Depuis la fin du XXe siècle, l'introduction de nouvelles méthodes de gestion, la formation de réseaux, l'apparition du phénomène des groupes de sociétés, l'informatisation des activités économiques et commerciales, la globalisation et la financiarisation de l'économie ont modifié les structures et la dynamique des entreprises. En conséquence, leur représentation en a été troublée. Certes, des efforts théoriques ont été entrepris pour en adapter l'image. Ainsi, il est aujourd'hui fréquemment fait allusion aux entreprises en réseaux dont les modes d'organisation sont beaucoup plus diffus et répondent aux exigences de flexibilité et d'adaptabilité des échanges commerciaux contemporains. Mais, avec l'apparition de l'entreprise-marchandise, la rupture épistémologique s'est encore accentuée. De plus en plus souvent, les entreprises sont aujourd'hui devenues des vecteurs destinés à générer des profits sur les marchés financiers. Le droit des sociétés va accompagner cette évolution et de profondes réformes vont faciliter la négociabilité fondée sur la liquidité de la marchandise " entreprise ". Face aux modifications qui ont affecté l'entreprise et qui ont rendu de plus en plus difficile son utilisation par le droit, des juristes, magistrats ou universitaires, un économiste et une sociologue de l'entreprise s'interrogent dans cet ouvrage sur la façon de surmonter la crise de l'entreprise et de sa représentation.
