The earliest reference to the Order in France is in a fragment preserved in the Bibliotheque de l'Arsenal called, La regle et vie de Frere Franfois, pauvre et humble hermite de Paule, laquelle donne a tous ses 2 freres voulant entrer et vivre en son ordre. The dating of this manuscript should be accepted with considerable reserve; it bears a clearly legible "1474," although it seems most unlikely that any reference to an Order occurred before the Bull of 1493 or that any Rule appeared in French before the Founder's visit to Louis XI in 1483. 3 The fame of Francis and his reputation as a "guerisseur" had reached the French court where Louis XI was sick and dying; the King summoned him to the chateau of Le Plessis-Ies-Tours, but it required the intervention of the Pope to make the hermit undertake the journey

Book excerpt: Combining a broad analysis of political culture with a particular focus on rhetoric and strategy, Jeffrey Sawyer analyzes the role of pamphlets in the political arena in seventeenth-century France. During the years 1614-1617 a series of conflicts occurred in France, resulting from the struggle for domination of Louis XIII's government. In response more than 1200 pamphlets—some printed in as many as eighteen editions—were produced and distributed. These pamphlets constituted the political press of the period, offering the only significant published source of news and commentary. Sawyer examines key aspects of the impact of pamphleteering: the composition of the targeted public and the ways in which pamphlets were designed to affect its various segments, the interaction of pamphlet printing and political action at the court and provincial levels, and the strong connection between pamphlet content and assumptions on the one hand and the evolution of the French state on the other. His analysis provides new and valuable insights into the rhetoric and practice of politics. Sawyer concludes that French political culture was shaped by the efforts of royal ministers to control political communication. The resulting distortions of public discourse facilitated a spectacular growth of royal power and monarchist ideology and influenced the subsequent history of French politics well into the Revolutionary era. Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups

World War II and the division of France into two ideological camps, each asking for legitimacy from the colonized, opened for Africans numerous unprecedented options. French Colonialism Unmasked analyzes three dramatic years in the history of FWA, from 1940 to 1943, in which the Vichy regime tried to impose the ideology of the National Revolution in the region. Ruth Ginio shows how this was a watershed period in the history of the region by providing an in-depth examination of the Vichy colonial visions and practices in fwa. She describes the intriguing encounters between the colonial regime and African society along with the responses of different sectors in the African population to the Vichy policy. A glimpse at the general judicial latitude generally afforded to parodies, satires, caricatures, and pastiches demonstrates the social and cultural value of this particular form of artistic expression. With the advent of technologies and the evolution of copyright legislation, creative endeavours in the form of parody gathered a new youth but became unlawful. While copyright law grants exclusive rights to right-holders, this right is not absolute. Legislation includes specific exceptions, which preclude right-holders from exercising their prerogatives in particular cases which foster creativity and cultural diversity within that society. The parody exception pertains to this ultimate objective by permitting users to reproduce copyright-protected materials for the purpose of parody. To understand the meaning and scope of the parody exception, this book examines and compares five jurisdictions which differ in their protection of parodies: France, Australia, Canada, the US and the United Kingdom. This book is concerned with finding an appropriate balance between the protection awarded to right-holders and the public interest. This is achieved by analysing the parody exception to the economic rights of right-holders, the preservation of moral rights and the interaction of the parody exception with contract law. As parodies constitute an artistic expression protected under the right to freedom of expression, this book also considers the influence of freedom of expression on the interpretation of this specific copyright exception. Furthermore, this book aims at providing guidance on how to resolve conflicts where fundamental rights are in conflict. This is the first book in English to offer an in-depth investigation into the parody exception in copyright law, and comments on industry practices linked to this form of creative endeavours.
