Excerpt: ...the owner of said tract of a large portion thereof, and to unlawfully obtain 449 the same for the estate of Maria Josefa Cavazos, and also to prevent the line of the Paredes tract from being correctly established, so as to exclude by such survey from said tract the whole of Fort Brown reservation; and defendant Stillman, having made himself a party in fact to said litigation, he is concluded by the final decree in said cause, independently of the fact of his being in privity of estate with Maria Josefa Cavazos, whose administrator and estate were parties to said suit. The plaintiffs are informed and believe that the report and map made by the surveyor and commissioners and filed by them in said suit No. 1346, and approved by the court, as aforesaid, have been extract-from the files and record of said suit; but the plaintiffs charge that defendant Carson has copies of the same. 2. And the plaintiffs aver and represent that after the district court of Cameron county, in said suit No. 1346, in said final decree of May 27th, 1889, had in all things approved and confirmed and made final the survey and report of the surveyor and the commissioners therein, by which more than one-half of Fort Brown reservation, was shown to be situated on the Paredes tract, the said court, by the procurement of said defendant Carson and others acting with him, and without the knowledge or consent of plaintiff C. B. Combe, executor, who was then the sole executor of Stephen Powers, deceased, inserted in said final decree a provision to the effect, substantially as follows: That neither the field notes of said Paredes tract, which were set out in said decree and made a part thereof, and which show that the lines of said Paredes tract were, by the survey made, as...
