Book excerpt: The book concerns the study and analysis of the UN Committee on Economic, Social and Cultural Rights from an international legal perspective, taking into consideration the adoption of the 2008 Optional Protocol to the International Covenant on Economic, Social and Cultural Rights (ICESCR). The volume provides a detailed account of the structure and functioning of the Committee on Economic, Social and Cultural Rights in the light of its jurisprudence, through a study of the Committee’s procedures and practices (periodic reports and general comments), including taking into account the Optional Protocol for individual complaint procedure. The book considers the possible implications of the work of this Committee on other UN Committees, such as the Human Rights Committee and the UN Committee on the Rights of the Child, as well as considering the repercussions of its work on the international protection of fundamental rights, such as the right to education, to health and adequate food. The UN Committee on Economic, Social and Cultural Rights will be of particular interest to academics and students of International and Human Rights law.

Book Synopsis Women, Islam and International Law by : Ekaterina Yahyaoui Krivenko
Download or read book Women, Islam and International Law written by Ekaterina Yahyaoui Krivenko and published by BRILL. This book was released on 2009 with total page 281 pages. Available in PDF, EPUB and Kindle. Book excerpt: Islam and womena (TM)s human rights entertain an uneasy relationship. Much has been written on the subject. This volume addresses it from a new perspective. It attempts to define some basis for constructive dialogue and interaction in the context of international law and, more precisely, in the context of participation of many Muslim States in the United Nations Convention on the Elimination of All Forms of Discrimination Against Women. Having discovered a constructive potential in both Islam and womena (TM)s human rights, the author concentrates on the role which international law should play in promoting dialogue and constructive interaction. This is done mainly through analysis of the regime of reservations and of the practice of reservations developed in the context of Muslim Statesa (TM) participation in the CEDAW. The basic thesis defended is the following: Islam as articulated in the practice of States and womena (TM)s human rights, as reflected in international instruments, are both results of human activity. Their analysis in this study reveals more commonalities than one might expect. International law should be more attentive to their voices and more innovative in using these commonalities in order to promote constructive dialogue between them and thus help to improve the situation of women suffering from discrimination and inequalities.

Book Synopsis Human Rights, the UN and the Baháʼís in Iran by : Nazila Ghanea-Hercock
Download or read book Human Rights, the UN and the Baháʼís in Iran written by Nazila Ghanea-Hercock and published by Martinus Nijhoff Publishers. This book was released on 2002 with total page 648 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first comprehensive assessment of the contribution of the United Nations to the human rights situation of the Bahá ís in Iran. It does this by examining the theoretical, legal, institutional and political dimensions of this issue in detail. The situation of the Bahá í community in Iran between 1979 and 2002 provides a particularly good test case for the international community due to its clarity. By giving attention to a singular case within a discrete time frame, this book is able to effectively examine the impact of UN human rights protection. Attention is given in this study to the clash between religion and human rights, the protection of freedom of religion or belief in international law, the workings of UN human rights charter-based and treaty bodies and their various mechanisms, and recommendations for the resolution of the Bahá í human rights situation in Iran.

Book Synopsis Keeping Hold of Justice by : Jennifer Balint
Download or read book Keeping Hold of Justice written by Jennifer Balint and published by University of Michigan Press. This book was released on 2020-02-19 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: Keeping Hold of Justice focuses on a select range of encounters between law and colonialism from the early nineteenth century to the present. It emphasizes the nature of colonialism as a distinctively structural injustice, one which becomes entrenched in the social, political, legal, and discursive structures of societies and thereby continues to affect people’s lives in the present. It charts, in particular, the role of law in both enabling and sustaining colonial injustice and in recognizing and redressing it. In so doing, the book seeks to demonstrate the possibilities for structural justice that still exist despite the enduring legacies and harms of colonialism. It puts forward that these possibilities can be found through collaborative methodologies and practices, such as those informing this book, that actively bring together different disciplines, peoples, temporalities, laws and ways of knowing. They reveal law not only as a source of colonial harm but also as a potential means of keeping hold of justice.
Book Synopsis Peacebuilding in the United Nations by : Fernando Cavalcante
Download or read book Peacebuilding in the United Nations written by Fernando Cavalcante and published by Springer. This book was released on 2019-05-06 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book traces the trajectory and different meanings of the concept of peacebuilding in the United Nations since the early 1990s. It analyses how that concept gained life in a particular context and the implications of this process for the Organisation’s support to societies affected by armed conflict in general and for peace operations in particular. Departing from tenets about the influence of ideas in world politics and engaging with the critique of the liberal peace scholarship, the book provides a theoretically informed narrative of how peacebuilding acquired different meanings while remaining largely motivated, justified, legitimated and informed by a proactive and top-down agenda of promoting liberal democratic institutions, norms and values as a remedy to the challenges faced by societies affected by armed conflict. The book will appeal to scholars, policymakers and practitioners in peacebuilding and post-conflict development.
Book Synopsis A History of the 1957 Federation of Malaya Constitution by : Joseph M. Fernando
Download or read book A History of the 1957 Federation of Malaya Constitution written by Joseph M. Fernando and published by Taylor & Francis. This book was released on 2024-12-09 with total page 181 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fernando examines important aspects of the drafting of 1957 Federation of Malaya constitution related to the system of governance, division of legislative and executive powers, the conceptualisation of citizenship and the roles of the judiciary and election commission. The book sheds new light on the balances that the Reid Commission sought to embed in the constitution and the historical constitutional debates and discussions which greatly shaped the framing of the new federal constitution between 1956 and 1957. Drawing on historical evidence mainly from declassified primary constitutional documents, it analyses the submissions, debates and discussions among the framers and various interest groups during the drafting of the constitution between 1956 and 1957 to discern more clearly the intentions of the framers on many aspects of governance and distribution of powers embedded in the constitutional provisions. This book reveals more deeply the nature and complexity of the constitutional issues faced by the framers and how they attempted to reach compromises between the various interest groups in Malaya. It is a valuable resource for scholars and academics of Malaysian, Asian and Commonwealth constitutional history as well as those interested in history, law, political science and important aspects of governance and distribution of powers in the system of parliamentary democracy.
