In many regions across the United States, there are programs that support and enable people with disabilities and older adults to live where they choose and with whom they choose and to participate fully in their communities. Tremendous progress has been made. However, in many cases, the programs themselves â€" and access to them â€" vary not only between states but also within states. Many programs are small, and even when they prove to be successful they are still not scaled up to meet the needs of the many people who would benefit from them. The challenges can include insufficient workforce, insufficient funding, and lack of evidence demonstrating effectiveness or value. To get a better understanding of the policies needed to maximize independence and support community living and of the research needed to support implementation of those policies, the National Academies of Sciences, Engineering, and Medicine convened a public workshop in October 2015. Participants explored policies in place that promote independence and community living for older adults and people with physical disabilities, and identified policies and gaps in policies that can be barriers to independence and the research needed to support changing those policies. This report summarizes the presentations and discussions from the workshop.

Book excerpt: This volume explores the varied outcomes that self-determination movements around the world have achieved, and in particular seeks to understand what factors promote better outcomes and what factors promote worse ones. Rather than focusing on the metric of achieving independence, the project evaluates the quality of societies after independence, including such elements as economic strength and political resilience, and it analyzes what factors contribute to different outcomes. The study finds that the single most determinative factor in the success of any independence movement is frequently beyond the control of such a movement, often relating to the global and historical contexts in which the movement finds itself. However, a whole host of factors are within the control of such a movement, but movements do not always seek to act on many of them. Activists become so convinced in the justness of the independence cause that they do not focus on actions that would contribute to greater success after independence.

Book excerpt: The "Critical Period" of American history—the years between the end of the American Revolution in 1783 and the ratification of the U.S. Constitution in 1789—was either the best of times or the worst of times. While some historians have celebrated the achievement of the Constitutional Convention, which, according to them, saved the Revolution, others have bemoaned that the Constitution’s framers destroyed the liberating tendencies of the Revolution, betrayed debtors, made a bargain with slavery, and handed the country over to the wealthy. This era—what John Fiske introduced in 1880 as America’s "Critical Period"—has rarely been separated from the U.S. Constitution and is therefore long overdue for a reevaluation on its own terms. How did the pre-Constitution, postindependence United States work? The fear that promising prospective scientists will choose other career paths has raised concerns about the future of biomedical research in the United States. At the request of NIH, the National Academies conducted a study on ways to address these issues. The report recommends that NIH make fostering independence of biomedical researchers an agencywide goal, and that it take steps to provide postdocs and early-career investigators with more financial support for their own research, improve postdoc mentoring and establish programs for new investigators and staff scientists among other mechanisms.

Book excerpt: This book investigates the causes and consequences of congressional attacks on the US Supreme Court, arguing that the extent of public support for judicial independence constitutes the practical limit of judicial independence. First, the book presents a historical overview of Court-curbing proposals in Congress. Then, building on interviews with Supreme Court justices, members of Congress, and judicial and legislative staffers, the book theorizes that congressional attacks are driven by public discontent with the Court. From this theoretical model, predictions are derived about the decision to engage in Court-curbing and judicial responsiveness to Court-curbing activity in Congress. The Limits of Judicial Independence draws on illustrative archival evidence, systematic analysis of an original dataset of Court-curbing proposals introduced in Congress from 1877 onward and judicial decisions.
