Applicable entities that do not meet certain performance requirements, based on the results of their vulnerability assessments, must develop a plan to achieve the performance requirements. In addition, the Commission directs NERC to develop modifications to Reliability Standard TPL-007-1: To modify the benchmark GMD event definition set forth in Attachment 1 of Reliability Standard TPL-007-1, as it pertains to the required GMD Vulnerability Assessments and transformer thermal impact assessments, so that the definition is not based solely on spatially-averaged data; to require the collection of necessary geomagnetically induced current monitoring and magnetometer data and to make such data publicly available; and to include a one-year deadline for the development of corrective action plans and two and four-year deadlines to complete mitigation actions involving non-hardware and hardware mitigation, respectively. The Commission also directs NERC to submit a work plan and, subsequently, one or more informational filings that address specific GMD-related research areas. The Commission is making these clarifications and refinements to fulfill its statutory responsibility of preventing undue discrimination and undue preference while providing developers the ability to bilaterally negotiate rates, terms, and conditions for the full amount of transmission capacity with potential customers. These clarifications and refinements will be implemented within the Commission's existing four-factor analysis used to evaluate requests for negotiated rate authority for transmission service. The Commission will apply this policy statement on a prospective basis to filings received after this issuance. The purpose of the NOPR is to solicit comments on proposed FERC regulatory rules that would encourage transmission system owners to participate in regional transmission organizations. Such organizations would manage various aspects of the operation and expansion of the nation's high-voltage electricity transmission system to support developing competitive wholesale and retail electric generation service markets that rely on these transmission networks. Regional integration of transmission systems is thought to be required in order to manage more effectively transmission network operations, to internalize various network externalities, and to facilitate the development of competitive electricity markets. The FERC initiative aims to speed the development of such regional organizations. I prepared the attached comments in response to FERC's RTO NOPR. My comments focus primarily on the future structure of the regulatory framework that governs how transmission system owners and operators will be compensated for providing transmission service. I also present a framework for evaluating the benefits and costs of not-for-profit ISOs that operate transmission facilities owned and maintained by others vs. for-profit Independent Transmission Companies (Transcos) that own, maintain, and operate their own transmission facilities.

Book excerpt: Vegetation Management around wood poles in Transmission Line ROW's in the Walla Walla Region (see attached checklist for identification). The proposed work will be accomplished in the indicated sections of the transmission line corridors with the easement width ranging from 0 to 200 feet. BPA proposes to clear unwanted vegetation around wood poles and switch platforms. The vegetation clearing around wood poles is for fire protection. Over the last 3 years, BPA has been able to increase reliability and reduce losses due to rangeland fires by applying a soil residual herbicide as a wood pole fire treatment around wood pole structures which provide a 10 to 15 foot vegetation free area at our structure sites. It is estimated that over 200 structures have been saved in areas where this program has been implemented. The need to implement this Program on BPA is beneficial due to the increased reliability and the reduction of costs due to structure replacement. Line sectionalizing switches are located on transmission towers that redirect electricity on the right-of-way. It is required for the area below the sectionalizing switch platform to be kept completely clear of vegetation. All work will be executed in accordance with the National Electrical Safety Code and BPA standards. Follow-up herbicide treatment will occur during routine patrols to eliminate any vegetation growing within 10 to 15 feet of the wood poles.
