The conventional wisdom is that it was instituted during the Johnson and Nixon years through the backroom machinations of federal bureaucrats and judges. The Fifth Freedom presents a new perspective, tracing the roots of the policy to partisan conflicts over fair employment practices (FEP) legislation from the 1940s to the 1970s. Drawing on untapped sources, Anthony Chen chronicles the ironic, forgotten role played by American conservatives in the development of affirmative action. Decades before affirmative action began making headlines, millions of Americans across the country debated whether government could and should regulate job discrimination. On one side was an interfaith and interracial bloc of liberals, who demanded FEP legislation that would establish a centralized system for enforcing equal treatment in the labor market. On the other side was a bloc of business-friendly, small-government conservatives, who felt that it was unwise to "legislate tolerance" and who made common cause with the conservative wing of the Republican party. Book excerpt: The early returns from Census 2000 data show that the United States continued to undergo dynamic changes in the 1990s, with cities and suburbs providing the locus of most of the volatility. Metropolitan areas are growing more diverse—especially with the influx of new immigrants—the population is aging, and the make-up of households is shifting. Singles and empty-nesters now surpass families with children in many suburbs. The contributors to this book review data on population, race and ethnicity, and household composition, provided by the Census's "short form," and attempt to respond to three simple queries: —Are cities coming back? —Are all suburbs growing? —Are cities and suburbs becoming more alike? Regional trends muddy the picture. Communities in the Northeast and Midwest are generally growing slowly, while those in the South and West are experiencing explosive growth ("Warm, dry places grew. Cold, wet places declined," note two authors). Some cities are robust, others are distressed. Some suburbs are bedroom communities, others are hot employment centers, while still others are deteriorating. And while some cities' cores may have been intensely developed, including those in the Northeast and Midwest, and seen population increases, the areas surrounding the cores may have declined significantly. Trends in population confirm an increasingly diverse population in both metropolitan and suburban areas with the influx of Hispanic and Asian immigrants and with majority populations of central cities for the first time being made up of minority groups. Census 2000 also reveals that the overall level of black-to-nonblack segregation has reached its lowest point since 1920, although high segregation remains in many areas. What is at stake for those who want to restrict marriage and for those who seek to extend it? Why has the issue become such a national debate? These questions can be answered only by viewing marriage as a political institution as well as a religious and cultural one. In its political dimension, marriage circumscribes both the meaning and the concrete terms of citizenship. Marriage represents communal duty, moral education, and social and civic status. Yet, at the same time, it represents individual choice, contract, liberty, and independence from the state. According to Priscilla Yamin, these opposing but interrelated sets of characteristics generate a tension between a politics of obligations on the one hand and a politics of rights on the other.
