Book excerpt: This book is a collection of essays dealing with issues of contemporary significance in the law of treaties. It neither purports nor aspires to provide a general overview of all aspects of the law of treaties, and it is by no means intended to be a comprehensive textbook. The discussion of the subjects selected in this book will shed some light on a number of areas of the contemporary law of treaties, and, consequently, on some important features of the international legal system at the beginning of the twenty-first century. The relevance of the rules governing the law of treaties for other central fields of international law continue to be the subject of frequent doctrinal discussion. In addition, some rapidly developing newer areas of public international law, which are regulated for the most part by treaties, have renewed the importance of some older problems, for example, the question of conflicts between treaties regulating the same subject-matter and the matter of treaty interpretation. One other important issue is the relevance of the emergence of new actors and factors, other than states, in the international legal order in general, and in the law of treaties in particular.

Book excerpt: Do you know silica, the tetrahedra of silicon and oxygen constituting the crystals of New Agers and the desiccant in a box of new shoes? It's no mere mundane mineral. As chemically reacting silicate rocks, silica set off the chain of events known as the origin of life. As biomineralized opal, it is the cell wall, skeleton, spicules, and scales of organisms ornamenting numerous lobes of the tree of life. Cryptocrystalline silica made into stone tools helped drive the evolution of our hands and our capability for complex grammar, music, and mathematics. As quartz crystals, silica is impressively electric and ubiquitous in modern technology (think sonar, radios, telephones, ultrasound, and cheap but precise watches). Silica is inescapable when we take a drink or mow the lawn and it has already started to save the Earth from the carbon dioxide we're spewing into the atmosphere. This book tells these scientific tales and more, to give dear, modest silica its due.

Book excerpt: This book explores the best mechanisms for helping bring about compliance with international treaties. In recent years, many international treaties have included non-compliance mechanisms (NCMs) to facilitate implementation and promote parties' compliance with their obligations. These NCMs exist alongside the formal dispute resolution processes of international courts and tribunals. The authors bring together a wide legal and geographical spectrum of views from different parts of the world representing novel insights into NCMs' contribution to treaty implementation and compliance. The research has cast important light on how procedural innovations may help render NCMs more effective, as well as on the circumstances in which they may be needed, including particularly where nations share common interests, populations are interdependent, and implementation makes significant administrative, regulatory and political demands. Book excerpt: Over the last two decades, environmental problems have been increasingly identified as potential sources of international instability or even direct threats to international peace and security. This phenomenon has been reflected in the growing proportion of multilateral environmental treaties which include dispute settlement clauses. At the same time, and increasingly since the beginning of the 1990s, international adjudication is going through a renaissance as more and more cases are submitted to an expanding number of international judicial fora. This unique study takes a pragmatic approach to determine under which conditions international adjudication, as currently structured, can effectively tackle the challenge of environmental degradation and the ensuing international disputes. It illustrates how multilateral environmental treaties have provided for the settlement of disputes that may arise from their implementation, with special attention given to so-called non-compliance procedures. Ten environmental disputes which have been the subject of international adjudication are examined in detail, explaining the origins of the dispute, how and why the case was brought before that particular jurisdiction, the proceedings, the judgement, and the aftermath of the case. To assess the effectiveness of adjudicative means, famous cases are revisited, including the Bering Sea Fur Seals, Trail Smelter, Lake Lanoux, Nauru Phosphates, Nuclear Tests, Danube, Meuse River, and Southern Bluefin Tuna cases, and the impact the judgements had on the original environmental problems examined.

Through a series of case studies the authors explore the coalescence of social forces around environmental issues, the process of alliance formation, and the role of state institutions, media and NGOs in the complex political battles over resource allocation. The volatile tensions between the winners and losers in this struggle for the environment will make Southeast Asia a focus of increased attention.

Book excerpt: This timely book provides a comprehensive insight into the challenges facing humanity and Earth in the 21st century. It opens with a discussion of the domination of all the continents and oceans by a growing human population. This is followed by an appraisal of the extent to which water and food supplies will be able to accommodate this population, which may reach eleven billion by 2100. The rapidly increasing ability to change biology and evolution through genomics is considered next and complements a discussion of disease, which is viewed largely as an evolutionary struggle between humanity and pathogens. A seemingly insatiable demand for energy, future energy supplies and the impact of their use on climate and attempts to ameliorate these effects are next examined. The book concludes with a discussion of the partial destruction of the ozone layer and the international effort to repair the damage./a

Book excerpt: This research examines the growth and expansion of public interest environmental litigation (PIEL) in India and analyses the changes that are influencing the development of PIEL in Bangladesh and Pakistan. The necessity for this research lies in the rapid degradation of environment and the need of efficient environmental management in the three countries of the South Asian region. Here, we compare the legal systems of the three countries from the environmental point of view, discuss new ideas and directions and critically analyse the legal provisions that would help to apply environmental norms. These offer the legislators a chance to find out what can be applied in their own region, thus developing their existing legal mechanisms. About the author Jona Razzaque is barrister and holds a PhD in law from the University of London. She works in the field of access to environmental justice and has published numerous articles on this issue. She taught law in Queen Mary College and School of Oriental and African Studies under the University of London. She is currently working as a lawyer in the Foundation for International Environmental Law and Development (FIELD) on cross-themed projects related to bio-diversity, trade and climate change.
