Book Synopsis Underwriters of the United States by : Hannah Farber

Available in PDF, EPUB and Kindle. Book excerpt: Unassuming but formidable, American maritime insurers used their position at the pinnacle of global trade to shape the new nation. The international information they gathered and the capital they generated enabled them to play central roles in state building and economic development. During the Revolution, they helped the U.S. negotiate foreign loans, sell state debts, and establish a single national bank. Afterward, they increased their influence by lending money to the federal government and to its citizens. Even as federal and state governments began to encroach on their domain, maritime insurers adapted, preserving their autonomy and authority through extensive involvement in the formation of commercial law. Leveraging their claims to unmatched expertise, they operated free from government interference while simultaneously embedding themselves into the nation's institutional fabric. By the early nineteenth century, insurers were no longer just risk assessors. They were nation builders and market makers. Deeply and imaginatively researched, Underwriters of the United States uses marine insurers to reveal a startlingly original story of risk, money, and power in the founding era.

Available in PDF, EPUB and Kindle. Book excerpt: This book places the marine insurance business of Amsterdam in the wider context of the political economy of Europe during the second half of the eighteenth century. The analysis is based on the simultaneous quotations of premiums for the twenty-two groups of destinations which formed a major part of the commerical matrix of the Netherlands. It considers the operation of the market at two levels. On the one hand, the provision of insurance responded to risk uncertainties in the market: in the 1760s and 1770s, Amsterdam experienced three serious unheavals, in the form of the financial crises of 1763 and 1772-73 and the hostilities leading to American independence and the Fourth Anglo-Dutch War. On the other hand, underwriters accepted risks in situations of structural uncertainty. The book is fully illustrated with graphs and maps and uses a wide range of original documents drawn from archives and libraries in Europe. An appendix provides the basic data of premiums quoted in the price-lists of the market.

Book Synopsis Perils of the Seas and Inherent Vice in Marine Insurance Law by : Ayça Uçar
Download or read book Perils of the Seas and Inherent Vice in Marine Insurance Law written by Ayça Uçar and published by Routledge. This book was released on 2020-10-28 with total page 198 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Supreme Court ruling in Global Process System Inc. v Syarikat Takaful Malaysia Berhad (The Cendor MOPU) created a shock wave in the London marine insurance market, as the Supreme Court decision changed the boundaries of doctrine with respect to the meaning of ‘perils of the sea’ and ‘inherent vice’. Both phrases play an important role in the insurance market, affecting both assureds and insurers and their respective interests under all classes of marine insurance policies. This book reviews the origin of the clauses ‘perils of the sea’ and ‘inherent vice’ by tracing back through the early cases in order to understand the origin and noting how and why the changes occurred. It will examine how the law has been developed in the recent cases and discuss whether the Supreme Court case The Cendor MOPU has overruled the previous cases in terms of the clauses ‘inherent vice’ and ‘perils of the sea’. Considering the impact of The Cendor MOPU decision with respect to the Marine Insurance Act 1906, as well as the standard Institute Cargo Clauses, it evaluates whether the decision is consistent with these things and discusses the effect of the decision on recent cases and on the insurance market.

Book Synopsis Maritime Risk Management by : Phillip Hellwege
Download or read book Maritime Risk Management written by Phillip Hellwege and published by Duncker & Humblot. This book was released on 2021-04-21 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: Insurance is a legal, an actuarial and a financial product, and it is one out of many risk management strategies. It follows that its history can only be studied in the broader context of the development of such strategies, applying an interdisciplinary approach. The theme of the present volume is maritime risk management. After an overview over the history of insurance, the contributions to the present volume examine different maritime risk management strategies by adopting a variety of methodological approaches. Some contributions focus on normative provisions, others contrast practice with legal scholarship, or focus on the emergence of insurance companies as opposed to individual insurers. Again, other contributions give insights in marine insurance practice in specific cities or analyse insurance practice through the lens of specific insurance litigation. As to the time frame, the different contributions span from antiquity to the nineteenth century.
