Book Synopsis The French Civil Code by : Jean-Louis Halperin
Download or read book The French Civil Code written by Jean-Louis Halperin and published by Taylor & Francis. This book was released on 2021-12-17 with total page 125 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book charts the formation of the French Civil Code, examining both its public and private effects. From the sixteenth to the eighteenth century, French private law was very different in the various parts of the country. In northern and central France, there were as many as sixty-five general customs in force, as well as over three hundred local customs, often differing from them in detail. As the feeling of nationhood grew, so did the idea of replacing the existing variety of laws by a single private law, possibly a code, common to all of France. 'A single body of law, called the Code Civil is to be created' proclaimed the Law of 21 March 1804, which was created by the amalgamation of thirty-six texts. The French Civil Code analyzes the Code using contemporary and modern sources, including the beautiful and concise extract from H.A.L. Fisher's History of Europe which gives an English historian's appraisal of Napoleon's contribution to the Code Civil. This text will appeal to all students of and those with an interest in international law.

This book was released on 2017-09-16 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Manual of French Law and Commercial Information This volume is a compendium of the salient points in the Law of France, taken from the French Codes and the Laws in vogue in France at the present day, together with special articles by experts on subjects of particular interest to American and English business men, travellers, and persons having business and social relations with France, students and literary persons desiring a handy book for reference. To this is added a number of forms in daily use in France in connection with business transactions and legal affairs. The whole is alphabetically arranged for convenience of reference. While written principally for laymen, the Manual may be of some interest and utility to the Profession. Of interest because French law is the perpetuation of the Civil Law, and it is also well for us votaries of the Common Law to remember that there is another juris prudence founded upon the Roman or the Civil Law, and prevailing throughout the greater part of Continental Europe, from which we have ourselves borrowed many of the most important legal principles. Of utility because the Manual, being compiled from reliable sources, may be safely consulted when occasion demands. Book excerpt: On the occasion of the recent bicentenary of the French Civil Code in 2004, this book reassesses the influence of this essential element of European private law. Contributions by distinguished jurists from the judiciary and academia examine the current role of the Civil Code within the French system, as well as its impact beyond the borders of France in other countries of Europe and beyond. Particular examination is made of the influence of the Napoleonic Code within Common Law countries. Authoritative contributions in both English and French offer theoretical and practical perspectives from both common law and civil law jurisdictions.
Book Synopsis The French Civil Code by : Henry Cachard
Download or read book The French Civil Code written by Henry Cachard and published by Forgotten Books. This book was released on 2017-10-13 with total page 624 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The French Civil Code: With the Various Amendments Thereto, as in Force on March 15, 1895 MY object in translating the Civil Code of France into English is to place at the disposal of the members of the Legal Profession in English-speak ing countries, a work enabling them to find out and establish what the French law is. For that purpose I have compared my translation with the original records, and have sworn to its correctness. Supplements will hereafter appear, containing the new amendments to the Code. Foreign Courts when called upon to decide questions of French law have sometimes rendered decisions not in accordance with the laws of that country. This book, it is to be hoped, may be found useful in preventing the recurrence of such cases. In remembering the achievements of France's great Conqueror, the Code is not among the works which have contributed the least to his fame, and its effects will be more lasting than those of his great battles. When presiding over the meetings at which the Articles of the Code were discussed, Napoleon, although not a jurist, displayed such quickness of perception and soundness of views as to astonish those present. Book Synopsis An Historical Introduction to Modern Civil Law by : Thomas Glyn Watkin
Download or read book An Historical Introduction to Modern Civil Law written by Thomas Glyn Watkin and published by Dartmouth Publishing Company. This book was released on 1999 with total page 520 pages. Available in PDF, EPUB and Kindle. Book excerpt: This account of civil law explores the Roman achievement as well as tracing how the contribution of the ancients was recognized and embraced during the intervening centuries by the various schools of civil and canon law, and also how the civilian tradition encompassed and absorbed many features from the legal arrangements of the Germanic world and other legal orders. The volume is designed to assist the reader who seeks an historical explanation of the similarities which exist among the civil law countries of contemporary Europe. It is not intended to furnish a narrative history of European civil law from ancient Rome to the present time. Instead, it focuses upon the development of those parts of the civilian legal heritage which are important to an understanding of contemporary civil law systems, while supplying sufficient information regarding the general history of the civilian tradition to make those developments comprehensible.
