This book was released on 2018-09-15 with total page 55 pages. Available in PDF, EPUB and Kindle. Book excerpt: The history of Islamic thought is marked by a continuous tradition of internal revitalisation and reform embedded in the principles of islah, and tajdid. The ultimate purpose has been to bring existing realities and social change in line with the transcendant and universal standard of the Qur’an and Sunnah through a process of restoration and reform. The tradition of islah-tajdid has thus consistently challenged the Muslim status quo and prompted fresh interpretation of the Qur’an and Sunnah, understood and implemented through the methodologies of interpretation and ijtihad, as well as the rejection of unwarranted accretions to the original messages of Islam. The basic theme of the paper is that civilisational renewal is an integral part of Islamic thought. The paper looks into the meaning, definition and origins of tajdid and islah and their relationship with ijtihad, and how these have been manifested in the writings and contributions of the thought leaders of Islam throughout its history. It also develops tajdid-related formulas and guidelines that should lead the efforts of contemporary Muslims in forging the objectives of inter-civilisational harmony and their cooperationfor the common good.

Book excerpt: This paper develops the idea of a maqasid-based framework for ijtihad and civilizational renewal (tajdid hadari), a broad and engaging prospect that also involves a review and reappraisal of the methodology of Islamic jurisprudence relating to both the maqasid and ijtihad. The author argues that this would enable Muslims to widen the scope and horizon of the maqasid or objectives of Islamic law from their currently legalistic leanings towards the wider perspective of civilisational renaissance. The nexus that needs to be developed between the maqasid and ijtihad also needs to be supported by a credible methodology, which is what the author has attempted in this paper.

This book was released on 2018-01-01 with total page 41 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the early centuries of Islam the response of Muslims to problem-solving the various issues and challenges that faced their rapidly expanding community was to use intelligence and independent reasoning based on the Qur’an and Sunnah to address them. This practice is known as ijtihad. As the centuries wore on however the gates of ijtihad were generally closed in favor of following existing rulings developed by scholars by way of analogy. And as reason and intellect, now held captive to madhhabs (schools of thought) and earlier scholarly opinion stagnated, so did the Muslim world. Ijtihad and Renewal is an analysis of ijtihad and the role it can play for a positive Muslim revival in the modern world, a revival based on society-wide economic and educational reform and development. It makes the case that the grafting of solutions rooted in the past onto the complex and unique realities of our own age, in a one-size-fits-all perspective, has paralysed the vitality of Muslim thought, and confused its sense of direction, and that to revive the Muslim world from its centuries of decline and slumber we need to revive the practice of ijtihad. Focusing attention on thinking through solutions for ourselves based on our own times and context, using the Qur’an and Sunnah, as well as the wisdom and experience of the past distilled from these, as tools in this endeavor whilst not the only solution, is certainly a viable and powerful one.

Iran World Award for Book of the Year In The Middle Path of Moderation in Islam, leading Islamic law expert Mohammad Hashim Kamali examines the concept of wasatiyyah, or moderation, arguing that scholars, religious communities, and policy circles alike must have access to this governing principle that drives the silent majority of Muslims, rather than focusing on the extremist fringe. Kamali explores wasatiyyah in both historical/conceptual terms and in contemporary/practical terms. Tracing the definition and scope of the concept from the foundational sources of Islam, the Qu'ran and Hadith, he demonstrates that wasatiyyah has a long and well-developed history in Islamic law and applies the concept to contemporary issues of global policy, such as justice, women's rights, environmental and financial balance, and globalization. Framing his work as an open dialogue against a now-decades long formulation of the arguably destructive Huntingtonian "clash of civilizations" thesis as well as the public rhetoric of fear of Muslim extremism since the attacks of September 11, 2001, Kamali connects historical conceptions of wasatiyyah to the themes of state and international law, governance, and cultural maladies in the Muslim world and beyond. Both a descriptive and prescriptive meditation on a key but often neglected principle of Islam, The Middle Path of Moderation in Islam provides insight into an idea that is in the strategic interest of the West both to show and practice for themselves and to recognize in Muslim countries.

Available in PDF, EPUB and Kindle. Book excerpt: Scholars, thinkers, and activists around the world are paying increasing attention to a legal reform method that promises to revolutionize the way people think about Islamic law. Known as “The Objectives of the Sharī‘a” (maqāṣid al-sharī‘a), the theory offers a way to derive and apply new Islamic laws using an ancient methodology. The theory identifies core objectives that underlie Islamic law, and then looks at inherited Islamic laws to see whether they meet those objectives. According to the maqāṣid theory, historical Islamic laws that meet their objectives should be retained, and those that do not—no matter how entrenched in practice or embedded in texts—should be discarded or reformed. Recently, several scholars have questioned the maqāṣid theory, arguing that it is designed not to reform laws, but to support existing power structures. They warn that adopting the maqāṣid wholesale would set the reform project back, ensuring that inherited Islamic laws are never fully reformed to agree with contemporary values like gender-egalitarianism and universal human rights. The Objectives of Islamic Law: The Promises and Challenges of the Maqāṣid al-Sharī‘acaptures the ongoing debate between proponents and skeptics of the maqāṣid theory. It raises some of the most important issues in Islamic legal debates today, and lays out visions for the future of Islamic law.

More than simply a system of law, it is concerned with a set of values and rules that are essential to the understanding and practice of Islam. In this volume, Mohammad Hashim Kamali, a world-renowned expert on Shariah, adopts a question-and-answer format to provide a clear introduction to its most salient aspects. Extending from the sources of Shariah in the Qur’an, hadith and the legal maxims of Islamic law to the discussion of issues such as freedom of religion, gender equality and human rights, Shariah Law: Questions and Answers connects the theoretical aspects of the law with how it is applied in the world today. At once scholarly and accessible, it is sure to be a vital resource for students, teachers and general readers, addressing as it does a range of contemporary concerns, including jihad, democracy, the environment, genetic engineering, human cloning, euthanasia and abortion.

Book excerpt: Islamic Thought in the Rise and Supremacy of Islamic Technological Culture: Water Resources and Energy, brings out the role of Islamic ideological culture in the birth, rise, and world supremacy of Islamic technological culture during the First to Eighth AH (Seventh to Fourteenth AD) centuries. Examples are given from the history of water resources and energy. Islamic ideology refers to implications for the two cultures of the Quranic concept of God and prophethood; the Kitab al-Kharaj books on the Traditions of Prophet Muhammad; Islamic law, esp. land tenure and environmental laws; economics; politics and administration; etc. The primary beneficiaries of these Islamic cultures during the early centuries, when Muslims were a minority in the Islamic world-states, were the non-Muslim majorities; the latter, therefore, embraced Islam first gradually and later on rapidly. The book presents the way to revive the Islamic ideological and technological cultures through a critique of the two main causes for the decline and continued backwardness of Muslim cultures: Sufism; and takhsis, i.e., reduction, limitation, restriction of Islamic law to only family laws; Islam to rituals and superficial aspects of the five pillars ; exclusion of Islamic science, technology, economics, etc. from Islamic epistemology and education; and other manifestations of takhsis.

Available in PDF, EPUB and Kindle. Book excerpt: Recent events have focused attention on the perceived differences and tensions between the Muslim world and the modern West. As a major strand of Western public discourse has it, Islam appears resistant to internal development and remains inherently pre-modern. However Muslim societies have experienced most of the same structural changes that have impacted upon all societies: massive urbanisation, mass education, dramatically increased communication, the emergence of new types of institutions and associations, some measure of political mobilisation, and major transformations of the economy. These developments are accompanied by a wide range of social movements and by complex and varied religious and ideological debates. This textbook is a pioneering study providing an introduction to and overview of the debates and questions that have emerged regarding Islam and modernity. Key issues are selected to give readers an understanding of the complexity of the phenomenon from a variety of disciplinary perspectives. The various manifestations of modernity in Muslim life discussed include social change and the transformation of political and religious institutions, gender politics, changing legal regimes, devotional practices and forms of religious association, shifts in religious authority, and modern developments in Muslim religious thought.

Book excerpt: “In a clear and historically incisive argument, Kamrava and the other contributors indicate how the Islamic concept of innovation (Arabic, bid ‘a) is an essentially contested and adaptive concept. Since the time of the Prophet Muhammad, Muslims have vigorously argued about its meaning and how to apply it. This incisive collection of essays range far beyond the confines of theology and jurisprudence, integrating ideological concerns with the exigencies of mundane ones, as well as crossing the sectarian divide of Sunni and Shia.” —Dale Eickelman, author of Muslim Politics "The economic and political underdevelopment of the Islamic world is commonly attributed to conservatism rooted in Islam. This splendid collection of provocative essays addresses the issue from several different perspectives and in various contexts. Collectively, the essays provide a broad introduction to the topic of innovation in Islam, both through what they teach and what they invite the reader to pursue." —Timur Kuran, author of The Long Divergence: How Islamic Law Held Back the Middle East “Muhammad brought new ideas and practices to the monotheistic tradition, but Muslim scholars interpreting the Qur’an and ahadith sought to squelch ideas that smacked of innovation. Such is the conventional wisdom. But Mehran Kamrava leads a stable of distinguished scholars in demonstrating persuasively that innovation has never ceased to mark the Islamic tradition. Indeed, the greatest modern innovators may be those Islamists who denounce innovation! These powerful essays overwhelm the conventional wisdom.” —Robert D. Lee, author of Religion and Politics in the Middle East: Identity, Ideology, Institutions, and Attitudes
