Available in PDF, EPUB and Kindle. Book excerpt: In any account of twentieth-century Canadian law, Bora Laskin (1912-1984) looms large. Born in northern Ontario to Russian-Jewish immigrant parents, Laskin became a prominent human rights activist, university professor, and labour arbitrator before embarking on his 'accidental career' as a judge on the Ontario Court of Appeal (1965) and later Chief Justice of Canada (1973-1984). Throughout his professional career, he used the law to make Canada a better place for workers, racial and ethnic minorities, and the disadvantaged. As a judge, he sought to make the judiciary more responsive to modern Canadian expectations of justice and fundamental rights. In Bora Laskin: Bringing Law to Life, Philip Girard chronicles the life of a man who, at all points of his life, was a fighter for a better Canada: he fought antisemitism, corporate capital, omnipotent university boards, the Law Society of Upper Canada, and his own judicial colleagues in an effort to modernize institutions and re-shape Canadian law. Girard exploits a wealth of previously untapped archival sources to provide, in vivid detail, a critical assessment of a restless man on an important mission.

Available in PDF, EPUB and Kindle. Book excerpt: The Society of Legal Scholars, originally the Society of Public Teachers of Law, was created in 1909, but was fortunate to survive its first half century. It had few members, lacked financial resources and was weak in influence. In comparison with other university disciplines Law enjoyed a fragile status, and was often held in low esteem by barristers and solicitors. At times the SPTL was caught up in problems of its own making, for instance refusing to admit women until the late 1940s. But there were also moments of excitement and achievement: the years between 1909 and the start of WWI were full of hope and new ideas and the establishment of the Journal of the Society of Public Teachers of Law in the 1920s was an important achievement for legal scholars. During the social revolution of the 1960s the SPTL continued to function as a rather sedate gentleman's club, gathering at its annual conference to socialise, rather than to engage in academic debate. The 1970s saw a sustained drive from its Young Members' Group to create a new, more serious organisation, with better conferences and more effective decision-making processes. The Society evolved slowly, but the process accelerated in the 1990s, with members encouraged to reinforce their intellectual contribution to the discipline and act as a central point for policy debate within the legal academic community. As we stand at the beginning of the twenty first century, the Society, with nearly 3,000 members, has come a long way from its small beginnings.

Available in PDF, EPUB and Kindle. Book excerpt: “It’s a girl!” the Ontario press announced, as Canada’s first woman lawyer was called to the Ontario bar in February 1897. Quiet Rebels explores experiences of exclusion among the few women lawyers for the next six decades, and how their experiences continue to shape gender issues in the contemporary legal profession. Mary Jane Mossman tells the stories of all 187 Ontario women lawyers called to the bar from 1897 to 1957, revealing the legal profession’s gendered patterns. Comprising a small handful of students—or even a single student—at the Law School, women were often ignored, and they faced discrimination in obtaining articling positions and legal employment. Most were Protestant, white, and middle-class, and a minority of Jewish, Catholic, Black, and immigrant women lawyers faced even greater challenges. The book also explores some changes, as well as continuities, for the much larger numbers of Ontario women lawyers in recent decades. This longitudinal study of women lawyers’ gendered experiences in the profession during six decades of social, economic, and political change in early twentieth-century Ontario identifies factors that created—or foreclosed on—women lawyers’ professional success. The book’s final section explores how some current women lawyers, despite their increased numbers, must remain “quiet rebels” to succeed.
