Available in PDF, EPUB and Kindle. Book excerpt: This collection provides a snapshot of big ideas in family law reform. The book asks: if you could change one part of family law, what would it be? This deceptively simple question is answered by 10 family law experts and debated within the volume by expert respondents. The book puts the proposal first, forcing authors (and their respondents) to critically engage with what family law should look like, and where the development of law is needed to address the changing landscape of family life. Cultural and religious plurality, the use of technology, and changes in societal attitudes have all had an impact on the continuing evolution of families. As a consequence, the law has some complex challenges to address in its attempt to regulate familial diversity. This book is an invaluable resource for scholars of family law, practitioners, policymakers, or anyone more broadly interested in family law reform, and serves as a companion to Hart Publishing's landmark Criminal Law Reform Now.

Book excerpt: Essay from the year 2023 in the subject Politics - Topic: Public International Law and Human Rights, , language: English, abstract: The law of recourse to force has changed dramatically over the last centuries. The concept of self-defense plays a fundamental role in international relations, shaping the interactions between states and defining the boundaries of acceptable behavior in the global arena. This research endeavors to delve into the complexities surrounding the application and interpretation of the principle of self-defense. By examining historical case studies, international legal frameworks, and contemporary geopolitical events, this study aims to shed light on the multifaceted dimensions of self-defense and the delicate balance between state sovereignty and collective security. The research begins by analyzing the evolution of ‘force’ and self-defense norms and doctrines, tracing their origins from customary international law to the modern legal framework established by the United Nations. It equally investigates the category of force for which self-defense becomes permissible. Furthermore, this research examines critically the debate on the boundaries of self-defense, and questions whether existing legal frameworks adequately address this contemporary challenge. By exploring these intricate dynamics, this research aims to contribute to the ongoing discourse on self-defense, especially in the light of Russia’s special military operation in Ukraine, and to provide insights into the evolving nature of international law and norms. It seeks to stimulate further dialogue among policymakers, legal experts, and scholars, with the ultimate goal of fostering a more nuanced understanding of self-defense and its implications for global peace and stability.

Book excerpt: This book highlights the cogency and urgency of the protection of indigenous peoples and discusses crucial aspects of the international legal theory and practice relating to their rights. These rights are not established by states; rather, they are inherent to indigenous peoples because of their human dignity, historical continuity, cultural distinctiveness, and connection to the lands where they have lived from time immemorial. In the past decades, a new awareness of the importance of indigenous rights has emerged at the international level. UN organs have adopted specific international law instruments that protect indigenous peoples. Nonetheless, concerns persist because of continued widespread breaches of such rights. Stemming from a number of seminars organised at the Law Department of the University of Roma Tre, the volume includes contributions by distinguished scholars and practitioners. It is divided into three parts. Part I introduces the main themes and challenges to be addressed, considering the debate on self-determination of indigenous peoples and the theoretical origins of ‘indigenous sovereignty’. Parts II and III explore the protection of indigenous peoples afforded under the international law rules on human rights and investments respectively. Not only do the contributors to this book critically assess the current international legal framework, but they also suggest ways and methods to utilize such legal instruments towards the protection, promotion and fulfi lment of indigenous peoples’ rights, to contribute to the maintenance of peace and the pursuit of justice in international relations. Book excerpt: Many different, and even opposite, meanings are ascribed to the term `sources' of international law. The author of this work goes back to the meaning of the term `source' in general (spring or well) and analyses in detail the various sources of international law. He first explains the sources of general, and then those of particular international law. He starts with general principles of law, which is followed by common features of customary process of whatsoever kind, and then by general and by particular customary law. Custom will be followed by unilateral acts of States and with opposable situations in international law which are closely linked with this kind of sources of international law. The explanation ends with treaties in regard to which there are the least doctrinal controversies. The explanation cannot be quite homogeneous. There are still deep doctrinal misunderstandings in respect to general principles of law and of unilateral acts of States. The author therefore offers a critical analysis of representative views of other authors and tries to reach solutions to problems presented. He also gives a systematic explanation of recent pronouncements of international courts and tribunals with regard to customary law, and he examines the specific solutions prescribed in the 1969 Vienna Convention on the Law of Treaties.
