Book excerpt: Excerpt from Reports of Cases Argued and Determined in the Supreme Court of Louisiana, Vol. 1: From October, 1841, to March, 1842 In conformity with the interpretation generally placed upon the acts regulating the manner of reporting the decisions of the Supreme Court, in force prior to the last session of the General Assembly, my predecessors considered themselves bound to pub lish a report of every case determined by the court. Under a system of jurisprudence which allows an appeal to the Supreme Court, in every civil case in which the amount in dispute exceeds a small sum, at the discretion of the party, and on questions of fact as well as of law, the publication of every decision necessarily led to the rapid and expensive accumulation of volume upon vo lume, increasing in a ratio proportioned to the augmentation of the population and business of the country, and to the consequent multi plication of its laws. The continuance of this practice is to be deprecated, not only as entailing a heavy annual expense upon the state and the profession, but, in as much as a large proportion of every volume must unavoidably consist of matter of little or no value, as calculated to diminish the usefulness of the reports of the really important cases, by burying them in a mass of unprofitable matter, rendering them at once more expensive to be purchased, and more inconvenient for use when obtained. The ninth section of that act vests the judicial power of the territory in a supreme court, district courts, probate courts, and justices of the peace. The supreme court consists of a chief justice and two associate justices, who are required to hold a term at the seat of government of the territory, annually. The terri tory is divided into three judicial districts, and a district court is held in the several organized counties of each dis triet, by one of the justices of the supreme court. The first term of the supreme court of Idaho was held in Boise city, the seat of government of the territory, com mancing in January, 1866. In the year 1867, a small vol ume of the decisions rendered was published, and called Vol ume 1 of Idaho Reports; but as these decisions are now out of print, the act of the legislature, approved December 28, 1880, authorizing the publication of this volume, pro vides that it shall contain all the decisions of the court from its organization to the present time; and, to distinguish it from the volume above referred to, the act provides that this shall be known as Volume 1, New Series. Book excerpt: Excerpt from Reports of Cases Argued and Determined, Vol. 1: In the Supreme Court of Ohio But few, comparatively speaking, of the circuit decisions of the Supreme Court have been reported. Several are contained in the first volume of Ohio Reports, having been published therein, by order of the judges, under the law above mentioned, and some cases may be found in the Western Law Journal. The only volume of circuit decisions is Wright's Reports of cases decided in the years 1831 to 1834, inclusive, While he was on the bench. The only vol ume of common pleas decisions is Tappan's Reports, published in 1831. The cases contained in it were decided in 1816, 1817, 1818, and 1819. Three courts were created by the general assembly under the constitution Of 1802, namely, the Superior and Commercial Courts of Cincinnati and the Superior Court Of Cleveland. They ceased to exist on the second Monday of February, 1853, when their nu finished business was transferred to the Courts of Common Pleas.
