Book excerpt: The "Critical Period" of American history—the years between the end of the American Revolution in 1783 and the ratification of the U.S. Constitution in 1789—was either the best of times or the worst of times. While some historians have celebrated the achievement of the Constitutional Convention, which, according to them, saved the Revolution, others have bemoaned that the Constitution’s framers destroyed the liberating tendencies of the Revolution, betrayed debtors, made a bargain with slavery, and handed the country over to the wealthy. This era—what John Fiske introduced in 1880 as America’s "Critical Period"—has rarely been separated from the U.S. Constitution and is therefore long overdue for a reevaluation on its own terms. How did the pre-Constitution, postindependence United States work? What were the possibilities, the tremendous opportunities for "future welfare or misery for mankind," in Fiske’s words, that were up for grabs in those years? The scholars in this volume pursue these questions in earnest, highlighting how the pivotal decade of the 1780s was critical or not, and for whom, in the newly independent United States. As the United States is experiencing another, ongoing crisis of governance, reexamining the various ways in which elites and common Americans alike imagined and constructed their new nation offers fresh insights into matters—from national identity and the place of slavery in a republic, to international commerce, to the very meaning of democracy—whose legacies reverberated through the nineteenth and twentieth centuries and into the present day. This book was released on 2012-10-22 with total page 367 pages. Available in PDF, EPUB and Kindle. Book excerpt: Here in a newly annotated edition are the two founding documents of the United States of America: the Declaration of Independence (1776), our great revolutionary manifesto, and the Constitution (1787Ð88), in which ÒWe the PeopleÓ forged a new nation and built the framework for our federal republic. Together with the Bill of Rights and the Civil War amendments, these documents constitute what James Madison called our Òpolitical scripturesÓ and have come to define us as a people. Now a Pulitzer PrizeÐwinning historian serves as a guide to these texts, providing historical contexts and offering interpretive commentary. In an introductory essay written for the general reader, Jack N. Rakove provides a narrative political account of how these documents came to be written. In his commentary on the Declaration of Independence, Rakove sets the historical context for a fuller appreciation of the important preamble and the list of charges leveled against the Crown. When he glosses the Constitution, the Bill of Rights, and the subsequent amendments, Rakove once again provides helpful historical background, targets language that has proven particularly difficult or controversial, and cites leading Supreme Court cases. A chronology of events provides a framework for understanding the road to Philadelphia. The general reader will not find a better, more helpful guide to our founding documents than Jack N. Rakove.

Book excerpt: The Framers of the American Constitution took special pains to ensure that the governing principles of the republic were insulated from the reach of simple majorities. Only super-majoritarian amendments could modify these fundamental constitutional dictates. The Framers established a judicial branch shielded from direct majoritarian political accountability to protect and enforce these constitutional limits. Paradoxically, only a counter-majoritarian judicial branch could ensure the continued vitality of our representational form of government. This important lesson of the paradox of American democracy has been challenged and often ignored by office holders and legal scholars. Judicial Independence and the American Constitution provocatively defends the centrality of these special protections of judicial independence. Martin H. Redish explains how the nation's system of counter-majoritarian constitutionalism cannot survive absent the vesting of final powers of constitutional interpretation and enforcement in the one branch of government expressly protected by the Constitution from direct political accountability: the judicial branch. He uncovers how the current framework of American constitutional law has been unwisely allowed to threaten or undermine these core precepts of judicial independence.

Taken together, these documents represent the liberating principles that America seeks to conserve for itself and proclaim to the world. If we are to restore and preserve America's principles, the truths to which we are dedicated and the common ideas that constitute us as a people, we must first rediscover them, writes Matthew Spalding, director of the B. Kenneth Simon Center for American Studies at The Heritage Foundation. And that demands that we rediscover the Declaration of Independence and the Constitution.

Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.

Why are they so crucial to human life? How do you protect them? These are some of the questions that A Declaration and Constitution for a Free Society answers. The book uses Objectivist philosophy—the philosophy of Ayn Rand—to analyze subjective, intrinsic, and objective theories of rights and show why rights and freedom are objective necessities of human life. This knowledge is then used to make changes to the Declaration of Independence and U.S. Constitution. Through these changes, the book shows the fundamental legal requirements of a free society and why we should create such a society. It demonstrates why a free society is morally, politically, and economically beneficial to human beings.
