Book excerpt: The impact of the September 11, 2001, attack by Al Qaeda was felt worldwide with increased security measures. However, maritime security measures are not as encompassing. This thesis investigated the possibility of maritime domain terrorism threats and what could be done to prevent such attacks as modeled on the basis of system of systems. Only certain terrorist groups have the capability to launch maritime terrorist attacks. The terrorist motives are to spread their political message, responding to what they have perceived as oppression. The system of systems model suggests (and is validated) that container vessels and cruise ships are potential targets, with possible human and economic consequences. However, these maritime targets failed to match the terrorist groups' objectives. Political assets such as warships and land-based maritime infrastructure align well to terrorist motives. Enhanced security measures protecting military and maritime infrastructure may require terrorists to use uncommon forms of attack. Terrorists could use submersible vehicles to remain undetectable. Costly submersible vehicles limit the type and number of terrorist groups that can employ such capability.

This book originates from the NATO Advanced Research Workshop (ARW) Counter-Terrorism Lessons from Maritime Piracy and Narcotics Interdiction, held in Copenhagen, Denmark, in May 2019. Participants in the three-day workshop included policymakers, senior military officers, and academics from NATO member states, international organizations, and two partner nations: Colombia and Israel. Their extensive discussions focused on methods for protecting critical maritime infrastructure, such as ports, supplies, and personnel, from seaborne terrorist attacks. Presentations and roundtables also addressed the human and social factors that contribute to the defense against terrorism in the maritime domain. The book is divided into three sections: organized crime and narcotrafficking; maritime piracy; and terrorism, and aims to bridge the gaps between these three substantive areas of maritime security research. These have remained largely separate areas of research in the past, with the result that valuable maritime security lessons from counter-piracy and counter-narcotics operations have not been fully incorporated into counter-terrorism best practice. The book facilitates the transmission of lessons learned from counter-piracy and counter-narcotic operations to formulate recommendations for best practice and technological innovations to manage maritime terrorism, and will be of interest to all those working in the field.

Yet, the avenues of attack and the varieties of terrorists far outnumber the available resources of most agencies concerned. Moreover, there have been no attacks on homeland U.S. targets since September 11. The red team concept provides an innovative method to examine these vulnerabilities from the terrorist perspective. The effectiveness of a red team can be measured in various ways and is dependent on key organizational and situational elements. In the end, the determination of effectiveness is based on the original intentions of the host enterprise, whether it is training, research, strategy, or analysis or a combination. We conducted a case study to utilize the red team concept as a tool for bringing a fresh awareness to a critical issue within the National Strategy for Combating Terrorism. The red teams identified vulnerabilities of possible targets, raised the awareness on the nature of terrorists, researched potential tactics and tools, and examined existing assumptions about maritime security. In applying the red team concept, the case study used military officers as surrogate terrorists planning a campaign to attack port cities. The case study effectively demonstrated the anticipated functions, while the follow- on actions ensured that the results were distributed to the appropriate agencies. Furthermore, civilian officials and the agencies concerned valued the red team reports as positive insights into the current situation.

Understanding the nature of maritime terrorism risk requires an investigation of threats, vulnerabilities, and consequences associated with potential attacks, as grounded both by relevant historical data and by intelligence on the capabilities and intentions of known terrorist groups. These risks also provide the context for understanding government institutions that will respond to future attacks, and particularly so with regard to the US civil justice system. In principle, civil liability operates to redistribute the harms associated with legally redressable claims, so that related costs are borne by the parties responsible for having caused them. In connection with maritime terrorism, civil liability creates that prospect that independent commercial defendants will be held responsible for damages caused by terrorist attacks. This book explores risks and U.S. civil liability rules as they may apply in the context of these types of attacks.

Here, piracy is defined as taking place on the high seas, while maritime crime takes place within a country’s territorial waters. Seaborne terrorism may occur in either one of these maritime zones. Maritime piracy can be divided into several categories, from pirates robbing a ship or its crew of petty items while at sea to taking a ship’s cargo and taking control of a vessel, reflagging it, and then using this captured ship to smuggle drugs, transport illegal immigrants, or conduct further acts of piracy. This is the most dangerous, not only because pirates can use a captured ship to carry out more raids, but also because they can use the ship’s identity papers to transport goods and weapons—potentially WMDs—into otherwise secure port areas. A special concern to the US is that the threat of piracy is growing most quickly in parts of the world—such as Africa, South Asia, and Southeast Asia—where both global trade is rapidly expanding and where international terrorist groups are actively functioning or have supporters. This geographical overlap suggests that the risk that pirates and terrorists may one day cooperate to strike at the US or an ally is most likely also on the rise. While many important African, South Asia, and Southeast Asian cases have received insufficient attention, many well-known historical piracy events stand in need of a reappraisal. This book integrates a number of multinational, multiregional, and historical cases of piracy, maritime crime, and seaborne terrorism to investigate whether piracy and other forms of maritime crime are becoming a major United States national security concern. It analyzes some of the most important cases, especially of the 19th, 20th, and early 21st centuries, as well as specific historical events. This allows to draw lessons as to what are the components of successful and unsuccessful piracy, common causes, the type of navy necessary to control it, and finally, possible military, political, and economic consequences. The book also discusses various types of cases, including parasitic, intrinsic, episodic, and opportunistic piracy. Specific cases are also evaluated in terms of the changing interpretations of international law and the recent reported growth rates of piracy, maritime crime, and seaborne terrorism. These findings are used to explore the impact of piracy on maritime security, in particular in Africa, South Asia, and Southeast Asia and their surrounding waters, which is where the majority of contemporary piracies and maritime crimes occur. Different methods of policing piracy and maritime crime are evaluated, including the viability of adopting greater Maritime Domain Awareness, which would require that all ships at sea—regardless of size or function—emit a signal beacon identifying their name, country of origin, and route. This combination of historical and modern day piracy and the many cases studied will provide readers with a broader understanding of maritime piracy.
