Available in PDF, EPUB and Kindle. Book excerpt: Seminar paper from the year 2012 in the subject Law - Miscellaneous, grade: 1,7, Carl von Ossietzky University of Oldenburg (Rechtswissenschaften), course: Advanced Lectures in EU Economic Law, language: English, abstract: The Council of Europe Commissioner for Human Rights, Thomas Hammarberg, said in his speech on 8th March 2011 "Every day women in Europe experience one of the most deep-rooted injustices - being paid less than a man for work of equal value." Equality between women and men is one of the objectives of the European Union. With the aid of legislation, case law and amendments to the contracts it had gradually succeeded to give emphasis to this principle and apply it in the EU. This work will now try to show you this development. In the beginning, there will be a description of legal framework in the EU. This framework essentially bases on Article 157 TFEU and the Directive 2006/54. Afterwards follows the development of case studies by the jurisprudence of the ECJ in more detail. Keep on with the content of Article 157 TFEU with a closer look on the questions: What is pay? What is equal pay for equal work or work of equal value? When exists discrimination? What is the difference between direct and indirect discrimination? "Well come forward, but still long way to go": So the initial assessment of the agreement is to promote equal opportunities between women and men in the private sector. Is it right and more: is it enough? Let's see if this question can be answered at the end of this work.

This book was released on 2013 with total page 38 pages. Available in PDF, EPUB and Kindle. Book excerpt: Women across the European Union bring home 16.2% less than their male counterparts in the EU. This figure is more than just a statistic: it has real-life consequences for the women concerned, for their families and for society at large. The European Parliament firmly believes that reducing the pay gap remains a political priority. It is not only about economic empowerment, it is also a matter of social justice. This EU Added Value Assessment supports the European Parliament's view and takes the view that reducing the gender pay gap, in particular by revising Directive 2006/54/EC, could be very beneficial, not only for individuals but also for society in general. It would help achieve inclusive growth and ensure economic and social cohesion and competitiveness, in line with the objectives set in the Europe 2020 Strategy.

Download or read book Compliance and Compromise written by Cher Weixia Chen and published by BRILL. This book was released on 2011-09-20 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: As domestic industrial relations and labor conditions have been seriously challenged by globalization, various international labor standards have been proposed to safeguard and promote labor rights. However, an important question remains: are these rules and standards enforceable and well enforced? Compliance and Compromise: The Jurisprudence of Gender Pay Equity examines the status of one of the core international labor standards—gender pay equity—that has been largely overlooked, and explores how domestic legislative and judicial systems respond to the core International Labor Organization Convention No. 100 on Equal Remuneration. It unravels under what circumstance legislative and judicial compliance occurs, with the novel application of the relatively new theory “transnational legal process” to explicate the phenomenon of “compliance”.
Book Synopsis Gender Equality in Employment and Occupation Directive 2006 by :
Download or read book Gender Equality in Employment and Occupation Directive 2006 written by and published by . This book was released on 2015 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: The principle of equal pay is anchored in the EEC founding Treaty of 1957. Directive 2006/54/EC of the European Parliament and of the Council was a recast of secondary law dating back to 1975, pursuing gender equality in (access to) employment and 'consolidating' case law in this area developed by the European Court of Justice. Did this 'Recast Directive' have the envisaged effects? Or is further legislative action necessary? This European Implementation Assessment, based on research from four independent groups of experts, analyses different aspects of the application of the Recast Directive, and concludes that there is a very strong case for immediate and vigorous actions at EU level, going beyond voluntary measures, in line with EP resolutions.

Available in PDF, EPUB and Kindle. Book excerpt: Women, Business and the Law 2021 is the seventh in a series of annual studies measuring the laws and regulations that affect women’s economic opportunity in 190 economies. The project presents eight indicators structured around women’s interactions with the law as they move through their lives and careers: Mobility, Workplace, Pay, Marriage, Parenthood, Entrepreneurship, Assets, and Pension. This year’s report updates all indicators as of October 1, 2020 and builds evidence of the links between legal gender equality and women’s economic inclusion. By examining the economic decisions women make throughout their working lives, as well as the pace of reform over the past 50 years, Women, Business and the Law 2021 makes an important contribution to research and policy discussions about the state of women’s economic empowerment. Prepared during a global pandemic that threatens progress toward gender equality, this edition also includes important findings on government responses to COVID-19 and pilot research related to childcare and women’s access to justice.
Download or read book Voice and Agency written by Jeni Klugman and published by World Bank Publications. This book was released on 2014-09-29 with total page 239 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite recent advances in important aspects of the lives of girls and women, pervasive challenges remain. These challenges reflect widespread deprivations and constraints and include epidemic levels of gender-based violence and discriminatory laws and norms that prevent women from owning property, being educated, and making meaningful decisions about their own lives--such as whether and when to marry or have children. These often violate their most basic rights and are magnified and multiplied by poverty and lack of education. This groundbreaking book distills vast data and hundreds of studies to shed new light on deprivations and constraints facing the voice and agency of women and girls worldwide, and on the associated costs for individuals, families, communities, and global development. The volume presents major new findings about the patterns of constraints and overlapping deprivations and focuses on several areas key to women s empowerment: freedom from violence, sexual and reproductive health and rights, ownership of land and housing, and voice and collective action. It highlights promising reforms and interventions from around the world and lays out an urgent agenda for governments, civil society, development agencies, and other stakeholders, including a call for greater investment in data and knowledge to benchmark progress.
Book Synopsis The EU Charter of Fundamental Rights by : Steve Peers
Download or read book The EU Charter of Fundamental Rights written by Steve Peers and published by Bloomsbury Publishing. This book was released on 2014-12-01 with total page 1938 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Charter of Fundamental Rights of the European Union enshrines the key political, social and economic rights of EU citizens and residents in EU law. In its present form it was approved in 2000 by the European Parliament, the Council of Ministers and the European Commission. However its legal status remained uncertain until the entry into force of the Treaty of Lisbon in December 2009. The Charter obliges the EU to act and legislate consistently with the Charter, and enables the EU's courts to strike down EU legislation which contravenes it. The Charter applies to EU Member States when they are implementing EU law but does not extend the competences of the EU beyond the competences given to it in the treaties. This Commentary on the Charter, the first in English, written by experts from several EU Member States, provides an authoritative but succinct statement of how the Charter impacts upon EU, domestic and international law. Following the conventional article-by-article approach, each commentator offers an expert view of how each article is either already being interpreted in the courts, or is likely to be interpreted. Each commentary is referenced to the case law and is augmented with extensive references to further reading. Six cross-cutting introductory chapters explain the Charter's institutional anchorage, its relationship to the Fundamental Rights Agency, its interaction with other parts of international human rights law, the enforcement mechanisms, extraterritorial scope, and the all-important 'Explanations'.

Download or read book Violence Against Women written by and published by . This book was released on 2014 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Violence against women undermines women's core fundamental rights such as dignity, access to justice and gender equality. For example, one in three women has experienced physical and/or sexual violence since the age of 15; one in five women has experienced stalking; every second woman has been confronted with one or more forms of sexual harassment. What emerges is a picture of extensive abuse that affects many women's lives but is systematically underreported to the authorities. The scale of violence against women is therefore not reflected by official data. This FRA survey is the first of its kind on violence against women across the 28 Member States of the European Union (EU). It is based on interviews with 42,000 women across the EU, who were asked about their experiences of physical, sexual and psychological violence, including incidents of intimate partner violence ('domestic violence'). The survey also included questions on stalking, sexual harassment, and the role played by new technologies in women's experiences of abuse. In addition, it asked about their experiences of violence in childhood. Based on the detailed findings, FRA suggests courses of action in different areas that are touched by violence against women and go beyond the narrow confines of criminal law, ranging from employment and health to the medium of new technologies."--Editor.
