Book excerpt: In light of the concerns that have been raised about the lack of transparency of credit card charges in the UK, particularly in relation to interest rates charged for store card credit, this matter was referred by the Office of Fair Trading to the Competition Commission in March 2004. The Commission's inquiry focuses on two key aspects: store card credit services to retailers and related insurance services; and consumer credit through store cards and related insurance services. These cards offer a method of payment and credit option which are retailer-specific, and are mostly operated by department stores and clothing retailers. The investigation is based on data relating to the period from 1999 to 2003 (supplemented by relevant information for 2004 and projections for 2005 and 2006) and focuses on the functioning of the market as a whole rather than on the conduct of individual companies. Issues examined include: relevant economic markets and the wider regulatory framework; proposals to reform the legislation governing the credit market and statutory issues; factors that prevent, restrict or distort competition; detrimental effects on customers; and options for remedial action. The report finds that the interest rates charged on store cards are too high (generally annual percentage rates (APRs) of between 10 to 20 per cent above required levels), resulting in an estimated cost for consumers of at least £55 million a year and possibly significantly more. A number of remedies are identified that store card credit providers should make, including warning cardholders on monthly statements that cheaper credit may be available elsewhere; providing more and clearer information on all monthly statements; offering an option to pay by direct debit; and offering payment protection insurance separately from other elements of store card insurance.

Book excerpt: The Commission's report examines the market for personal current account (PCA) banking services in Northern Ireland, following on from a supercomplaint made by Which? and by General Consumer Council for Northern Ireland under the Enterprise Act 2002. This provisional report finds that banks have unduly complex charging structures and practices which are not sufficiently explained, and customers generally do not actively search for alternative PCAs or switch provider. It concludes that, despite significant changes in recent years, without effective remedial action the market as a whole will remain uncompetitive.

Based on the premise that open and fair competition is good for both consumers and businesses, competition law prevents businesses from entering into anti-competitive agreements and from abusing their dominant market position. Competition Law and Policy in the EC and UK looks at how competition law affects business, including: co-ordinated actions; pricing behaviour; take-overs and mergers; and state subsidies. It provides a clear guide to and outline of the general policies behind, and the main provisions of EC and UK competition law. Information is presented within a structured framework, complete with a glossary of useful terminology. This fourth edition has been revised and updated to take into account developments since publication of the previous edition, including expanded coverage of the regulation of cartels, the development of private enforcement, the consideration of IP issues in Microsoft, and extended discussion of UK competition Law.

Available in PDF, EPUB and Kindle. Book excerpt: Antitrust and competition law is a fast moving area of law and the subject of extensive academic research. The aim of this volume is to select articles as tools for understanding how antitrust and competition law is applied to unilateral conduct which is harmful to the consumer and to the competitiveness of the market. The articles examine the meaning of dominance and monopolisation and show that although legal and economic rules have been developed to establish whether undertakings hold such strong market positions, it is often difficult to determine with certainty that the undertaking being investigated meets the threshold. The various debates on pricing and non-pricing conduct are also represented as are the conflicts that have arisen regarding the exercise of intellectual property rights by powerful undertakings, particularly in the context of the new economies. The volume includes scholarly articles published on both sides of the Atlantic and enables a greater understanding of the application of antitrust and competition law from the point of view of economics and politics.

Available in PDF, EPUB and Kindle. Book excerpt: After a long period of prosperity and steady economic growth, the world's leading economies are now in crisis, and although there will be debate about its origins, the scale and seriousness of the crisis is in no doubt. There is also no doubt that excessive amounts of consumer credit, allied to a weak understanding of how globalised credit markets might react to a crisis, have played a significant part. This book, which is primarily about credit, debt and the trouble they have led to, is written by authors who have specialised in researching into over-indebtedness, that is, situations in which an individual's debt burden has become overwhelming. For these authors the plight of individuals is a primary concern, but the wider issue is how credit is used and how it changes societies. The essays in this volume, addressing topics which are fundamental to our understanding of the current crisis, range widely across the whole sector of consumer finance, including mortgages, 'credit-binges', the regulation of consumer lending, insolvency, repayment plans, debt counselling and much more besides. The conclusions drawn from the book are equally wide-ranging, but above all the lesson learned from these essays is that the financialisation of contemporary life ensures that issues of the appropriate role of credit remain of critical importance in society.

Book excerpt: The Committee's report examines the work of the Office of Fair Trading (OFT) as part of a programme of short inquiries into the non-departmental public bodies associated with the Department of Business, Enterprise and Regulatory Reform (formerly the DTI). A NAO report (HCP 593, session 2005-06; ISBN 0102936161) published in November 2005 highlighted three key areas of concern about the OFT and its approach to its work, focusing on making best use of its resources; improving the management of investigations; and improving the measurement of its achievements and the communication of its work. The Committee commends the OFT for its positive response to address these concerns, and although it is too soon to make a balanced assessment of the results, they are encouraged by the evidence of progress so far. The report also examines issues relating to staffing constraints, the merger referral threshold, the OFT's role in voluntary industry codes of practice, and the OFT's Consumer Direct telephone service.

Book excerpt: This is the eleventh in the series on EU Competition Law and Policy produced by the Robert Schuman Centre of the European University Institute in Florence. The volume reproduces the materials of the roundtable debate which examined the enforcement of the prohibition on cartels. The workshop participants - senior representatives of the Commission and the national competition authorities of some EC Member States, renowned international academics and legal practitioners - discussed the economic and legal issues that arise in this particular area, including: 1) unearthing cartels: the evidence; 2) the institutional framework and 3) tools of enforcement.
