Available in PDF, EPUB and Kindle. Book excerpt: Since 2010, a significant quantity of international climate change finance has begun to reach developing countries. However, the transfer of finance under the international climate change regime – the legal and ethical obligations that underpin it, the constraints on its use, its intended outcomes, and its successes, failures, and future potential – constitutes a poorly understood topic. Climate Change Finance and International Law fills this gap in the legal scholarship. The book analyses the legal obligations of developed countries to financially support qualifying developing countries to pursue globally significant mitigation and adaptation outcomes, as well as the obligations of the latter under the international regime of financial support. Through case studies of climate finance mechanisms and a multitude of other sources, this book delivers a rich legal and empirical understanding of the implementation of states’ climate finance obligations to date. The book will be of interest to scholars and students of international law and policy, international relations, and the maturing field of climate change law.

Book excerpt: Covering the ethical dimensions of international-level adaptation funding, a subject of growing interest in the climate change debate, this book provides a theoretical analysis of the ethical foundations of the UNFCCC regime on adaptation funding, one that culminates in the definition of a framework of justice. The text features an interpretative analysis of the ethical contents of the UNFCCC funding architecture by applying the framework of justice proposed to different areas of empirical investigation. The book offers scholars working on climate change, international relations, and environmental politics an analysis characterized by both theoretical soundness and empirical richness. The comprehensiveness of the book’s approach should make it possible to plan and implement international adaptation funding more effectively, and eventually to define more just funding policies and practices.

Book excerpt: Preventing risks of severe damage from climate change not only requires deep cuts in developed country greenhouse gas emissions, but enormous amounts of public and private investment to limit emissions while promoting green growth in developing countries. While attention has focused on emissions limitations commitments and architectures, the crucial issue of what must be done to mobilize and govern the necessary financial resources has received too little consideration. In Climate Finance, a leading group of policy experts and scholars shows how effective mitigation of climate change will depend on a complex mix of public funds, private investment through carbon markets, and structured incentives that leave room for developing country innovations. This requires sophisticated national and global regulation of cap-and-trade and offset markets, forest and energy policy, international development funding, international trade law, and coordinated tax policy. Thirty-six targeted policy essays present a succinct overview of the emerging field of climate finance, defining the issues, setting the stakes, and making new and comprehensive proposals for financial, regulatory, and governance mechanisms that will enrich political and policy debate for many years to come. The complex challenges of climate finance will continue to demand fresh insights and creative approaches. The ideas in this volume mark out starting points for essential institutional and policy innovations.

Available in PDF, EPUB and Kindle. Book excerpt: Climate change governance is in a state of enormous flux. New and more dynamic forms of governing are appearing around the international climate regime centred on the United Nations Framework Convention on Climate Change (UNFCCC). They appear to be emerging spontaneously from the bottom up, producing a more dispersed pattern of governing, which Nobel Laureate Elinor Ostrom famously described as 'polycentric'. This book brings together contributions from some of the world's foremost experts to provide the first systematic test of the ability of polycentric thinking to explain and enhance societal attempts to govern climate change. It is ideal for researchers in public policy, international relations, environmental science, environmental management, politics, law and public administration. It will also be useful on advanced courses in climate policy and governance, and for practitioners seeking incisive summaries of developments in particular sub-areas and sectors. Available in PDF, EPUB and Kindle. Book excerpt: Drawing on a range of expert contributions, this book explores how the European Green Deal is being deployed in practice and observes how the EU tries to promote the protection of the environment in third countries. This book begins by assessing the state of the art in terms of the key conceptual issues and analyses sectoral initiatives that are particularly relevant for the deployment of the European Green Deal external dimensions. These include the Carbon Border Adjustment Mechanism, the EU’s regulatory action in the control of maritime emissions, the 2030 Biodiversity Strategy, the Deforestation Initiative, the Zero Pollution Initiative, the From Farm to Fork Initiative, and the Climate Neutrality and Clean Energy Initiative in the context of the Energy Charter Treaty. Next, the authors deal with horizontal aspects of the European Green Deal that also have external dimensions, such as the Green Deal Diplomacy, the Green Public Procurement, funding measures, initiatives related to corporate sustainability and due diligence, and the implementation and enforcement of EU environmental law. This volume concludes with a cross-cutting analysis, focusing on how the EU can strengthen the impact of its normative power on international environmental governance, while also noting its limitations. Deploying the European Green Deal will be of great interest to students and scholars of international and EU environmental law and environmental policy and governance. Available in PDF, EPUB and Kindle. Book excerpt: While significant attention has been devoted to achieving Sustainable Development Goal 13 (SDG 13) and scaling up climate finance for developing countries, the adverse impacts of funded projects on local communities remains inadequately explored by both academics and policymakers. Mobilizing climate finance on an unprecedented scale is undeniably vital for the success of developing countries’ climate policies. However, these initiatives often give rise to adverse consequences for individuals in these countries, leading to displacements, exacerbating food insecurity, or even triggering conflicts over resources. This book examines the extent to which the climate funds established for achieving SDG 13 are adequate for addressing climate change impacts in developing countries. Yet, its analysis transcends the mere evaluation of the sufficiency or efficacy of these efforts found in much of the existing literature. Beyond the scope of quantifiable success, the book delves into the root causes of the adverse impacts that these funds can have on local communities and offers tailored recommendations to realize the noble aspirations of SDG 13, all without implying that the individuals who should benefit from climate finance are the ones who pay in the end.

Book excerpt: This research deals with the legal responsibility of states to provide climate finance to developing countries in order to facilitate climate mitigation and adaptation. The research demonstrates that the area of climate finance has not escaped globalization, where global actors operating at a level beyond the state (the UNFCCC and several Climate Funds) have increasingly taken over some of the climate finance functions previously performed by states. Against this backdrop, the thesis also examines the role of international bodies in providing climate finance, assesses to what extent these bodies are accountable to affected local stakeholders, and puts forward recommendations to foster increased accountability. The research project employs Global Administrative Law (GAL) as a normative framework for assessing and fostering accountability. This thesis is relevant, first and foremost, as an examination of the extent to which global climate finance is adequate for addressing climate change impacts in developing countries. To this end, it engages in a detailed analysis of the international legal framework for climate change and of the relevant financial instruments. It also engages in a normative evaluation of these instruments using the standards proposed by GAL. In keeping with this, the research gives substance and a better definition to these standards. As such, the thesis has the potential to contribute not only to the literature on climate finance, but also to the literature on GAL. It also sheds light on the relationship between climate finance and GAL, a topic that has been largely neglected in the academic literature so far.
