Desde esta perspectiva, la novedad de este libro estriba en indagar en:1) el pensamiento jurídico que motivó las reformas del 2011 y del 2012 para acompasar la negociación colectiva española y los ideales de competitividad en una economía global;2) el impacto que ello causó en la estructura de dicha negociación colectiva y en la prohibición de concurrencia de los convenios colectivos de eficacia general;3) las relaciones entre estos convenios y otros pactos de empresa de muy diferente naturaleza sobrevenidos para subvertir las dificultades de la aplicación de los convenios colectivos de sector en las empresas que componen un tejido cada vez más dúctil e inestable;4) la introducción en la jerarquía de fuentes de los planes de igualdad y su forma de cambiar indirectamente la negociación de ciertas condiciones de trabajo;5) otras formas de negociación de pactos que, por la fuerza expansiva y atractiva de los convenios colectivos y de la fijación de las condiciones de trabajo en ellos realizada, se están celebrando con pseudo trabajadores -los autónomos económicamente dependientes-, y en el sector público para su personal funcionario imbuidos por las limitaciones del Derecho administrativo; y6) los modelos de negociación colectiva en sus trazos generales aportados por tres ordenamientos jurídicos foráneos e influyentes en el nuestro propio, aludiendo con ello a Alemania, Portugal e Italia. En definitiva, partiendo de las bases doctrinales clásicas ya mencionadas, se intenta mostrar los aspectos más recientes, versátiles e, incluso, arriesgados de la negociación colectiva en España en un intento de revalorizarla como mejor escudo protector de las diferentes formas de prestación de servicios que, superando la tradicional subordinación, se ubican en la dependencia económica, y ello a la luz del recién promulgado Real Decreto-ley de 28 de diciembre, de medidas urgentes para la reforma laboral, la garantía de la estabilidad en el empleo y la transformación del mercado de trabajo. Y, en definitiva, no es posible omitir que todas autoras son mujeres, afrontando el reto de investigar sobre un tema, el de la negociación colectiva, que ha sido substraído en ocasiones a su competencia. Book excerpt: In many EU Member States, the various economic crises of recent years provided grounds for a rarely equalled level of state intervention in the regulation of labour relations with an explicit aim: the decentralisation of collective bargaining. An extensive body of research – summed up and analysed expertly in the chapters of this very important book – reveals that the process of decentralisation has more often than not led to a situation where salaries and labour conditions are ever more frequently determined by direct negotiations between employer and employees, with the State becoming the sole guarantor of employee protection even as it encourages decreasing labour costs to ensure that companies remain competitive. The comparative approach offered in this book adds to this synthesis by providing examples of speci c recent developments in fourteen Member States and Turkey. Among the numerous topics and issues that arise are the following: – ‘opt-out’ clauses that derogate unfavourably from sectoral agreement standards; – extension of the employer’s unilateral decision-making power; – ‘memoranda of understanding’ imposed by the ‘troika’ (EU, ECB, and IMF); and – ‘stand-by arrangements’ imposed by the IMF. However, notwithstanding the strong emphasis on changing the structure of collective agreements by shifting the centre of gravity closer to the company, research nds promise in the reconstituted support for sector-level agreements increasingly found among very small businesses, networked businesses, and work via digital platforms. Book excerpt: Armed conflicts are a major cause of forced displacement, but people displaced by conflict are often not recognized as refugees under the 1951 Convention Relating to the Status of Refugees. They are frequently considered as having fled from generalized violence rather than from persecution. This book determines the international meaning of the refugee definition in Article 1A(2) of the Convention as regards refugee protection claims related to situations of armed conflict in the country of origin. Although the human rights based interpretation of the refugee definition is widely accepted, the interpretation and application of the Convention as regards claims to refugee status that relate to armed conflict is often marred with difficulties. Moreover, contexts of armed conflict pose the question of whether and to what extent the refugee definition should be interpreted in light of international humanitarian law. This book identifies the potential and limits of this interpretative approach. Starting from the history of international refugee law, the book situates the 1951 Convention within the international legal framework for the protection of the individual in armed conflict.
