Book excerpt: Excerpt from Hand-Book of the Law of Bills and Notes In preparing a new edition of Mr. Norton's book, it has been deemed advisable to print as an appendix the Negotiable Instruments Law, which has already been adopted in fifteen states, as well as in the Dis triet of Columbia. It is obvious that even an elementary book upon Bills and Notes must contain references to this law, which, while it is, in the main, declaratory in its efiect, settles some doubtful points, and necessarily changes rules in many jurisdictions upon points con cerning which a conflict of laws existed. The text of the law as print ed in the appendix is that of the New York act, such few modifications as have been made by the various states being mentioned in the notes. The law is also valuable to the student, even in states which have not adopted it, as furnishing a concise statement of rules, which for the most part are of universal application; and for this reason the editor has throughout the book, in the footnotes, inserted references to the appropriate sections of the law, at the same time pointing out any changes effected by them. Much new matter has been incorpo rated, and this has necessitated some alteration of the former text. At the suggestion of many teachers, the publishers have adopted the device of printing in bold type in the footnotes and text the names of all cases there cited which are to be found in certain of the collee tions of leading and illustrative cases on Bills and Notes in use in the law schools. The cases so printed are to be found in Ames' Cases on the Law of Bills and Notes, Huffcut's Negotiable Instruments, and Johnson's Elements of the Law of Negotiable Contracts (second edi tion). Founded as it is upon the Digest of Judge Chalmers, afterward enacted into the English Bills of Exchange Act, it presents the best statement available of the results of English and American judicial decisions. Even before its adoption by the legislatures in Great Britain and the United States, Judge Chalmer's Digest had been edited for use in law schools, and had met with much favor for purposes of study and instruction. A Digest or Code is, however, but a set of abstract rules. The student needs to see the rules in operation upon concrete facts in order to appreciate their force and effect. It is the purpose of this book to set over against each important rule a case or a selection of cases from which the rule might be deduced did no Code exist and in which the rule, as embodied in the Code, may be studied in its application to concrete facts. In this way it is hoped to give vitality and interest to what are otherwise mere abstract propositions of law. As to the relation of the cases to the Code, the reader is referred to Judge Chalmers' remarks, found on page 119 of this work, and to the opinion of Lord Herschell on page 127, and of Lord Russell of Killowen on page 442. Under the sections of the statute will be found references to the "Cases and Authorities" which make up Part II of the work. Conversely there is set opposite the title to each case the section number of the statute which is applicable to it. In the four years which have elapsed Since then it has been enacted in Massachusetts, Rho-de Island, Pennsylvania, Maryland, Virginia, North Carolina, Tennessee, Wisconsin, North Dakota, Utah, Oregon and Washington, and has also been adopted by Congress as the law of the District of Columbia. In most instances the law has been passed in the form pro posed by the Commissioners on Uniformity of Laws; but in several States a few minor changes have been made. These are indicated in the notes to this edition. I have also en deavored to point out the changes made by the law in the different States, and have added to the notes citations to the decisions in all the States where the statute is now in force. It is somewhat notable that so few cases have arisen under the Act. The reported cases number only about a half dozen in all; and in most of these the court was required only to apply the act, and not to construe it. Perhaps nothing could better demonstrate that the practical working of the law has been satisfactory. As in the previous edition, the text is that of the New York Act. For the information of the pro fession outside of New York it may be stated that the hiatus in the section numbers does not indicate the omission of any sections, but is in accordance with the plan adopted in all the General Laws of this State.
