Book excerpt: Las fallas de la respuesta del Estado eran tan acusadas que en 1998 la Comisión Nacional de Derechos Humanos de México emitió una recomendación referente a la insuficiencia de la respuesta oficial frente a los asesinatos y exigió la aclaración de los crímenes y el procesamiento de sus perpetradores, así como las imposición de sanciones a los funcionarios incursos en omisión de cumplir sus obligaci. [...] Durante el 114o período ordinario de sesiones de la Comisión Interamericana, en marzo de 2002, la Relatora Especial Marta Altolaguirre informó al plenario de la Comisión los detalles de la visita y la información recogida y organizó una audiencia de seguimiento en la sede de la CIDH con representantes del Estado y de la sociedad civil mexicanos. [...] Las organizaciones dieron cuenta de la negligencia de las autoridades encargadas de investigar esos delitos y procesar a sus perpetradores, así como de la ineficacia global de la administración de justicia y la falta de voluntad política a todos los niveles de hacer frente al problema. [...] En el curso de la audiencia de marzo de 2002 realizada ante la CIDH, representantes de "Alto a la impunidad: ni una muerta más" informaron que los familiares de las víctimas cuyos presuntos cadáveres fueron encontrados los días 6 y 7 de noviembre de 2001 habían regresado al lugar el 25 de febrero de 2002, y encontraron ropas y otros objetos vinculados con algunas de las víctimas en la escena de lo. [...] En cuanto a la labor de otros sectores, esas modalidades de violencia contra la mujer requieren respuesta por tratarse de un problema de seguridad pública, en cuanto a la prevención de ese tipo de delitos, y por tratarse de una cuestión de salud pública en cuanto a la necesidad de medidas de prevención y prestación de servicios a las víctimas, y una cuestión social en cuanto a los efectos que reca.

Amnistía Internacional en sus estudios los catalogan como crímenes raciales y calificados de feminicidios. Los métodos de asesinatos y desapariciones practicados en Ciudad Juárez desde hace 10 años y en general en toda la República representa una prueba muy grave de violencia contra la mujer y violaciones sistemáticas de los derechos de la mujer fundadas en una cultura de violencia y discriminación basada en el género. Las violaciones a los derechos humanos cometidos por la población o por el mismo Estado deben tener consecuencias jurídicas internas e internacionales. La responsabilidad internacional es una relación jurídica muy importante que surge cuando un Estado comete actos u omisiones que violan las disposiciones internacionales México debe de responder por el hecho ilícito a través de una restitución desgraciadamente una vida no puede ser restituida. El Estado al no proteger ni otorgar los medios necesarios para detener los feminicidios y en general la violencia contra la mujer está violando los tratados internacionales que lo obligan a proteger y respetar los derechos humanos y por lo tanto también es responsable de permitir el quebrantamiento de uno de los pilares de los derechos de la humanidad: derecho a la vida, y como tal debe de reparar el daño moral causado a las familias de estas mujeres.
