Book excerpt: One of the most unfortunate facts about the relationship of the United States with Latin America is that only in recent years has there been any appreciable amount of intellectual interchange with reference to law. This, of course, is an example of the relative lack of cultural exchange between these peoples. Only in very recent years has the North American interest in Latin America been in any sense general and active. While there are a few recent volumes which discuss various aspects of Latin American law in a fashion calculated to interest the North American lawyer and academician, the Latin American contributions to and attitudes toward international law are virtually unknown in the United States except in very restricted quarters. For this reason it was thought that a survey such as the one presented here would contribute not only to a better under standing of Latin American juristic thought as pertaining to international law, but also to a better comprehension of legal theory in general, and of Latin American culture as a whole. The phase of the philosophy of international law which, with reference to the regional application here studied, has been the major interest in this work, i.e., whether writers rely more on naturalism or positivism as the philosophical foundation of the law of nations, is, like the matter of Latin American law itself, a subject which has been neglected by North American scholars.

The Attorney General of the United States performs several functions that affect in one way or another the relations of the United States with foreign nations. But this study focuses mainly on only one of these, namely, the duty of the Attorney General to provide legal opinions to various officers of the federal government. The reasons for undertaking a study of those opinions of the Attorney General especially relating to international law and practice are set forth in the Introduction, and will not be com mented upon here. In like manner, the problems of method, sources and coverage encountered in the course of inquiry are discussed at appropriate points in the text. Much of the material used herein is based on the research done in connection with my doctoral dissertation, accepted by Duke University in 1951. "Three generations of imbeciles are enough." Few lines from U.S. Supreme Court opinions are as memorable as this declaration by Justice Oliver Wendell Holmes Jr. in the landmark 1927 case Buck v. Bell. The ruling allowed states to forcibly sterilize residents in order to prevent "feebleminded and socially inadequate" people from having children. It is the only time the Supreme Court endorsed surgery as a tool of government policy. Though Buck set the stage for more than sixty thousand involuntary sterilizations in the United States and was cited at the Nuremberg trials in defense of Nazi sterilization experiments, it has never been overturned. It has been more than a decade since Paul A. Lombardo's classic Three Generations, No Imbeciles first exposed the Buck case's fraudulent roots. During that time, several of the remaining twentieth-century eugenic sterilization statutes have finally been repealed, and reparations to sterilization survivors have been paid in two states. Discussion of the Buck case has once again engendered controversy in the courts. The Wisconsin Supreme Court invoked Buck most recently in a debate over the power of the state to enact restrictions on citizens and businesses during the COVID-19 crisis, and the US Supreme Court cited Three Generations, No Imbeciles in arguments over the newest state laws seeking to limit access to abortion.
