This book was released on 2015-11-05 with total page 61 pages. Available in PDF, EPUB and Kindle. Book excerpt: The International Development Law Organization (IDLO) and the Center for International Forestry Research (CIFOR) assessed the legal frameworks that govern land-use activities and investments in Mozambique. Mozambique’s legal framework for environmental management is well developed, and recent legal reforms have strengthened key public interest safeguards. Similarly, the country has established a comprehensive framework for investment through the Investment Law and Investment Promotion Centre (CPI), and enshrined in the Land Law the right to the use and benefit of land (DUAT). The Environmental Impact Assessment (EIA) process places public consultation at the heart of effective environmental management. It extends participation to a broad spectrum of stakeholders at an early stage, allowing, in theory, substantial influence over the design and implementation of the EIA process. The National Council for Sustainable Development (CONDES) and the Ministry for Environmental Coordination (MICOA) have not managed, however, to influence high level government policy decisions and push convincingly for a sustainable development agenda.

Book excerpt: This publication offers an overview of REDD+ strategy in Mozambique through a synthesis of the current knowledge about the causes of forest carbon changes, a review of the legal and institutional context, and a description of the current political process of REDD+. The objective of the study is to collate data and relevant information, and to offer a preliminary analysis of the fundamental aspects that can help promote efficiency, efficacy, and equity in REDD+ policy. Specifically, this study concludes that some of the major problems for REDD+ in Mozambique are the lack of data about deforestation and forest degradation, institutional weakness (regarding monitoring and propriety rights), and gaps in human and technical capacity to fulfil demands associated with REDD+. Therefore, efficient results will depend on the degree to which REDD+ policies are oriented toward real mitigation of the sources of forest carbon changes. In Mozambique, REDD+ policy tends to originate outside the timber sector. The cost-effectiveness of the results will depend on identifying and addressing the fundamental causes of forest carbon changes through more viable REDD+ policy options; government capacity to respond to REDD+ demands, especially at the sub-national level; the capacity of civil society and other institutions; and the strength of the institutional framework. The degree of success of equitable outcomes and the generation of co-benefits will depend on the inclusion and appropriateness of the processes at the national level; if those who support REDD+ costs are also being compensated; and on the general definition of carbon rights and environmental services.

This book was released on 2015-10-27 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: The International Development Law Organization (IDLO) and the Center for International Forestry Research (CIFOR) assessed the legal frameworks for major natural resource sectors in Zambia, Tanzania and Mozambique to analyze whether, and to what extent they enable sustainable investments. National development plans in each country, and their crosscutting laws on land and the environment incorporate principles of sustainable development. However, sector-specific laws governing forestry, agriculture, mining and energy reflect these principles to varying degrees. Relying significantly on natural resources, these countries have witnessed consistent GDP growth in recent years. Despite their resource wealth and increased investments, poverty and resource degradation persist. Rural populations remain disproportionately affected, with limited access to basic services and increased vulnerability to the impacts of deforestation and climate change. This Synthesis report outlines four key insights on issues identified by the legal assessments that can either hinder or enable sustainable land use investments. These consist of: Reframing investment incentives and focusing on smallholder interests;Protecting customary land rights and ensuring consultation and consent:Establishing clear and effective regulations, strengthening enforcement capacity and supporting decentralization andRaising awareness, guaranteeing participation and promoting freedom of information. The report demonstrates that landscapes governance embodying the rule of law and adherence to social and environmental safeguards can create enabling conditions for sustainable investments. Equity, responsive legal and policy reforms, improved enforcement capacity, strengthened participatory mechanisms and other rule of law considerations are critical to planning and managing investments so that they contribute to sustainable development.

Book excerpt: Ambitious in nature, the Istanbul Programme of Action (IPoA) for the Least Developed Countries (LDCs) adopted by the Fourth United Nations Conference on the LDCs (UN LDC IV) in 2011, sets out a development path for LDCs for the coming decade. Successful implementation of the IPoA requires identification of delivery tools for specific targets, provision of necessary financial and non-financial resources, and a strengthened monitoring mechanism. LDC IV Monitor, an independent partnership of eight interested organisations, aims to add value by enhancing transparency, accountability and efficiency of the official monitoring and review mechanism of the IPoA. LDC IV Monitor’s first set of two reports, produced outside of the official intergovernmental process, provide credible, evidence-based and policy-oriented assessment of the delivery status of the promises contained in the IPoA. The Synthesis Report, derived from the critical analyses of the state of play concerning the IPoA, presents the broad messages and key recommendations. The volume on Analytical Perspectives addresses a wide spectrum of issues including articulation of a composite IPoA index, building of productive capacity, trade in goods and services, delivery of the Millennium Development Goals (MDGs), flows of different forms of development finance, and consequences of climate change. The publications seek to contribute towards crafting national and international policies to support graduation of the LDCs through structural transformation of their economies.
