In trying to account for this outburst, most western journalists, academics, and policymakers have resorted to the language of the premodern: tribalism, ethnic hatreds, cultural inadequacy, irrationality; in short, the Balkans as the antithesis of the modern west. Yet one of the most striking aspects of the wars in Yugoslavia is the extent to which the images purveyed in the western press and in much of the academic literature are so at odds with evidence from on the ground."—from The Myth of Ethnic War V. P. Gagnon Jr. believes that the Yugoslav wars of the 1990s were reactionary moves designed to thwart populations that were threatening the existing structures of political and economic power. He begins with facts at odds with the essentialist view of ethnic identity, such as high intermarriage rates and the very high percentage of draft-resisters. These statistics do not comport comfortably with the notion that these wars were the result of ancient blood hatreds or of nationalist leaders using ethnicity to mobilize people into conflict. Yugoslavia in the late 1980s was, in Gagnon's view, on the verge of large-scale sociopolitical and economic change. He shows that political and economic elites in Belgrade and Zagreb first created and then manipulated violent conflict along ethnic lines as a way to short-circuit the dynamics of political change. This strategy of violence was thus a means for these threatened elites to demobilize the population. Gagnon's noteworthy and rather controversial argument provides us with a substantially new way of understanding the politics of ethnicity.

What was it about the situation in occupied Yugoslavia and the Serb officers' response to that state of affairs that prevented them from carrying out serious anti-Axis activity or engaging in effective collaboration? The author attends to the emergence, organization, and failure of the Chetniks, the regional particularities of the movement, and Mihailovic's efforts to establish his own authority over the widely scattered non-Communist armed formations. The author also discusses the domestic opposition to Tito and the complex reality of the national and political civil war in Yugoslavia.

It is also a meditation on the conflicting intersection of law and politics in achieving justice and peace. Le Monde’s review (November 3, 2000) of the original edition recommended Hazan’s book as a nuanced account of the Tribunal that should be a must-read for the new president of Yugoslavia. “The story Pierre Hazan tells is that of an institution which, over the course of the years, has managed to escape in large measure from the initial hidden motives and manipulations of those who created it (not only the Americans).” With insider interviews filling out every scene, author Pierre Hazan tells a chaotic story of war while the Western powers cobbled together a tribunal in order to avoid actual intervention, hoping to threaten international criminals with indictment and thereby to force an untenable peace. The international lawyers and judges for this rump world court started with nothing—no office space, no assistants, no computers, not even a budget—but they ultimately established the tribunal as an unavoidable actor in the Balkans. This development was also a reflection of the evolving political situation: the West had created the Tribunal in 1993 as an alibi in order to avoid military intervention, but in 1999, the Tribunal suddenly became useful to NATO countries as a means by which to criminalize Miloševic’s regime and to justify military intervention in Kosovo and in Serbia. Ultimately, this hastened the end of Miloševic’s rule and led the way to history’s first war crimes trial of a former president by an international tribunal. Ironically, this triumph for international law was not really intended by the Western leaders who created the court. They sought to placate, not shape, public opinion. But the determination of a handful of people working at the Tribunal transformed it into an active agent for change, paving the road for the International Criminal Court and greatly advancing international criminal law. Yet the Tribunal’s existence poses as many questions as it answers. How independent can a U.N. Tribunal be from the political powers that created it and sustain it politically and financially ? Hazan remains cautious though optimistic for the future of international justice. His history remains a cautionary tale to the reader: realizing ideals in a world enamored of realpolitik is a difficult and often haphazard activity.

Critical and timely, this study contributes to existing scholarship in many different ways. It is the first legal analysis to focus on the dilemma of prosecuting and punishing wartime gender-based crimes in the statutory laws of the international criminal tribunals and the ICC in the context of fair labelling. Moreover, it emphasizes that applying fair labelling to wartime gender-based crimes would enable the tribunals and the ICC to deliver fair judgments, eliminate inconsistent prosecution, overcome shortcomings in addressing gender-based crimes within their jurisprudence, while breaking the cycle of impunity for these crimes. Consisting of two parts, this work begins by outlining the central focus and theoretical legal framework of the study.
