Most of the articles prove that secularism of the contemporary state ruled by law targets Christian symbolism (cross, cradle, the Decalogue). Christian religious symbols shall always be inscribed in the temporal order, otherwise they have no chance to be displayed in the public sphere. In this way, the rights of Catholic believers, as one of the dominant religious groups, are restricted in the name of the protection of religious and areligious minorities. As a result, the aim is to bring about the actual equality of all religions and – ultimately – the final removal of the Christian tradition from Western culture. Against this background, Polish (as well as Hungarian and Italian) judicial decisions present a different approach, which – as the authors of the volume prove – presents a position in favour of the presence of religious symbolism in the public sphere. The multifaceted evaluation of the inconsistency, casuistry and nuance of the jurisprudence of the US Supreme Court is extremely creative and interesting. It allows to conclude that the jurisprudence of the US Supreme Court, which usually limits the presence of religious symbols in the public forum, has not yet become universally binding. Book excerpt: After the fall of the state socialist regime and the end of martial law in 1989, Polish society experienced both a sense of relief from the tyranny of Soviet control and an expectation that democracy would bring freedom. After this initial wave of enthusiasm, however, political forces that had lain concealed during the state socialist era began to emerge and establish a new religious-nationalist orthodoxy. While Solidarity garnered most of the credit for democratization in Poland, it had worked quietly with the Catholic Church, to which a large majority of Poles at least nominally adhered. As the church emerged as a political force in the Polish Sejm and Senate, it precipitated a rapid erosion of women’s reproductive rights, especially the right to abortion, which had been relatively well established under the former regime. The Politics of Morality is an anthropological study of this expansion of power by the religious right and its effects on individual rights and social mores. It explores the contradictions of postsocialist democratization in Poland: an emerging democracy on one hand, and a declining tolerance for reproductive rights, women’s rights, and political and religious pluralism on the other. Yet, as this thoroughly researched study shows, women resist these strictures by pursuing abortion illegally, defying religious prohibitions on contraception, and organizing into advocacy groups. As struggles around reproductive rights continue in Poland, these resistances and unofficial practices reveal the sharp limits of religious form of governance.

Book excerpt: Jewish life in early modern Poland was characterized by an adherence to Jewish law (halakhah) that Polish Jewry had inherited from medieval Franco-German Jewry, and almost all aspects of Jewish activity, even the most personal of matters, fell within its purview. Jewish law remained constant throughout the ages in some areas, but in others rabbis were forced to reinterpret it in light of the complexities of contemporary life. Edward Fram draws upon the ordinances of Polish Jewry's political leadership, Polish legal records, and the responsa of some of the outstanding poseqim of the sixteenth and seventeenth centuries to show how Polish jurists responded to those complexities. His case studies, gleaned from a period of exceptional creativity in the annals of Polish Jewry, deal with weddings on the Sabbath, the rights of daughters to familial wealth, women in the marketplace, the personal reliability of those who dealt in the sale of kosher wine, competition among Jews for sources of livelihood obtained through leases (arendy), the transfer and payment of personal debts via bills payable to bearers (membrany), and personal insolvency. Concerned with the needs of the underprivileged as well as those of the marketplace, these rabbis struggled to maintain the integrity of Jewish communal life and to preserve the tradition they perceived to represent divine law. Particularly in commerce, failure to observe Jewish law or at least the independent direction taken by the lay leadership often became the basis for communal legislation and practice. Fram shows how the Polish community, at times consciously and at times unconsciously, transformed some of its traditional values until they may have been unrecognizable to Jews from an earlier age..
