who want to gain new insights into one of the most striking changes in family forms over the last 50 years.
