Book Synopsis Rationing and Resource Allocation in Healthcare by : Ezekiel Emanuel
Download or read book Rationing and Resource Allocation in Healthcare written by Ezekiel Emanuel and published by Oxford University Press. This book was released on 2018-05-10 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: Budgets of governments and private insurances are limited. Not all drugs and services that appear beneficial to patients or physicians can be covered. Is there a core set of benefits that everyone should be entitled to? If so, how should this set be determined? Are fair decisions just impossible, if we know from the outset than not all needs can be met? While early work in bioethics has focused on clinical issues and a narrow set of principles, in recent years there has been a marked shift towards addressing broader population-level issues, requiring consideration of more demanding theories in philosophy, political science, and economics. At the heart of bioethics' new orientation is the goal of clarity on a complex set of questions in rationing and resource allocation. Rationing and Resource Allocation in Healthcare: Essential Readings provides key excerpts from seminal and pertinent texts and case studies about these topics, contextualized by original introductions. The volume is divided into three broad sections: Conceptual Distinctions and Ethical Theory; Rationing; and Resource Allocation. Containing the most important and classic articles surrounding the theoretical and practical issues related to rationing and how to allocate scare medical resources, this collection aims to assist and inform those who wish to be a part of bioethics' 21st century shift including practitioners and policy-makers, and students and scholars in the health sciences, philosophy, law, and medical ethics.
Book Synopsis Allocating International Responsibility Between Member States and International Organisations by : Nikolaos Voulgaris
Download or read book Allocating International Responsibility Between Member States and International Organisations written by Nikolaos Voulgaris and published by Bloomsbury Publishing. This book was released on 2019-05-16 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: The ever-growing interaction between member States and international organisations results, all too often, in situations of non-conformity with international law (eg peacekeeping operations, international economic adjustment programmes, counter-terrorism sanctions). Seven years after the finalisation of the International Law Commission's Articles on the Responsibility of International Organisations (ARIO), international law on the allocation of international responsibility between these actors still remains unsettled. The confusion around the nature and normative calibre of the relevant rules, the paucity of relevant international practice supporting them and the lack of a clear and principled framework for their elaboration impairs their application and restricts their ability to act as effective regulatory formulas. This study aims to offer doctrinal clarity in this area of law and purports to serve as a point of reference for all those with a vested interest in the topic. For the first time since the publication of the ARIO, all international responsibility issues dealing with interactions between member States and international organisations are put together in one book under a common approach. Structured around a systematisation of the interactions between these actors, the study provides an analytical framework for the regulation of indirect responsibility scenarios. Based on the ideas of the intellectual fathers of international law, such as Scelle's 'dédoublement fonctionnel' theory and Ago's 'derivative responsibility' model, the book employs old ideas to add original argumentation to a topic that has been dealt with extensively by recent commentators.

Available in PDF, EPUB and Kindle. Book excerpt: As national borders become more permeable, women are increasingly travelling from poor to rich countries to take up jobs as care workers. The struggle to maintain a healthy work-care balance in Western nations is creating a care deficit in the developing world. This volume links ethics to the social politics of care by examining the implications of the feminization of migrant labour and the shortcomings of social policy. From Canada to Sweden and from Korea to Japan, renowned and emerging scholars reveal that a truly feminist ethics of care must be grounded in the concrete lives of real people working in transnational webs of social relations.

Download or read book Frontex and Human Rights written by Melanie Fink and published by Oxford University Press. This book was released on 2018-12-13 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the allocation of responsibility for human rights violations that occur in the context of border control or return operations coordinated by Frontex. The analysis is conducted in three parts. The first part examines the detailed roles and powers of Frontex and the states involved during joint operations, focussing on the decision-making processes and chains of command. The second and third parts develop general rules that govern the allocation of responsibility under public international law, ECHR law, and EU non-contractual liability law in order to apply them to Frontex operations. To illustrate the practical implications of the findings, the study uses four hypothetical scenarios that are based on situations that have in the past given rise to human rights concerns. The book concludes that whilst responsibility for most human rights violations lies with the host state of an operation, it often shares this responsibility with participating states who contribute large assets as well as Frontex. However, the book also exposes how difficult it is for individuals to find a place for bringing complaints against violations of their human rights suffered at the EU's external borders. This casts doubts on whether the current legal framework offers them an effective remedy.

Available in PDF, EPUB and Kindle.

Book Synopsis The Participation of the EU in International Dispute Settlement by : Luca Pantaleo
Download or read book The Participation of the EU in International Dispute Settlement written by Luca Pantaleo and published by Springer. This book was released on 2018-10-22 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: The topic of this book is the participation of the EU in international dispute settlement. It aims to provide the reader with an appraisal of the most problematic aspects connected with the participation of a sui generis legal subject such as the EU to international dispute settlement mechanisms in a State-centric international law. In particular, the publication dwells on the question of how to make possible an effective participation in disputes while at the same time preserving the specific characteristics (i.e. the autonomy) of the EU legal order. It does so by outlining different models and proposing the internalization model adopted under EU investment agreements as a possible paradigm. It is aimed at academics, practitioners and graduate students as well as EU officials and judges who should find the issues discussed both useful and of interest for staying up-to-date on the scholarly discussion and of their relevance to case law. Luca Pantaleo is a Lecturer in International and European Law at The Hague University of Applied Sciences in The Netherlands. He obtained a PhD in International and EU Law in 2013 at the University of Macerata in Italy and was previously a Senior Researcher at the T.M.C. Asser Institute and Postdoctoral researcher at the University of Luxembourg.
