Book excerpt: The Committee's report examines the work of the Office of Fair Trading (OFT) as part of a programme of short inquiries into the non-departmental public bodies associated with the Department of Business, Enterprise and Regulatory Reform (formerly the DTI). A NAO report (HCP 593, session 2005-06; ISBN 0102936161) published in November 2005 highlighted three key areas of concern about the OFT and its approach to its work, focusing on making best use of its resources; improving the management of investigations; and improving the measurement of its achievements and the communication of its work. The Committee commends the OFT for its positive response to address these concerns, and although it is too soon to make a balanced assessment of the results, they are encouraged by the evidence of progress so far. The report also examines issues relating to staffing constraints, the merger referral threshold, the OFT's role in voluntary industry codes of practice, and the OFT's Consumer Direct telephone service.

Book excerpt: The Office of Fair Trading (OFT) has improved its operations following recommendations on maintaining competition in markets made by the National Audit Office and Committee of Public Accounts in 2005 and 2006. It now needs to concentrate its efforts on strengthening the skills and experience of its staff at key management grades, and be clearer on how long it expects its investigations will take. The OFT is now directing its work to areas that have the most impact, though this refocus on higher priority cases has led to a perception that the OFT is less interested in smaller markets, with a risk that its deterrent effect will be reduced in these markets. The OFT has taken steps to address this perception, launching investigations into more local markets such as in construction and bus transport. The time taken to process high profile cases has been reduced by introducing better project management and more flexible ways of working, including using bigger teams and temporary legal staff. The OFT has also brought criminal charges in two cartel cases for the first time under the Enterprise Act, one of which to date has resulted in criminal convictions. The OFT recognises that some of its cases are still taking too long. The OFT operates in a competitive labour market and still continues to face challenges in attracting and retaining talented staff. The OFT has provided project management and leadership training to its staff, but it needs to sustain and increase this work in order to continue to recruit and retain staff at key management grades.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the theories and practice of how to control corporate behaviour through legal techniques. The principal theories examined are deterrence, economic rational acting, responsive regulation, and the findings of behavioural psychology. Leading examples of the various approaches are given in order to illustrate the models: private enforcement of law through litigation in the USA, public enforcement of competition law by the European Commission, and the recent reform of policies on public enforcement of regulatory law in the United Kingdom. Noting that behavioural psychology has as yet had only limited application in legal and regulatory theory, the book then analyses various European regulatory structures where behavioural techniques can be seen or could be applied. Sectors examined include financial services, civil aviation, pharmaceuticals, and workplace health & safety. Key findings are that 'enforcement' has to focus on identifying the causes of non-compliance, so as to be able to support improved performance, rather than be based on fear motivating complete compliance. Systems in which reporting is essential for safety only function with a no-blame culture. The book concludes by proposing an holistic model for maximising compliance within large organisations, combining public regulatory and criminal controls with internal corporate systems and external influences by stakeholders, held together by a unified core of ethical principles. Hence, the book proposes a new theory of ethical regulation.

Available in PDF, EPUB and Kindle. Book excerpt: This critical account of the fair trade movement explores the vast gap between the rhetoric of fair trade and its practical results for poor countries, particularly those of Africa. In the Global North, fair trade often is described as a revolutionary tool for transforming the lives of millions across the globe. The growth in sales for fair trade products has been dramatic in recent years, but most of the benefit has accrued to the already wealthy merchandisers at the top of the value chain rather than to the poor producers at the bottom. Ndongo Sylla has worked for Fairtrade International and offers an insider’s view of how fair trade improves—or doesn’t—the lot of the world’s poorest. His methodological framework first describes the hypotheses on which the fair trade movement is grounded before going on to examine critically the claims made by its proponents. By distinguishing local impact from global impact, Sylla exposes the inequity built into the system and the resulting misallocation of the fair trade premium paid by consumers. The Fair Trade Scandal is an empirically based critique of both fair trade and traditional free trade; it is the more important for exploring the problems of both from the perspective of the peoples of the Global South, the ostensible beneficiaries of the fair trade system.

Looking at research from North America and Britain, the book explores the way fraudsters are treated. It draws on various disciplines including Economics, Law, Politics, and Sociology in order to show the frequency and impact of different types of fraud. In this book, Dr. Levi introduces the reader to the key areas of debate: What pressures influence the law on fraud? How do state agencies, self-regulatory bodies, or other professionals police fraud? To what extent are money-laundering and international organized crime breaking down the distinction between policing of the underworld and the upperworld? Dr. Levi concludes with an analysis of national and international policy trends in relation to fraud. This book will be of interests to students of criminology, politics, and the sociology of law as well as to practicing lawyers and other professionals in the business sector.

Book excerpt: As sales of fair-trade goods explode across the globe, Fair Trade and the Citizen-Consumer provides a timely analysis of the organizations, institutions and grassroots networks behind this growing movement. Drawing on examples from the UK, Sweden and USA, this book moves away from models of individualized consumer choice and instead explores the collective cultures and practices that motivate and sustain fair-trade consumer behaviour. Although the fair-trade citizen-consumer has been called to action and publicly represented as an individual 'voting' in the marketplace, this book reveals how market interventions are editing the choices available to consumers, at the same time as 'Fairtrade Town' consumer networks are flourishing. Offering new and critical insights into the fair-trade success story, this book also contributes to debates about sustainable consumption behaviour and the growth of 'new' forms of political participation and citizenship.

Book excerpt: The Ordnance Survey has existed for 216 years as a publicly funded and managed agency of government. It became a Trading Fund, then an Executive Agency in 1980s and 1990s, and is now overseen by the Department for Communities and Local Government. The Survey though ceased to be publicly funded in October 2006, and since that time is required to make a profit and so engage in commercial competition. This in turn raises the question of whether such a dominant organisation can operate fairly in the information market. A previous report (HCP 481, session 2001-02, ISBN 9780215003812), concluded that there needed to be defined boundaries between public service and national interest work. The Communities and Local Government Committee has set out 12 conclusions and recommendations, including: now that Ordnance Survey is self supporting, both funding its public task and commercial work entirely from its own revenues, the distinction between public duty and commercial interest is no longer clear; the Committee believes that the Surveys' annual report and accounts should distinguish between its public and private tasks; that the Survey needs to co-operate with the private sector in regard of licences that cover intellectual property rights, particularly if the licence is too stringent in its' requirements, such as requiring competitors not to compete with the Survey; greater clarity is needed on what use can be made of data bought from the Survey and that licensing conditions appear to be too complex and inflexible.

Available in PDF, EPUB and Kindle. Book excerpt: Competition policy is an integral and prominent part of economic policy-making in the European Union. The EU Treaty prescribes its member states to conduct economic policy ‘in accordance with the principle of an open market economy with free competition’. More precisely, the goal of EU competition policy is “to defend and develop effective competition in the common market” (European Commission, 2000: 7). Under its Commissioners van Miert, Monti and, most - cently, Kroes the EU Commission has stepped up its effort to pursue and achieve the aforementioned goal. A number of so-called hard-core cartels, such as the - torious “vitamin cartel” led by Roche, have been detected, tried in violation of Art. 81 of the Maastricht Accord and punished with severe fines. Also Microsoft was hit hard by the strong hand of the Commission having been severely fined for - ploiting a dominant market position. Economic analysis has been playing an increasingly significant role in the Commission’s examination of competition law cases. This holds true in particular for merger control. Here, however, the Commission has had to accept some poi- ant defeats in court, such as the Court’s reversals of Airtours-First Choice or GE- Honeywell. Among other things, the European Court of Justice found the e- nomic analysis as conducted by the EU’s Directorate General for Competition to be flawed and the conclusions drawn not to be convincing. These rejections by the courts have stirred up the scholarly debate on the conceptual foundations of Eu- pean competition policy.
