Book excerpt: As perennial famine and material shortages call into question the tenability of North Korea's military-authoritarian government, the international community has struggled to reconcile contradictory humanitarian, economic, and political goals in formulating foreign policy and aid responses to the secretive Pyongyang regime. In a historical analysis drawing heavily on primary sources, Lee attacks the problem at its root: the assumption of policy-makers that Pyongyang's belligerence and intractability is an attempt to secure autonomy and national legitimacy in the eyes of the world. Rather, Lee argues, close review of the available evidence demonstrates convincingly that forced reunification with South Korea is the only discernible goal of the Pyongyang government, and that the key strategy of the reunification program is a war of attrition against the U.S. military presence in the South. Lee begins with a summary history, and moves on to examine the formation of the North Korean communist state in the wake of World War II. The implementation of state programs in the 1950s and 1960s follows, including the drive towards industrialization, the emergence of the Juche ideology, and collectivization of agriculture. The 1982 United Nations Convention on the Law of the Sea and the Agreement relating to the implementation of Part XI of the Convention constitute essential instruments of the law of the sea governing a new maritime order for the international community. With its entry into force on November 16, 1994, the 1982 United Nations Convention on the Law of the Sea has virtually become the Magna Carta of the Oceans, or the Constitution for the Oceans. Testifying to its success is the number of Parties adhering to it, now totaling 132 States, including one international organization, the European Community. The world is entering the era of a New Maritime Order based on near-universal adherence to the United Nations Convention on the Law of the Sea. In the wake of the Convention's entry into force and its ratification by many States in Northeast Asia, a new maritime order is emerging in the region. The littoral States have enacted and promulgated new national legislation to incorporate the provisions of the UN Convention into their domestic legal order. The three littoral States China, Japan and South Korea concluded or initialed bilateral fisheries agreements based on the new concept of extended jurisdiction set forth by the UN Convention. The UN Convention will, however, present even more challenges than opportunities for the littoral States of Northeast Asia in their quest for a new maritime order. The maritime security situation in the region has been and will continue to be extremely volatile due to conflicting claims, disputed boundaries, unregulated pollution of the marine environment and widespread illegal activities at sea. The author has set the both pragmatic and ambitious aim of outlining the emerging maritime order in Northeast Asia. As a practitioner of the law of the sea who has participated in bilateral and multilateral negotiations on maritime affairs, the author sheds light on the new maritime order in the making at the international and regional levels. The author also delineates the main issues and disputes hindering the establishment of a new maritime order in the region and present policy options that could contribute to erecting a solid maritime order in the region by peaceful and cooperative means. Finally, the author presents a compilation of relevant legal texts, most of which were produced after the entry into force of the UN Convention, in the hope that this collection will prove useful for desk officers in charge of ocean affairs in promoting peaceful and constructive solutions for maritime issues in Northeast Asia. This work serves as a realistic analysis of the current law and State practice, as well as of the progressive development of the law of the sea and its codification in the wake of the entry into force of the 1982 UN Convention.

Book excerpt: A historical analysis of the policies and military strategies applied during the Korean War stalemate period Korean Showdown: National Policy and Military Strategy in a Limited War, 1951–1952 takes a holistic and integrative approach to strategy, operations, and tactics during the Korean War’s stalemate period and demonstrates how these matters shaped each other and influenced, or were influenced by, political and strategic policy decision-making. Bryan R. Gibby offers an analysis of the major political and military decisions affecting how the war was conducted operationally and diplomatically by examining American, Chinese, North Korean, and South Korean operations in the context of fighting a limited war with limited means, but for objectives that were not always limited in scope or ambition. The foundational political decision was Harry Truman’s voluntary repatriation policy, which extended the war by up to eighteen months. Its military counterpart was the American-led Operation Showdown, the last deliberate military offensive to coerce concessions at the negotiation table. Showdown’s failure (and the Communists’ own equally disappointing military efforts) opened up new avenues for solving the war short of a militarily imposed solution. Gibby’s research draws on primary sources from American, Korean, and Chinese archives and publications. Many of these sources have not yet been mined in diplomatic and military histories of the Korean War. This innovative book also addresses a significant gap in the study of Korean military operations—the linkage between ground and air pressure campaigns, as well as the many Chinese and American operations conducted to establish negotiation positions. Gibby also explores many political and propagandist developments that assumed great importance in the summer of 1952, such as prisoner of war riots, the bombing of hydroelectric dams, and the South Korean constitutional crisis, which significantly influenced American and Chinese military decision-making. Ultimately, this volume serves as a cautionary analysis of the limits of force, the necessity to understand an adversary, and the importance of strategic consensus. It also offers an effective case study on an underappreciated period of civil-military tension during the Cold War and on how civilian politicians and military leaders must collaborate to determine a realistic and effective strategy.
